Draft Minutes Meeting Fossoway and District Community Council
Tuesday January 7th 2014, Blairingone Primary School

Attending: Sandy Morrison, Kevin Borthwick, Alastair Lavery, Trudy Duffy-Wigman, Angus Cheape, Graham Pye, Cllrs M Barnacle, D Cuthbert and W Robertson and 7 Members of the Public (MoP).

Apologies: Rod Paterson, Cllrs J Giacopazzi

Declarations of interest: None.

Community Policing: Report was not received as of start of meeting. Cllr Barnacle met with Inspector Sangster, the Convenor of Safety and Cllr Giacopazzi to discuss the proposed counter closures, however no reassurance was given that there may not be any further reductions in police numbers in Kinross. The CC will write to the Police authority and seek reassurance about this, and also to request that the area report is always received in time for this meeting if the Community Officer is unable to be present.

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
• Glendevon / Rumbling Bridge Hydro Scheme: The application has been approved. Hugh Wallace will attend the next meeting to give an update. Although there were representations from local residents at the DMC, local councillors thought that this was a worthwhile scheme and voted in favour of it. Alastair had previously complained to PKC that this CC’s comments had not been included in the planner’s report, and as a result the convenor presented our comments at the start of the DMC meeting.
• Blairingone War Memorial: The wall at the rear of the cemetery was partly demolished during the recent storms, which may mean that the memorial has to be moved to a different place.
• Crook of Devon Church Car Park: on-going.
• Travellers’ Site at Crook Moss, Crook of Devon: The CC is waiting for a date when the enforcement action will take place, as the conditions are due to be met in early January. Councillor Barnacle intended to take this up, as the travellers representative had confirmed his client was keen to meet all the conditions within 3 months. The CC will remind PKC of the timescales. There was extensive discussion amongst all present about the proliferation of Traveller sites in Kinross, and how they seem not to be handled in the same way as normal applications. MoP asks for definition of a traveller – it’s self-defining, as long as an applicant can convince council officials of their status.
• Glenquey Quarry: The next DMC meeting that could include this application is the 19th February.
• Glendevon Pollution Incident: No developments to report. The CC will contact SEPA again to determine when a result is likely to be published once the legal proceedings are completed.

CC Business:

Community Workshops: The workshops are planned for 18th March in Powmill and 25th March in Blairingone. More details to follow when available. The CC has responded to an email from PKC that had suggested postponing the Powmill workshop, saying that it should go ahead as planned.

Community Speed Watch: Cllr Robertson reports that a business case is being put forward by PKC to fund a Police-based post, a decision will be available in the next couple of months, and it’s widely supported. There was some discussion about the 40mph limits on the new Green Routes, which are thought to be too high.

Bus Investment Fund: Cllr Barnacle reports that there is interest from Clacks in this scheme too. Local Cllrs will seek information about the progress of this scheme for the next meeting.

Walkmill Play Park: On-going.

PKC Councillors’ reports:
Cllr D Cuthbert: M90 Junction 7 upgrade is supported by all four local councillors – It has been suggested by the Scottish Government that this should be financed by planning gains from local applications, but Nick Brian says this is unlikely to be feasible. Cllr Robertson notes that as it concerns the M90 it should be financed by the Scottish Government, and he has replied to that effect. However there is an intention to include this in the next PKC roads review. MoP asks when the passing places required as a condition of the development at Easter Muirhead Equestrian Centre will be constructed – Cllr Cuthbert will contact the Enforcement Officer.

Cllr M Barnacle: The LDP has now been approved, and in the main the final result after the Reporter’s changes is reasonable. However there seems to be a flaw in the democratic process since the Councillors have no opportunity to comment on the Reporter’s changes. Cllr Barnacle has written to Andy Clegg about cessation of maintenance of the St Serfs Road, Crook of Devon footpath, and this will be looked at again. Naemoor Road to River Devon footpath work __has now been done, although minor flooding issues that have now become apparent are still to be addressed.

Cllr W Robertson:__ Perth City Hall is proposed to be demolished at a cost of £3.5 million since there was no viable plan for its future use. The £40 million re-development of the Perth theatre is mostly financed by the Gannochy Trust, which might impact other projects that have been funded by this trust in the past. MoP asks about A91 drain blockage, Cllr Robertson will ask for it to be investigated.

Cllr J Giacopazzi: Cllr was not present, but he had reported that Loch Leven Community Centre library opening hours had been reduced due to finance cuts which were implemented without any local consultation. School children will still be able to access library facilities during the Monday closure. In spite of these cuts, the opening hours are still longer than they were before the Campus was opened. More resources will be directed towards mobile libraries. Cllr Barnacle hopes that something can be included in this year’s financial plans to address this problem.

Planning:
13/02195/FLL. Extension to dwelling house. Mutehill, Powmill, Dollar FK14 7NP
No Community Council comment

07/00555/FLL. Plot 5A Powmill has been withdrawn.

SP Power Systems have confirmed that the upgrade to the overhead power line between Kincardine and Blairingone does only consist of replacing the insulators with new ones to suit the higher voltage of the line, and the existing towers will be retained. Detailed plans for consultation with, and compensation of, affected landowners are in place.

Cllr Barnacle reports that he is still requesting a site meeting with Nick Brian at Lambhill wood chip plant, and this has now been promised for February. It was agreed a pre-meeting should take place before the site meeting. Councillor Mike Barnacle to organise. John Anderson has had a meeting with Gordon Banks MP and PKC’s planning department at which it was shown that the legal precedent used to permit this development is not relevant in this case. The SEPA officer will also re-examine the site in the next few weeks.

Cllr Barnacle notes that the planning conditions for several items of the Braehead site at Rumbling Bridge have still not been done, even though they were promised by the end of December. The enforcement officer will visit shortly.

Correspondence: Kevin went through the correspondence which was all available for reading.

AOCB: PKC Criminal Justice – Application forms for work to be carried out by people on Community Service Orders have been received. Suggestions for work to be done under this scheme are welcome. The CC will ask the responsible officer to attend this meeting and explain the type of work that can be done.

Blairingone Notice Board – this suffered severe damage during the December storms. Repairs will take place in the next few weeks; meanwhile it will not be possible to add any new notices to it, and most notices previously posted have been lost.

along the stunning Heritage Trail around Loch Leven National
Nature Reserve.
• The routes start and finish at the Boathouse Bistro in Kinross. Both routes
are along well-maintained, traffic free footpaths. The walks are
signposted, with fantastic views, and there will be event marshalls to
cheer you along.
• Walkers can sign in and start their walk at any time between 10am and
11.30am. Every walker will receive a certificate and medal.

Draft Minutes Meeting Fossoway and District Community Council
Tuesday 4th February 2014, Fossoway Primary School

Attending: Sandy Morrison, Kevin Borthwick, Alastair Lavery, Trudy Duffy-Wigman, Rod Paterson, Graham Pye, Cllrs M Barnacle, D Cuthbert and J Giacopazzi and 10 Members of the Public (MoP).

Apologies: PC Dougie Stapleton, Angus Cheape, Cllr W Robertson.

Declarations of interest: None.

Community Policing: PC Dougie Stapleton was unable to attend, however a report has been received – Possible intruder to rear of property in Crook of Devon, and housebreaking to properties in Powmill and Blairingone. There have been other break-ins in remote areas, any information gratefully received. Please also contact Police about any suspicious bogus tradesmen, or people selling tools. Drink/Drug and Drive testing continues, including tests to detect “morning after” offences.
The CC has received a response from Inspector Steve Sangster to our letter about the Local Policing Plan, saying that there are financial pressures, but a response will always be made to any contact. Cllr Cuthbert has been reassured that the Community Officer will make more strenuous efforts to attend these meetings.

