National Community Councils Website Launched

Fossoway Community Council has been contacted by the Chief Executive's Office at Perth & Kinross Council to inform us all of a new website to enhance the work of community councils in Scotland.

The text below is from their email.

The Scottish Government are pleased to let you know that as part of their work in collaboration with COSLA to enhance the role of Community Councils, the Improvement Service has developed a Community Council website. The purpose of the website is to:

• Raise awareness of Community Councils amongst the general public.
• Provide information on the role of a Community Councillor to potential candidates.
• Support new Community Councils/Councillors to access information to help in their work.
• Support Community Councils with good practice case studies.

This is the first time a national website has been developed in Scotland with a focus on Community Councils. They would like to thank all the Community Council Liaison Officers and Community Councillors who provided comments on the website. They would also like to thank Morningside Community Council who won the competition for designing the logo, as well as all the other Community Councils who entered.

www.tellmescotland.gov.uk – Benefits for Community Councils

  • www.tellmescotland.gov.uk is Scotland’s online portal for Public Information Notices (PINs) and is supported by the Scottish Government and Scottish Councils. The portal is a useful tool for Community Councils as it provides a single online access point to a range of information from across the country that can be accessed by anyone at any time.
  • The portal was launched in December 2010 and 28 of the 32 Scottish Councils and 18 wider Scottish public sector organisations are now using the portal to publish their PINs.
  • Types of notices published on tellmescotland include road closures, planning or property developments, licensing and any other type of general public notices from Councils, including committee meetings, councillors’ surgeries and events notices. Information from wider public sector organisations is also available, such as advertising of public meetings/consultations, denotification of land use, publication of draft bills, audit reports, corporate plans, and invitations to comment on these documents.
  • Users can quickly and easily search for current and archived notices and instantly see how they might be affected by public service developments in their local authority area, or any other part of Scotland. The national picture provided allows users to view notices along council boundaries and to see what is going on in other local authority areas across Scotland, a service not available on Councils’ own websites or in newspapers. A clear visual representation of the notice location is also available, with an interactive online map highlighting the areas or streets affected.
  • Access and registration is free and there are real-time SMS and e-mail alerts available that will notify the user immediately as a notice is published that matches their predefined requirements (up to 6 postcodes can be registered, for example your home address, business address).
  • The portal allows organisations to provide extra information beyond the statutory requirements, and far more detail than is available in newspapers, enhancing the public’s knowledge of notices. Where relevant, an attachment is also provided to a notice that gives more information i.e. a Traffic Order that shows where speed calming humps are located on a road. Each notice also includes the relevant contact details to find out more about or comment on a particular notice.
  • The portal also provides a more coherent national picture of a whole journey through the ‘Route Notices’ function, highlighting how a series of street closures may impact on someone travelling through more than one local authority area.
  • Tellmescotland provides a significant improvement in the accessibility and depth of information provided through local newspaper advertisements. These improvements, in turn, should lead to greater engagement and a higher level of response to public notices. Feedback received from Community Councils to date confirms the benefits that the portal offers.
  • iOS and Androids Mobile Apps for the Portal have been released and these are available on the iPhone App Store and Android on Google Play. This is an exciting development which we hope will further enhance the user's experience of the site.

Draft Minutes Fossoway and District Community Council
2nd December, Fossoway Primary School, Crook of Devon

Attending: CCllrs: Trudy Duffy (Chair), Kevin Borthwick, Alastair Lavery and Graham Pye; Cllrs Mike Barnacle, Dave Cuthbert and Joe Giacopazzi; 6 members of the public.

Apologies: CClrs Sandy Morrison, Angus Cheape and Rod Paterson; Cllr Willie Robertson

Declarations of Interest: None.

Police report: Sgt. Sandra Williams attended the meeting and explained that resource constraints have resulted in Community Officers being called to urgent work and hence being unable to attend meetings of late. Sgt Williams emphasised that it was always possible to use the special email address for the Community Officer (ku.ecilop.nnp.dnaltocs|TPCerihs-ssornikedisyaT#ku.ecilop.nnp.dnaltocs|TPCerihs-ssornikedisyaT) to contact them.
Moving on to the normal report, no crimes have been reported for this area; however there have been a number of break-ins to houses and garages in nearby areas.

PKC are looking for volunteers to join the Licensing Forum – contact ku.vog.ckp|llebpmaClieN#ku.vog.ckp|llebpmaClieN if interested.

Emergency response training has been taking place recently, which has resulted in people hearing and seeing “blue light” vehicles more often than normal.

MoP informs us that the main street in Scone has a set of traffic lights that are turned red if a vehicle approaches at excessive speed. Cllr Giacopazzi had previously been told by PKC that this was not possible.

Kevin received a message from Commander Mike Whitford announcing the creation of a weekly bulletin describing crimes in our area that will be sent to the CC.

Minutes of the previous meeting: Were signed off without amendments.

Matters arising
Criminal Justice Unpaid Work Team: There are a number of proposals on the table which can be considered for performing by the team in the Spring.

Rumbling Bridge Hydro Scheme: Kevin brought an update from Hugh Wallace. Presentations to Rumbling Bridge residents and visits to comparable schemes in Dunkeld have gone well. The revised route requires permission from three landowners, two of whom have already consented, and once the third has agreed an amendment to the planning application will be submitted, hopefully before the next meeting of this CC. The meeting planned for 3rd December will now be held early in the New Year, provisionally the 14th January.

Blairingone War Memorial: Cllr Barnacle reports that nothing will now be done until the New Year.

Crook Moss Travellers’ Site: Cllr Barnacle has sent a comprehensive letter to PKC discussing the location of Gypsy/Traveller Sites and the protection of the Loch Leven Catchment. Cllrs Cuthbert and Giacopazzi had a long meeting with the Planners and stressed that the Enforcement issues are still ongoing, particularly noise, with little sign of any of them being followed. Local Cllrs have agreed with Nick Brian that a list of Planning Applications that should be given most attention will be created, especially concentrating on enforcement. Cllr Cuthbert has analysed submissions to the DMC and it turns out that 34% are in Kinross-shire, which suggests that planning applications in this area are more contentious than in other areas.

Glenquey Quarry: The applications (10/02181/FLM and 10/02182/FLL) were unanimously refused at the 19th November DMC meeting, even though the intention was merely to discuss conditions of an extant application. Cllr Giacopazzi explained that the planning lawyers are not confident that this refusal will not be overturned on appeal.

Blairingone Community Workshop: We’re still awaiting PKC’s strategic plan.

Lambhill Chipping plant: Cllr Cuthbert reports that Nick Brian stated that the planning application would shortly be resolved, although we don’t know in what manner.

Landscape areas in Kinross-shire: The consultant’s report was received on the afternoon of this meeting; hence it has not yet been possible for the CC to comment. An important consideration is to check which areas are included, especially the Devon Gorge.

A977: Cllr Barnacle is still seeking a meeting of all parties to decide on the best short and long term solutions to the problems of speeding and HGV usage of the road. There is strong community interest in addressing these problems; however there are, not surprisingly, different views about what will and won’t work.

Waulkmill Play Area: Work is ongoing, with some delays due to weather. The Portakabin has now been emptied, and is likely to be taken away in return for a