Matters arising:
• Glendevon / Rumbling Bridge Hydro Scheme: Hugh Wallace reports on the progress of the scheme – planning approval was received in December, together with SEPA water extraction licence and power connection agreement. Discussions continue with other major power users in the area in order to establish a cost-effective power connection, which is currently putting the project at a slight risk. Construction is unlikely to commence before 2015.
• Criminal Justice Service: Arek Nowrotek attended the meeting and described the scheme which is designed to show the community that the offenders are putting something back. Free labour and some vehicles and equipment are available for projects, although the community would have to provide materials, etc. Normally a team of five people and a supervisor would be made available. All suggestions for possible projects are welcome, application forms and contact details were provided.
• Blairingone War Memorial: The wall against which the memorial was proposed to be placed has completely collapsed. Cllr Barnacle reports that the wall is owned by PKC and will be rebuilt by them in a proper manner, which will probably involve reconstructing the wall from the founds upwards, including the creation of field drains either side of the wall.
• Crook of Devon Church Car Park: On-going.
• Travellers’ Site at Crook Moss, Crook of Devon: Cllr Giacopazzi has contacted the Chief Executive of PKC who has assured him that the enforcement issues will be treated with utmost priority. Cllr Cuthbert has contacted Nick Brian on the same issue. Pursuing these issues is difficult since there hasn’t until now been a central register of planning conditions
• Glenquey Quarry: The next DMC meeting that could include this application is the 19th February.
• Glendevon Pollution Incident: Scottish Water has been fined £10,000 for allowing acid to enter the reservoir and hence the river, causing the death of a large number of fish. SW has subsequently made a £500,000 investment to minimise the chance of such an event happening again. There was considerable discussion on this item, and Mop’s and the CC wished to have assurances from Scottish Water and PKC that procedures were in place to inform the public promptly if something of this nature were to happen again.
• Community Workshops: Blairingone: Moubray Hall, 25th March 6:30 – 9pm, proposed posters and fliers have been sent to the CC for review. Date for a Powmill workshop is still to be determined
• Community Speed Watch: Cllr Giacopazzi reports that Hamish Macpherson, the Divisional Commander, who isn’t a supporter of the scheme, would prefer other programmes, for example a warnings programme. However the Police would assist in training, but the Community would need to fund the equipment. A reporter from the Perthshire Advertiser has contacted the CC (Kevin) to say the scheme was not going to be continued. The Community felt it was beneficial and should be continued.
• Bus Investment Fund: On-going, minor administrative complications are being sorted out, with the hope that the scheme may start this financial year.
• Walkmill Play Park: On-going.
• M90 Junction 7: Transport Scotland replied to the CC’s letter saying that there are currently no plans to upgrade the junction, although traffic flows in the area are continually monitored.

New Business
• SEPA Flood Risk Maps: Rod notes that the latest maps are available online at: http://map.sepa.org.uk/floodmap/map.htm
• Outh Muir Wind Farm: Fossoway are to receive 10% of the Community Benefit if the scheme goes ahead, Fife have not yet made a decision on the scheme, although the time for determination has passed. The CC thanked John Anderson for attending these meetings and for his efforts on the CC’s behalf.
• Winter Road Maintenance 2013/14 – A request has been received from PKC for feedback.

CC Business
Administrative Grant – PKC is implementing a new system from April 2014 whereby CCs only get a grant each year which is sufficient to restore their account to a balance of £700. None of the elected members present recall being consulted about this change.

Meetings Attended – Fossoway School Fete: Kevin attended a meeting where resurrection of this event was being discussed. Volunteers and ideas are sought. The CC will help to promote the event via the notice boards, web site, and updates at meetings.

Fossoway Church Office: Angus attended this meeting.

PKC Councillors’ reports:

Cllr M Barnacle: Has written to the responsible Minister to complain about the lack of opportunity to comment on the Reporter’s changes to the LDP. The plan has now been adopted. Friends of the Ochils are proposing the Ochils to be a Designated Landscape Area. Aldie Road has had some patching done, but more major work needs to be done later this year. Core path signing in Crook of Devon area is imminent.

Cllr D Cuthbert: Has followed up on the enforcement issues at Easter Muirhead Equestrian centre regarding passing places and landscaping.

Cllr J Giacopazzi: LLCC Library hours – A protest group has been established; they will be meeting with local councillors and subsequently with the PKC official responsible. This change is part of a move towards more provision of mobile services.

Planning:
The final LDP is now available on the PKC web site titled “Proposed Plan as Modified”.

SCARF CHALLENGE FOR CHAS

Children’s Hospice Association Scotland (CHAS) is a charity that provides the only hospice services in Scotland for children and young people with life-shortening conditions. CHAS offers care in two children’s hospices, Rachel House in Kinross and Robin House in Balloch. The hospices support the whole family by offering short planned breaks, emergency support, end of life care and a range of bereavement services. CHAS also provides a home care service, called CHAS at Home, staffed from both hospices and with dedicated teams in the North of Scotland. The service offers care to families in their own homes when they need it most. CHAS supports over 250 families, as well as a significant number of families who receive bereavement support. The services are funded mainly through the generosity of the many supporters who help raise over £7 million needed each year to provide these vital hospice services.

Can you knit or crochet? Do your friends sew? We need YOU!
To raise money and awareness for CHAS, we want to make a scarf that stretches from Gateside, Fife to Rachel House in Kinross. We need lots and lots of donations of scarves, which can be crocheted, sewn or knitted and can be in any width, so long as they are a minimum of 1.5 metres in length. We will collect scarves from now until the end of September. They can be handed in to:

Central Library, Dundee
Tesco, Edinburgh or Crieff Road, and Morrisons, Perth
Library, Rothes Halls, Glenrothes
Sainsbury’s, Kinross
YMCA, Cupar
Rascal’s Nursery, Kelty
Tikasam handmade cards & crafts, Burntisland
or any CHAS shop or office throughout Scotland.

Once collected, some of the scarves will be sewn together over 24 hours in a
“stitchathon”, before being sold individually to raise money for CHAS.
A few “special” scarves which will be auctioned at a charity dinner in Kinross.

Fossoway and District Community Council - Draft Minutes Tuesday 1st April 2014

Attending: Sandy Morrison, Kevin Borthwick, Angus Cheape, Trudy Duffy-Wigman, elected members Mike barnacle, Joe Giacopazzi, Willie Robertson and Dave Cuthbert, and nine members of the public.

Apologies: Alastair Lavery, Graham Pye and Rod Patterson

Declarations of interest: None

Community Policing: Euan Mitchell attending; a report had been sent in advance but there were no particular issues in our area. In the wider area there were reports of bogus workman, scam letters asking for money to release a prize, bogus charity collectors and thefts of heating oil. The public was reminded that an oil tank needed to be secured (padlock or within a fence) in order to be insured.
Euan reminded the public that the counter service at Kinross Police station has now finished. Anyone needing to speak to the police (in a non-emergency) can use the phone outside the station. Officers can come to people’s home or alternatively make an appointment to meet at the police station. There was a question about Community Speed Watch but the situation regarding continuation is still unclear.
Proposed transport plans for the Ryder Cup: 23 – 28 September 2014
Euan is the community liaison officer for the Ryder Cup arrangements. The plans have been drawn up and the public is now being consulted. Feedback will be welcomed. In our area, Balado (T-in-the-Park site) is the largest of the Park and Ride sites for the Ryder Cup. The purpose is to keep the traffic flowing smoothly during the peak hours (5am till 9.30am) and also to keep the A91 as free as possible for the buses going to Auchterarder. Buses will only travel one way: from Balado, through the Glen, then back over the A9 to Broxden and down the M90 to Kinross again. Roughly 6 buses per 5 minutes are expected to leave at peak times. From Glasgow traffic will follow A977 till Tillyochie to the Charlie gate; from Edinburgh via the Cleish Road over the Coldrain road and from the north via Milnathort. Smaller roads could be made one-way for the duration. Consultation with residents will be held; and restrictions will be handled sensibly.

Minutes: There were no amendments so the minutes were signed off.

Matters arising:
Unpaid Work Team: FDCC was asked to suggest projects for the unpaid work team: clearing offlets on the road A977 joining with A91; Aldie Road; Drum village; B9097; work on the footpath from Drum to Fossoway Primary. There was a report of damage to the little bridge on Gelvan Road.
Hydro Scheme: £10,000 developer’s contribution is supposed to be used for footpaths in the Fossoway Area. This is NOT the possible annual community gain, which will come directly to the community.
War memorial: When the wall has been rebuilt, the monument will be put in place.
Crook of Devon Car Park: No news
Crook Moss Travellers Site: There was a list available with the conditions and possible enforcement actions. PKC is to meet with the travellers next week and will draw up timetable for the conditions to be met; mainly regarding waste-water treatment and noise pollution. A short general discussion on enforcement of planning conditions within PKC followed. Planning enforcement FAQs are now put on the PKC website.
Glenquey Quarry: Is not coming up in the April meeting.
Glen Devon Pollution Incident: MB received reply to his concern that in the future with incidents like these an early multi-agency meeting will be called. He will follow this up as we are still concerned about an early warning system.
Workshop Blairingone: Turn-out was disappointing; and although the activities and exercises were interesting, there was a general feeling that the wheel was being reinvented; much of this was done during the strategy meetings in preparation for the current local plan. All agreed that Blairingone needs more and affordable housing to get a critical mass.
Bus investment fund: PKC is now working on legislation to put everything in place.
Waulkmill Play Park: A survey has been held and there seems to be some progress. Eventually a meeting will be called to discuss the options.
Outh Muir Wind Farm: This application has been rejected on three points, one of was the interference with radar systems at Edinburgh Airport. This may have an impact on the Blairadam application.
Lambhill Chipping Plant: No news
Crook Moss Community Acquisition: This group has had a meeting. A valuation has now been received and discussions with the owner will now take place. Initial research on sources of funding has been carried out, and some funding may be available, up to 95% of the acquisition price.

Community Council Business:
Winter maintenance: Rod will deal with the winter road maintenance feedback.
Community Council funding: MB to follow this up- many CCs are dissatisfied. In the mean time it is wise to make sure that there is not much left in the account at the year end.
Community Challenge Fund: This fund can provide matched funding up to £10,000. There will have to be a community contribution, but this contribution can be in kind (work carried out etc.)

Councillors’ Reports:
JG: High hedges Act came into place today
MB: is writing an article for Rural Scotland about the loss of the Area Of Great Landscape Value designation. There will be a replacement, but there is considerable delay in putting another designation in place.
WR: Litter picking on A91 has taken place. Green Routes are proving to be successful and are being rolled out in other areas. There was a question about fly tipping on the A91- is difficult to do anything against. If there is fly tipping on farmers’ lands, it is the farmer’s problem.
DC: Is hoping Director of Environmental Services will learn from the Crook Moss situation; PKC needs to learn from the experience and perhaps put their foot down in similar situations. There is a general feeling that Travellers are treated differently from the public when dealing with planning applications, but this was refuted by PKC. MB adds that PKC is trying to set up a dialogue between Travellers and communities.

Application in principle for a house on the site between the Old School House and Fossoway Primary School carpark. The plot is small and this may restrict the size of the house, not defined at this stage, to allow for proportionate garden and access. The site is within the settlement boundary and not zoned as greenspace in the Local Development Plan.

PKC spam: All email correspondence that comes to the CC via the PKC address has unnecessary graphics and text attached to it. This has to be manually removed prior to printing to save paper. Also the CC receives a lot of Spam email via this address. Dealing with these emails is very time consuming. The CC has emailed PKC to see if anything can be done. Currently we are still waiting on a reply.

In reply to a question from the public the elected members explained that they cannot vote on an issue if they have expressed an opinion prior to a meeting where the vote will be held. This is part of the Code of Conduct of Councillors. JG has published a longer explanation in the April Newsletter.

Draft Minutes Meeting Fossoway and District Community Council
Tuesday May 6th 2014, Fossoway Primary School

Attending: CClrs: Sandy Morrison, Kevin Borthwick, Rod Paterson, Alastair Lavery, Trudy Duffy – Wigman. Cllrs: Mike Barnacle, Willie Robertson, Joe Giacopazzi and 11 members of the public.

Community policing:
Report received. Main issue in this area: the public have to watch out for bogus callers (who have been active in the Powmill area). They will use various methods to distract you (ask for use of the bathroom, a glass of water) to gain entry to your property, and rob you. Do not let cold callers in, arrange for a friend to be with you and contact the police if concerned.

Hydro Scheme:
One of the landowners received a letter with what he felt was a threat for compulsory purchase of his land if he failed to cooperate. However, councillors had never heard of this measure being used by a private company. Hugh Wallace to update CC at next meeting.

Blairingone War Memorial:
No progress. It would be fitting if it is finished before the commemoration of the first World War.

Crook of Devon Church Car Park:
No progress. There was a comment on inconsiderate parking of some church goers; possibly hampering the access of emergency services. The CC will take these matters up with the church.

Travellers’ site: Enforcement orders have been issued in respect of some conditions. Foul water conditions are prioritised; the measures should be implemented in 6 to 9 months. Other conditions will also be enforced but are not prioritised. There is still concern about the generator noise. MB commented that, in general, by accepting retrospective applications, it is more difficult to enforce waste and foul water conditions; which is more significant in the Loch Leven catchment area. However, PKC has to consider retrospective applications whoever they are from.

Glenquey Quarry:
The CC still get regular updates from Malcolm Best; but the quarry is not on the agenda of the next DMC. Also, Tayside Geodiversity has conducted a survey and they will bring out a report in favour of a geological designation.

Glen Devon pollution incident:
Councillor Barnacle is in conversation with PKC to make sure lessons are learned from the incident so that the initial response mechanism will be fit for purpose.

Community Workshop on Blairingone:
PKC has put a lot of effort into this process; unfortunately the turnout of Blairingone residents was disappointing. Several issues were identified, such as a village hall, paths, a shop, and woodland development. A hall could only be realised in conjunction with some development of housing; PKC will meet with landowners to see whether there is scope for some development. There would also have to be a significant contribution from local residents in respect of funding and project management. Are the people prepared to give this commitment? Mr Stewart may have some information regarding development at the next meeting. PKC are keen to have a follow on meeting to discuss the outcomes from the workshop, probably in Blairingone. A suitable dare and venue in Blairingone will be agreed in the near future. The ownership of site E22 was thought to be James Manclark , but this would have to be confirmed.

Bus Investment Fund:
There is now agreement with the taxi operators and licences are organised. The launch may be as early as this month. A wonderful opportunity to improve transport for non-drivers.

Waulkmill Play Park/ Road at Village Hall: There is now a budget for adopting the road. The council will fund up to 40% to bring the road to an adoptable standard.

Lambhill Chipping plant:
Following a meeting with PKC, John Anderson, Alan Kinloch and Gordon Banks it has become clear that the justification for allowing the plant to operate in the current way is based on an incorrect interpretation. The council is now reviewing its position.

Crook Moss Acquisition:
Valuation received, and discussed with the landowner. In some cases the land has been gifted, but the price range could be from £500 to £650 per acre, and it would depend on what value the community put on the land. The landowner has now taken the farm off the market, but has agreed that if he decided to sell the Moss, he would give the community first option on it.

Spam emails:
Kevin is trying to reduce spam emails and the length of PKC emails and disclaimers. Has had some success as the Ryder Cup logo is now removed. We are still hoping that PKC can put in some filters.

Ryder Cup traffic planning:
Last meeting we had an update. A resident of Carnbo has voiced concerns about 6 buses every 5 minutes on the A91- it will be difficult to cut in and join the traffic. There was also a question whether the speed limit imposed in Carnbo can be reduced to 30mph. There are conflicting opinions about this; in the absence of street lighting. The CC and the Cllrs will take this up again. Also, the verges may need a second cut (are usually only cut for T-in-the-Park); WR will check this.

New Business
Dunning Glen:
Once again there are reports of irresponsible camping on the site, and large amounts of rubbish have been left all around the area. The CC will to try and resurrect multi-agency meetings and look for more a permanent solution.

Road Maintenance:
Rod will update next meeting.

Local Landscape Designation review:
There will be a replacement for the ‘Area of Great Landscape Value’ designation. It will be called LLA (Local Landscape Area). During a working meeting several areas in Perth and Kinross were put forward for this new designation; in our area they were The Ochils, Lomond Hills and Loch Leven. This was an evidence gathering exercise; the consultants will present the findings back to the group and then propose the way forward.

Mike Barnacle:
Community Speed Watch: seems like the end of the road; no support from the police for this initiative.
Footpath at St Serf’s: will be maintained.

Willie Robertson:

Tree policy: When a tree is overhanging or obstructing between private properties, it is the owner’s responsibility to cut it down and to remove the branches. The council will only step in when it is overhanging on the public road or in any sense dangerous. Previously the council had carried out the work and billed the owner, if they had failed to do the work.

Loch Leven Heritage Trail:
The trail will officially be opened on the 30th of May.

New Roundabout in Kinross: A member of the public asked if was a council policy for contractors who go over time? Also, the way the site is left (with cones etc) can be hazardous. Councillors reported there was an unforeseen problem with a utility cable. The public were also asked to report hazards at the time and not wait for a meeting.
Lay-by Aldie Road: This site has been used by Scottish Water as a parking/ storage for contractors’ vehicles and equipment as well as materials and waste. It has not been properly cleared and tidied when the work was finished. Councillor Giacopazzi will take this mater up.

Minutes of AGM
May 6th 2014 7.30pm

2. Minutes: Minutes of the 2013 AGM meeting were read, approved, and signed off.

3. Chair’s Report:

The elected members of the Community Council are as follows:-

During the year Sheila Anderson resigned and Graham Pye was co-opted. The Community Council (CC) wishes to record its thanks to Sheila for her contribution over the years.

The Community Council has had another very busy year with eleven scheduled meetings and one special meeting regarding the potential acquisition of the Crook Moss. The main issues during the year have been:

• Crook Moss Planning Application: Planning permission was granted with a number of conditions which had timescales for their implementation. The majority of the conditions have not been met and enforcement orders have now been issued with new timescales for some of the conditions. This matter involved a significant amount of correspondence, telephone calls and meetings with Perth and Kinross Council (PKC) officials.
• Local Development Plan: The Plan was approved by the Scottish Executive with some amendments. PKC accepted the findings and adopted the Plan which in the main reflected the Community’s views.
• Introduction of a Unitary Police Force and Unitary Fire Service in Scotland: These changes are still being implemented and the only effect so far is the closure of the desk service for the public at Kinross Police Station.
• Community Speed Watch Programme: The new police service has decided not to support this measure.
• Fossoway Church Car Park: No progress has been made by the church.
• Core Paths: Signposting has been completed.
• Lambhill Site: There is still ongoing discussion with PKC on this matter.
• Glen Quey Quarry: The planning application has still not been determined.
• Wind Turbines: The CC has decided to object to all applications until PKC produces detailed guidance regarding wind turbines, in particular cumulative impact.
• AGLVs: The CC has lobbied PKC to produce a replacement policy for this subject.
• Bus Investment Fund: The CC supported the bid for a local service in the area.
• Blairingone War Memorial: Progress has been made and it is anticipated the relocation will take place in 2014.
• Devon Hydro Scheme: The CC has had significant dialogue with the developer which has resulted in the developer amending the scheme and meeting the CC’s initial objections.
• Ryder Cup: The impact of the Park and Ride at Balado and the traffic management system has been discussed with the CC and the community.
• Crook Moss Community Acquisition: A sub-group of some CC members and volunteers from the Community was set up to explore the possibility of the Community acquiring Crook Moss.
• Community Consultation: PKC organised an event to discuss the LDP and its effect on Blairingone.
• Green Routes: These have been introduced in various parts of the district.

In addition to these specific issues, there have been a significant number of planning applications, together with an increasing number of issues which the Community Council has been consulted on, extensive correspondence and a large number of meetings to attend.

The emphasis coming from the Scottish Executive is increasing community involvement and empowerment of communities. The Scottish Executive’s aim is to involve people at all age levels in the community but it is extremely difficult for people with busy working lives to become involved to the level envisaged.
The concept is laudable but in my view it is not easily achievable through voluntary bodies such as CCs. The current workload is significant and increasing therefore any further major increase will not be dealt with effectively with the current structure.

Thank you to my fellow councillors for their support and for the significant efforts they have made in dealing with their portfolios and attending external meetings. Thanks also to our local Councillors Barnacle, Cuthbert, Giacopazzi and Robertson for their support and assistance to the CC on numerous occasions. Our local MP Gordon Banks has also provided support and assistance to the CC.

4. Secretary’s Report:

I have now settled into the role of Secretary, and have got a system of how I deal with all the work. Basically I have to deal with it as it happens, and not let it build up. Fortunately as I work from home I am more or less able to do this.
We have had a really busy year, in 2013/14, and we have had a substantial increase in the amount of correspondence, and meetings attended.
Over the past year I have dealt with 1137 (916 last year) incoming emails, and have sent out 585 (471 last year). I also ran off 1828 (1576 last year) prints for the correspondence, and agendas etc. This is an increase of approximately 20%. When you include phone calls and meetings it soon adds up to a fair bit of work.

Streamlining the way we do the correspondence at the meetings has been a great success, although I fail to see why I have to print it all out, as very rarely does anyone ever look at it. But rules are rules.

This year I have tried to lobby PKC to cut out the amount of SPAM emails we receive, and also to remove as much of the inane blurb that is at the foot of all their correspondence. I have had some success, in that any correspondence does not have all the copied recipients listed in the email, cutting out half a page, we also have had the Ryder Cup logo removed, but not a lot happening with the SPAM. I’m still waiting on more feedback on that one.

I will keep looking at the processes we have to follow as a Community Council, and keep trying to make things easier and less laborious and tedious for both the members and the public. To try to make our meetings run smoother and make them a more pleasurable experience.

5. Treasurer’s Report:
The Annual Accounts were approved and signed off – Proposer: S Morrison, Seconder: K Borthwick.
The closing cash balance for the year was £291.83, including accruals for outstanding creditors. Major expenses during the year included £245.84 for accommodation and £127.96 for secretarial expenses. In line with new PKC guidelines, ongoing funded for the Community Council will be capped at £700. The Chair thanked Rod for stepping in to do the accounts at the last minute.

Community policing: Report received. No crimes to report this month. Cllr Barnacle has been given “No Cold Calling” posters and stickers by PKC’s Janet Ray, which are available at Crook Post Office amongst other places.

Minutes of the last meeting: Were signed off without amendments.

Matters arising:
Unpaid work team: Arek Nowrotek of the Criminal Justice Service is researching possible projects and will report at the August meeting of this CC.

Rumbling Bridge Hydro Scheme: The scheme is currently on hold - Hugh Wallace explained that this is pending completion of agreements with affected landowners, twelve have agreed, however the remaining one is currently selling his property and is unable to commit at the moment. SSE have now proposed a more acceptable grid connection charge due to reduction in use by others in the area.

Blairingone War Memorial: Cllr Barnacle has contacted Richard Smith to find out progress, site is now surveyed and ready, formal order will be issued shortly and work should start at the end of June, finished by end of July.

Crook of Devon Church Car Park: No progress.

Crook Moss Travellers’ site: Cllr Cuthbert reports that there has been no progress on the enforcement actions.

Glenquey Quarry: Tayside Geodiversity’s survey suggests that the quarry should have a geological designation. It’s not clear whether the report has been published yet.

Glen Devon Pollution Incident: Jim Dixon called Kevin to explain that if it’s a Public Health issue then the Health Authority takes over, and they may not have realised which areas were affected. A recent event at Glenfarg was handled more efficiently.

Community Workshop on Blairingone: A follow on meeting has been proposed by PKC for the end of August, however it would be better to have the plan that Johnny Stewart is preparing to discuss first.

Bus Investment Fund: The Muckhart and West Kinross-shire Demand Responsive Transport (DRT1) service started on 2nd June. Andrew Warrington (PKC Public Transport Manager) explained the background of the DRT1 service – The system works by booking at least 24 hours before, and the fare is the same as a bus fare, including child and concession rates and is operated by local taxi firms. Mary Carruthers (one of the service operators) reports that 20 journeys were made on the first two days. Funding is currently in place for the next three years, but Andrew I optimistic that this could be extended if the scheme is successful. Booklets describing the service are available throughout the area, and on various websites. Although the current area of operation is defined, it may be possible to alter or extend the area as the scheme develops.

Waulkmill Play Park: Detailed proposals for refurbishment of the park have been prepared and appear to be satisfactory. Comments from the community are welcome.

Lambhill Chipping plant: Cllr Cuthbert reports that PKC Environmental Health are awaiting further noise measurements before a decision is made. Meanwhile there has been no progress on the Planning Application which has now been agreed to be based on an invalid precedent.

Crook Moss Acquisition: No activity at the moment, as the land is not currently on the market. The sub committee will re convene to discuss possible funding and potential uses of the ground.

Spam emails: On-going.

Ryder Cup traffic planning: Kevin contacted PC Euan Mitchell who informed him that it’s proposed to impose a temporary 40mph speed limit on the A91 from Milnathort to Carnbo, currently there is no plan to have a 30mph limit in Carnbo itself, although this was thought to be a good idea by those present.

Dunning Glen Rubbish and Vandalism: Sgt Sandra Williams has been contacted – she thought it wasn’t worth reviving the multi agency meeting that she was previously responsible for. Meanwhile the Police will give the area as much attention as they can. Cllr Barnacle suggested that a possible meeting should be sought with landowners, council officials, and interested community parties to investigate a possible purchase of the land from the landowners, and also to discuss whether doing this would solve the problem. Suggestions to address this issue are welcome.

Roads Maintenance Strategy: Rod will update next meeting.

New Business
Perth and Kinross Credit Union: Steven Young explained that a Credit Union is a financial co-operative in that it takes in deposits and makes loans to members of the community; it’s only open to people living, working or studying in Perth and Kinross. Any profits will be used to improve the service. The scheme has only been operating for six weeks, so currently has a small number of products, and is run by volunteers – more are welcome. Although it may be most advantageous to people to whom normal banking facilities are not normally available, it’s open to all.

Lay-bay at end of Aldie Road: Although the pile of waste has been cleared up, there is still plenty of rubbish there from various works.

Fossoway Church Graveyard: MoP commented about the state of this, which has now been addressed.

Legacy Toolkit: This material encourages Communities, individuals, organisations and businesses in Perth and Kinross to take pride in our people and help create a sense of place in the year of the Commonwealth Games, Ryder Cup and Homecoming. It’s available from the PKC website.

CC Business
CC Meetings 2014/5: Dates and places have been confirmed and will be circulated and published in the usual places, see end of these minutes.
Local Landscape Designation Review: Consultants are preparing a proposal for this scheme, that replaces the Area of Great Landscape Value designation, to be presented on the 10th June. Comments can be made until the 6th June at http://www.surveymonkey.com/s/PKC_LLDR
Kinross-shire Community Council Workshop: Sandy, Kevin and Alastair attended this meeting which described how the Planning Department will operate under the new Development Plan, and how the Community Councils can best communicate with the Planning Department.

Councillors’ reports
As part of a Scotland–wide review of Council sizes it’s been proposed that the number of PKC Councillors be reduced by one. Could this affect our ward? Cllr Giacopazzi says that it was discussed but any proposal to reduce our local representation would be strongly rejected.

The Committee is working hard to get auction items and we already have, for example, a Family Day at Landmark, golf at Blairgowrie and golf at St Andrews, some babysitting, a children’s disco, clay pigeon shooting and two different holiday homes for a week’s stay abroad.

Our target is to raise £3,000 so we really need everyone’s support.

Attending:

Declarations of Interest: None.

Community policing: Report received. The Public are reminded to be sensitive to other land users when enjoying the countryside during the summer. Only recent crime in the area is the theft of a Motor home from Crook of Devon which is under enquiry. Incidence of fly-tipping seems to be increasing; anyone spotting this in progress should report any details of registration numbers, etc., to the police.
MoP asks about process for handling runaways from Seamab School, as reports of a recent incident revealed that the control centre (contacted using the 101 number) didn’t know anything about the school. Kevin will raise this with the Police.

Minutes of the last meeting: Were signed off without amendments.

Matters arising:
Perth and Kinross Credit Union: Details will be put on the Fossoway web site.

Unpaid work team: Arek Nowrotek of the Criminal Justice Service has asked for suggestions, previously we have suggested using the team to clear offlets in various roads in Fossoway or perhaps do some additional verge cutting. See also AOCB.

Rumbling Bridge Hydro Scheme: Hugh Wallace attended to provide an update: SSE have withdrawn their requirement for a large sum to upgrade the power network, which returns the project to a sound economic footing. Energy for All have been helping with arrangements to raise community funding. One of the landowners is currently refusing to sign an agreement for the pipeline to pass his land pending the sale of his house – alternatives routes are possible, but difficult. MoP asks if there is any risk of asbestos being found in the ground that was previously a rubbish tip – Hugh says that sampling hasn’t revealed any, but obviously it will be handled appropriately were it to be found.

Blairingone War Memorial: Cllr Barnacle reports that some work is taking place, although it appears to be behind schedule. Cllr Barnacle has reminded the builders of the importance of completing this before November.

Crook Moss Travellers’ site: There is no information about progress in enforcing the planning conditions, particularly with regard to noise. This CC and Cllrs will continue to press the issue.

Glenquey Quarry: Kevin reports that this was not on the agenda for the July DMC meeting; the next meeting is 13th August. Meanwhile the Tayside Geodiversity paper has been completed and sent to PKC and all members of the DMC.

Community Workshop on Blairingone: A date for the follow on meeting is still to be agreed.

Lambhill Chipping plant: Cllr Barnacle is still trying to organise the site meeting with Nick Brian, but to no avail – discussions continue about whether the CC can be represented at the meeting.

Crook Moss Community Acquisition: The subcommittee will reconvene in due course.

Ryder Cup Traffic Planning: Ongoing, some minor improvements to the proposed arrangements have been made. Hopefully a Police Officer will attend a future meeting to update us.

Dunning Glen Rubbish and Vandalism: On-going. There was extensive discussion about possible solutions to these problems.

New Business
T-in-the-Park: The festival will be moving to Strathallan. The organisers have thanked the community for all their support over the years it has been held at Balado.

CC Business
Landscape Review: Alastair attended.
Planning Users Forum: Kevin attended this meeting, during which it was announced that input for the next local plan is already being sought.

Councillors’ reports
Cllr Barnacle: Request for mitigation measures on A977 has been made to PKC; some minor works to ant-skid surface will be done, and a survey of HGV traffic will be made. It’s now necessary to persuade the Council to instruct the Roads Department to resume work on preparing the business plan for the major mitigation measures – support of this CC will help. Dunning Bridge has been addressed. A previously reported problem with a bad smell at Crook of Devon has now abated. Carnbo Post Box – Previous correspondence from the Post Office in London stated that letters could be handed to delivery staff in the absence of a local post box. General opinion amongst those present was that this was not being allowed by local staff. Cllr Barnacle will forward the letter from the London Office to the Kinross office to elicit their comments.

Planning matters:
A number of decisions by the local review body were intimated and discussed.
There was a feeling was feeling from the public that the item in respect of Dollar Equestrian at Blairingone, appeared to be an example of a system being used to obtain a house in the countryside. There was also disquiet by a MOP over apparent inconsistencies in the granting of permission for wind turbines.

Outh Muir Wind Farm – Cllr Barnacle notes that this went to appeal after refusal, so sent the reporter a copy of the local landscape review.
Braehead Developer reports that the footpath surfacing has been completed; works to a previously agreed chalet site are in progress.

All correspondence was available for viewing. Volunteers to man polling stations are sought, details available to anyone interested. Volunteers needed for Older People’s Day – 22nd October at LLCC; This CC has received an annual administration grant of £408; PKC’s “Seven Days of Sport” programme offers open sessions at various sports clubs 23rd August – 3rd September, see www.pkc.gov.uk/sevendaysofsport Auction of items and promises at 7pm on 13th September at Crook of Devon Village Hall.

AOCB: The Crook of Devon electronic speed sign is not working. Cllr Barnacle will report this. MoP also notes that several speed limit signs are in need of cleaning – this might be a good job for the Unpaid Work Team.

Draft Minutes Fossoway and District Community Council
2 September 2014, Fossoway Primary School

Attending: Sandy Morrison, Alastair Lavery, Kevin Borthwick, Trudy Duffy (CC), Mike Barnacle, Dave Cuthbert (elected members) and 9 members of the public.

Police report: Euan Mitchell, Police Scotland in attendance. Police report received.

No crimes reported since last meeting.

Although not in the Fossoway area there have been reports of fly tipping. If you see this happening please call the police and report it giving details of vehicle registration numbers.

‘Enjoy the outdoors’ :- Consider others, keep speed on country roads down, give horses, walkers, and livestock plenty of room, keep away from farm animals and farm machinery, don’t block driveways or gateways, keep dogs under control. Don’t leave litter or destroy or remove plants. Don’t drop matches or smouldering cigarettes.

Be aware of fraudulent letters stating the recipient has won a large amount of money, and requires your bank details so the sum can be paid into your account. Do not give out your details unless you are certain the request is genuine.

Speed Checks and Static Checks continue to be carried out in the area by officers when time is available. The Ryder Cup is this month, so please be aware of local road closures.

Some incidents of vandalising ‘No’ campaign signs was raised. The public are asked to report such incidents but should be aware of limited resources to follow these up.

Both CC and elected members are disappointed by the lack of police presence during CC meetings. Euan stressed that if issues are raised during a meeting we could request an officer attend the next meeting if the situation is ongoing.

MOP brought up that when there was an incident (absconded pupil) at Seamab School the person on the other end of the 101 call had no knowledge of Seamab School. Eventually there was a reply from the community police officer. In those situations it may be better to use the 999 number.

Ryder Cup.
• Leaflet will shortly be available. Most of the traffic using the Balado car park will come over the M90. Peak hours are expected to be 6 to 8 am on Tuesday to Saturday and 10 to 12 noon on Sunday, return peak hours daily between 5 and 7.30pm.
• There will be temporary speed limits of 40mph on the A91 from the M90 junction to Carnbo, on the A977 from the M90 to the Tillyochie junction.
• Temporary road closures will be from 22 till 28 (29) September: A823 for through traffic between Yetts of Muckhart and A9, B918 between A91 and Burnbrae and Mawhill Road between A91 and B918.
• Some roads will have a one-way traffic system, changing at around 12 noon (time to to be confirmed) from one direction to the other. Roads affected are B918 (Tillyochie Road), C494 (Coldrain Road)U231 (between A977 and B918). Residents living in areas where roads are closed will be given special permits. Passes are also available at several points in Auchterarder and Muckhart.
• The police and the security personnel will take a common sense approach to letting people through closed-off roads.
• There is drop-off provision for the Balado, and other official Park and Ride car parks. However there is no drop-off facility at Gleneagles.
• In case of inclement weather, the event (and all the restrictions above) can continue through to Monday.

Minutes of the previous meeting: Signed off with the following amendment.
Member of the public remarked that we noted that the footpath at the Braehead development in Rumbling Bridge was completed while it actually has not been completed. In a short discussion this was clarified. The car park for visitors to the Gorge (also a planning condition) had not been finished either. The member of the public was advised to contact the Enforcement Officer of PKC to clarify the situation.

Unpaid work team: Have been asking for inside jobs during the winter: Sandy has contacted the village halls and the Church but is still waiting for a response from all except Powmill.

Hydro Scheme: awaiting update

Blairingone War memorial: The wall against which the memorial will be placed has now been finished. The Council will mark out the area where the memorial should go, and when that is done Profile Projects will relocated it. A member of the public remarked that there are some trees in the immediate vicinity that could blow over and damage wall (made of breeze blocks) or the memorial. Mike Barnacle will propose a site visit to make sure everything is going to plan.

Crook Moss Travellers’ site: The deadline to comply with the conditions imposed by PKC is the end of October. No further update.

Glenquey Quarry: The application is not on the September agenda; next DMC on 15 October.

Blairingone community workshop: Meeting with the landowners, planning consultant and PKC on the 16th of September. Outcome will determine when the next workshop with the community will go ahead.

Lambhill Chipping plant: PKC is awaiting noise report. A site visit has still not happened, although councillors have been requesting this for some time. This situation has now been going on for two years. Communication between PKC and local residents is laborious. Local residents corresponding to the PKC planning department don’t get replies quickly if at all. One member of the public is now thinking of lodging a formal complaint.

Crook Moss Community Acquisition: nothing to report

Dunning Glen: Nothing to report.

Church Car Park: (question from a member of the public, not on the agenda): no progress, despite planning permission being granted, the council ready and the community willing to assist, but the church appears not to want to progress the matter.

New Business:

Fossoway Primary School: The School received a good report from HMI. However the CC was disappointed that monitoring of the school is now to by PKC. It would have expected a further follow up report from HMI prior to responsibility being passed to the Council. The reason for this comment is that the community was of the opinion that the previous problems were partly due to a lack of proper oversight by PKC. It remains to be convinced that PKC will be effective in this area in the future.

Landscape areas in Kinross-shire: See also Mike Barnacle’s correspondence in the Kinross newsletter. The new proposed LLA’s (in place of the Areas of Great Landscape Value) are Loch Leven, Portmoak and the Ochil Hills. The river Devon (and in particular the Gorge) and the Cleish Hills are not included. Clackmannanshire has recognised their part of the Devon landscape and Fife has recognised their part of the Cleish Hills; so there is a strong argument for inclusion of those landscapes in the LLAs. The CC will make representation.

Councillors’ reports
MB has written to PKC about the mitigation measures on the A977. He (and the CC) has received representation on the bad state of the road through Crook of Devon and the damage to the drains done by heavy vehicles, as well as the noise pollution through the day and the night. An answer has not been received, despite being promised by the 12th of August. The council has to survey the road. The A977 doesn’t seem to have priority for inclusion in the capital budget. We will have to keep asking for answers.

Planning:
14/01308/FLL:- Erection of 7 dwelling houses, formation of access road and associated infrastructure. Land 100 metres South of Merryorchard Rumbling Bridge.
This is a substantial development for Rumbling Bridge. Several objections to this development have been received and have been lodged on the planning website. The CC will object to this development as being contrary to:
PM1B (a and d): the development is out of scale with the surrounding development;
PM4: the site is out-with and immediately adjacent to the settlement boundary;
RD3: the site is not within the settlement boundary but no valid justification is given under the Housing in the Countryside Policy;
RD4: the developer proposes off-site affordable housing contribution for 1.7 houses. Rural areas need affordable housing.
14/1486/IPL: Erection of a dwellinghouse (in principle). Land 300 metres North East of Former Craigend Farm Powmill. The CC objects to this application as being contrary to: RD3: the site is not within a settlement boundary but no justification is given under the Housing in the Countryside Policy. This is a very incomplete planning application and no decision should be made until more information is available.
14/01359/FLL: Alterations and extension to dwellinghouse and garage, Mossgrove, Drum, Kinross. No CC comment.

Correspondence: all the correspondence was available for viewing. The Library is looking for volunteers to cover on the days that the library is now closed: Saturday afternoon and Monday. Meeting this Wednesday 10th September, 7pm, LLCC. There was some discussion on setting up a Fossoway Facebook page to promote events in the area. This will be investigated.

AOCB: Member of the public commented on the state of the A91, especially between Ballingall Bridge and Carnbo. There are deep craters and damage has been done to cars. When repairs are done, it is with materials that only last a short time. Mike Barnacle and Dave Cuthbert will take this up with PKC.

The 2014 Ryder Cup Transport Arrangements

The 2014 Ryder Cup is coming to Perth and Kinross from 23-28 September. This is one of the most prestigious sporting events in the world and it is an exciting time for the Perth and Kinross area.

Many spectators will be travelling to the event by Park and Ride. There are 3 Park + Ride sites - Balado, Kinross (7,500 cars), Castleview, Stirling (3,500 cars) and McDiarmid Park, Perth (1,500 cars).

To minimise disruption in your area and to ensure that business continues as usual, a structured transport, safety and security plan has been formulated by the Event Organisers in conjunction with Police Scotland, The Gleneagles Hotel, Perth & Kinross Council and other local authorities.

Temporary Road Closures
For event security and safety, temporary road closures will be in place from Monday 22 September until Sunday 28 September in the following locations:
• The A823 will remain open for local access to businesses and residences, however it will be closed to through traffic between
A91 at Yetts O’Muckhart and A9.
• B918 will be closed between A91 and Burnbrae.
• Mawhill Road will be closed from A91 to B918.

Temporary One-Way Traffic
To minimise congestion on the roads, temporary one-way routes will be in place from Monday 22 September until Sunday 28 September. These one-way routes will generally be north and eastbound from midnight to 2.30 pm, and then west and southbound from 2.30 pm to midnight (see map).

Temporary Speed Limits
To manage the flow of traffic, temporary speed limits will be in place from Monday 22 September until Sunday 28 September on the following roads:
• 40mph from M90 to Carnbo, A91.
• 40mph from M90 to Tillyochie, A977.

Prevention of Fly Parking
To prevent Ryder Cup spectators parking in the local area, and then walking onto the site, Ryder Cup Europe operates a strict policy of not allowing spectators to walk onto the Park + Ride site. Spectators must arrive by taxi, bus, or by car.

To ensure no fly parking in your area, and that there is a smooth flow of traffic, temporary no waiting restrictions will be introduced in the areas marked in pink on the above plan.

Permit Zone
Special vehicle passes will be printed by Ryder Cup Europe and issued by the Police Scotland community engagement officer to all residents living within the designated road closure or restricted access routes to allow 24 hour access to their homes and frontages.

Attending: CCllrs: Sandy Morrison, Trudy Duffy, Kevin Borthwick, Alastair Lavery, Angus Cheape and Graham Pye; Cllrs Mike Barnacle, Dave Cuthbert and Willie Robertson; and eight members of the public.

Declarations of Interest: None.

Police report: No Community Police officer was present, and no Police report was received. Note that future attendance will depend on shift patterns and incidents.
Sergeant Williams notified us that the email address to be used to contact our local community officer is: ku.ecilop.nnp.dnaltocs|TPCerihs-ssornikedisyaT#ku.ecilop.nnp.dnaltocs|TPCerihs-ssornikedisyaT this mailbox is also monitored by Sgt Williams ensuring any messages sent to it will be actioned. Cllr Barnacle has spoken to Inspector Sangster about the reduced attendance at CC meetings, and was told that the above mailbox should be used to raise issues.
MoP observes that speeding through Blairingone is a continuing problem that seems not to be being addressed by the Police. The CC will take this up with the Police.
Ryder Cup Traffic Plan: General view was that it worked very well for attendees, although it was considered that the road closures and changes seemed a little excessive. Communication to residents could have been more extensive. An Auchterarder resident contacted the CC complaining about the money spent on the road and rail improvement totalling £7M.

Matters arising
Criminal Justice Unpaid Work Team: No response as yet from Carnbo and Crook of Devon Village Halls to request for work proposals. See also Dunning Glen item below.
Rumbling Bridge Hydro Scheme: Awaiting update
Blairingone War Memorial: Cllr Barnacle reports that the new wall is complete, and a new location has been proposed. Concern about nearby trees damaging the wall has been addressed. However in view of the closeness of the First World War remembrance events it has been agreed that the move of the memorial will now be postponed until next spring.
Crook Moss Travellers’ Site: The deadline to comply with the conditions imposed by PKC is the end of October. Cllr Robertson has received a revised set of conditions dated 3rd September, some of the conditions, including water supply, have now been pushed out to January next year. Some vehicles were seen in the paddock area, but have now been removed again.
Glenquey Quarry: The application is not on the October agenda.
Blairingone Community Workshop: Kevin reported on the results of a meeting between the consultants of the landowners (Mr Stewart and Mr Manclark) together with representatives of PKC’s planning department: A strategic plan will be developed and brought to the residents for discussion.
Lambhill Chipping plant: It’s reported that Malcolm and Callum Snowie are happy to meet members of the community at any time to explain what’s going on, how they are operating within their consent, etc. Cllr Barnacle will pass this on to Nick Brian tomorrow with the hope that the long-proposed site meeting with the planners, Councillors and Community Councillors can finally be arranged.
Crook Moss Community Acquisition: No further action until the position about future developments in this area are clarified with the landowner.
Dunning Glen: Thanks to Sergeant Williams of Police Scotland who organised a clean-up using the Unpaid Work Team, and they are prepared to do it again. However this is only a short-term solution…
Fossoway Primary School: The community is extremely pleased with the improvement in all aspects of the education experience; however they wish to be assured that PKC will actively monitor the school, providing any necessary assistance to maintain and develop this welcome improvement.
Landscape areas in Kinross-shire: This CC is in support of this report based on Cllr Barnacle’s review. Cllr Barnacle notes that the full report will be available to this CC later this month, and once it has been reviewed the CC will add its own comments.

New Business
A977 Defects: There have been several letters from local residents complaining about the surfacing of the road through Crook of Devon. Our councillors have also followed this up. A response has been received from Stuart D’All agreeing to carry out some repairs immediately and to schedule repositioning of road gullies next year – the latter should help to reduce noise from large vehicles.
MoPs raised several issues about the quality of resurfacing work and repairs, several of which are already breaking up – Are the contractors carrying out this work being adequately supervised?
In spite of numerous attempts by our Councillors to raise this issue, there is no sign of any long term plan being created to address the A977.
Waulkmill Play Area: Is currently under refurbishment.
Community Empowerment Bill: The CC has responded to this proposal, and generally welcomes the tone and thrust of the proposal. Community Planning only mentions representatives from public service providers not the community. How is the community going to be involved? Community Organisations, the principle of involvement is welcomed, but there has to be a means by which the service provider is judged on their involvement. The CC is in agreement regarding the taking over of public building.

Community Council Business
Sandy attended the Scottish Rural Parliament inaugural regional event, which follows a model of similar bodies in Europe. The general consensus at the meeting was that if the new body did not have elected representatives and decision making powers it would just become another talking shop.

Councillors’ reports
Cllr Robertson: There’s a problem that Reports of Handling are not including the Conservation Officer’s Report, or any of its contents, which Cllr Robertson raised at the discussion of the recent Kinross High School Site application. In order to address this issue, Cllr Robertson has tabled a motion in the relevant committee to prevent this happening in future.
There are still £1.6M arrears from the historical Community Charge, and the increased number of people now on the Electoral Roll might have allowed some of this to be recouped; however there is now proposed legislation from the Scottish Government to no longer pursue these historic debts.
Cllr Barnacle: There are a whole set of problems are present in the Planning Process (as this CC knows only too well) and Cllr Barnacle is raising this through the Member Officer Working Group.
Cllr Cuthbert: Had written a report of problems with the Kinross High School Site Report of Handling which was circulated to all members before the meeting. Cllr Cuthbert is proposing to hold a monthly meeting between the senior planners and our local members where outstanding issues can be raised and progressed.

Planning Matters
There are no new applications for this area this month; there is one application outstanding from October:
14/01486/FLL Erection of dwelling house (in principle) at land 300 metres North-East of former Craigend Farm, Powmill. The CC will contact PKC as application information is incomplete.
The CC was contacted by PNE Wind, the developers of the proposed North Hill Wind Farm, and although they were invited to attend this meeting have not yet replied. Meanwhile, the Scottish Government have issued a Scoping Opinion Request for this development, which this CC will respond to.
Kinross-shire Civic Trust has raised two formal complaints against PKC regarding handling of the Kinross High School site application.
The appeal against the decision to turn down the Outh Muir Wind Farm has been dismissed.

Electoral registration system is changing this autumn

Over the autumn, all Perth & Kinross Council residents will receive a letter through the post telling them about a change to the electoral registration system.

Individual Electoral Registration (IER), which came into effect on 19 September, replaces the household registration system that has existed for almost a century with a requirement to register individually.

The Electoral Registration Officer for Perth & Kinross Council will write to all electors across the council area to inform them of the change to the registration system.

Many electors will automatically move onto the new electoral register. However, some will need to take action to join or remain on it, which they will now be able to do online for the first time.

Alastair Kirkwood, Electoral Registration Officer for Perth & Kinross Council, said:

“All electors will receive a letter at the end of October 2014 that will explain the change to the electoral registration system. Look out for the letter as it will tell you if you have been automatically transferred to the new register or not. If you have not been transferred, you will need to provide some additional information and the letter will tell you exactly what you need to do.”

Legislation providing for the introduction of IER was first introduced by the last UK Government and was followed up by the Electoral Registration and Administration Act 2013 that was introduced by the current UK Government. This legislation ensured that the move to IER in Scotland would not begin until after the referendum, although it began in England and Wales on 10 June.

Andy O’Neill, Head of Scotland Office at the Electoral Commission, said:

“This autumn the Electoral Commission will launch an advertising campaign that will raise awareness of the change to Individual Electoral Registration. No one will come off the current electoral register because of this change until after next year’s UK Parliamentary General Election at the earliest. We will run further campaigns next year to help inform people across Scotland of the change to the registration system.”

Fireworks Display at Nineacres 6 Nov 2014

A Scout Leader with the 2nd Fife has been in touch. They have a camp site at the Crook of Devon (Nineacres) and are holding a small fireworks display tonight at 7.45 to 8pm and would like to inform any adjoining neighbours in case they have pets or animals that could be frightened by such an event.

Draft Minutes Fossoway and District Community Council
4th November, Powmill Moubray Hall

Attending: CCllrs: Trudy Duffy (chair), Kevin Borthwick, Alastair Lavery, Angus Cheape and Graham Pye; Cllrs Mike Barnacle and Dave Cuthbert; 10 members of the public.

Apologies: CClrs Sandy Morrison and Rod Paterson; Cllrs Joe Giacopazzi and Willie Robertson.

Declarations of Interest: None.

Police report: Yet again no Community Police officer was present, and neither was a Police report received, both of which are causing considerable concern to this CC and local Cllrs.

Minutes of the previous meeting: Were signed off without amendments.

Matters arising
Criminal Justice Unpaid Work Team: No response as yet from Carnbo Village Hall to request for work proposals; Kevin reports that Crook of Devon Village Hall has asked for further details of what work could be done, they have been put in touch with the organiser directly.
Rumbling Bridge Hydro Scheme: Kevin passed on report from Hugh Wallace that the remaining landowner has still to give consent – an alternative route is being considered with a further meeting on 19th November to discuss. There is concern amongst residents of Station Road about the new route of the pipeline, although experience of other schemes is that underground pipelines do not create noise problems. Once a new route is decided on, then an amended planning application will be submitted. A tour of comparable schemes in the Dunkeld area will be arranged on 15th November, any interested parties are welcome to attend. A presentation to all members of the public will be held on 3rd December to provide general project updates and to introduce the funding partner Energy 4 All.
Blairingone War Memorial: Cllr Barnacle reports that the PKC Tree Officer has inspected the site and decided that three trees should be felled to avoid any potential damage to the new wall.
Crook Moss Travellers’ Site: PKC’s Enforcement officer (Eddie Jordan) has sent a summary of the current position (as of 26th September) with respect to the planning conditions at this site: very few, if any, have actually been complied with. Cllrs are pressing the PKC Officers for resolution but with no success as yet, a MoP suggested that the original planning application should now be returned to the DMC. The Cllrs will also raise the issue with MSPs and MEPs. The CC will contact SEPA to find out the progress of the licence application. Additionally, Nick Brian will be invited to a future meeting of this CC to explain why these conditions are not being enforced.
Glenquey Quarry: The applications (10/02181/FLM and 10/02182/FLL) are finally on the agenda for the 19th November DMC meeting.
Blairingone Community Workshop: We’re still awaiting PKC’s strategic plan.
Lambhill Chipping plant: Cllr Barnacle reports that he is still waiting for the meeting with Nick Brian and local representatives, but Mr Brian has at last said he will send possible dates.
Crook Moss Community Acquisition: No further action until position is clarified with landowner regarding future developments in this area; consequently this item will be dropped from the agenda for the time being.
Landscape areas in Kinross-shire: When this consultation document has been reviewed, hopefully towards the end of November, this CC will be able to comment.
A977 Defects: Cllr Barnacle has been in conversation with Jim Valentine about this problem. Some of the problems have been laid at the door of Scottish Water.
Alternative views are held by Cllrs about how to address the overall problem of traffic on the A977, especially heavy vehicles; however all Cllrs continue to press the Council to implement a long-term solution, whether that consists of by-passes, traffic slowing measures or ways to encourage heavy traffic to follow more suitable routes. Possible short-term solutions could be the imposition of 20mph speed limits through the villages and/or speed cameras showing current speed. The CC could apply for finance to provide such cameras themselves.
Waulkmill Play Area: Is currently being refurbished, work continues. Next to the play area is a container holding football equipment which is no longer being used. Cllr Barnacle has arranged for the equipment to be moved elsewhere and for removal of the container. Once the play area is complete there may be an opportunity to create new parking for the Church.

New Business
Strathearn Forum of Community Councils: This forum has sent a strongly worded letter to Bernadette Malone raising concerns about Administrative and Strategic matters, most of which sound very familiar to this CC. A response is currently being prepared by the Chief Exec. Perhaps a meeting of the Kinross CCs should be held to share common concerns.
Youth Crime Survey: A survey has been received on this topic from Strathclyde University, asking the community for response – it was completed at this meeting.

Community Council Business
Graham attended the exhibition about a proposed extension to the Green Knowes wind farm. The plan is to add a maximum of ten further turbines of up to 111m in height to the current 18 at the site. The turbines are likely to be located to the North-east of the existing site at Sim’s Hill, Green Law and Rowantree Craig. The machines can be delivered to the site via the A9 and A823, finally using the existing access road. However a new control building and grid connection will need to be constructed. Currently this CC does not receive any of the Community benefit from the Green Knowes site; however there may be an opportunity for that to be addressed if this application is approved.

Councillors’ reports
Cllr Cuthbert: Is concerned about how rarely the Police attend this meeting. Further, the detection rates for crimes in this area have dropped, it would seem that the Police now focus on major crimes and the sort of crimes occurring in rural areas are receiving less attention. The Police will be holding a meeting on 26th November to seek input from Communities.
Cllr Barnacle: Nothing to report other than items previously discussed.

Planning Matters
Alistair responded to the Scottish Government’s scoping request for the proposed North Hill wind farm, and mentioned transport, landscape, bio-diversity, and other matters.
Alastair reported on the progress of the complaints raised by Kinross-shire Civic Trust about the handling of the planning application for the old Kinross High School site. Several of the points have been defined as questions rather than complaints, one or two items have been upheld, but with no indication that any changes will take place.

AOCB: Verge cutting on A977 has involved what can only be described as mutilation of trees and shrubs. It is still policy to only cut verges a distance from the road to encourage bio-diversity. Additionally it is often difficult to ascertain ownership of land adjacent to roads, and it is the landowner’s responsibility to trim their own trees. Cllr Barnacle has enquired about this and been told by Paul Summers that the current activity is a once every ten years cut in order to comply with Road Traffic legislation. Further, a separate contractor will be deployed to tidy up all the debris produced.
Overhanging trees outside the Moubray Hall are causing problems with gutters, etc., – do PKC own the trees? Cllr Cuthbert will look into this.
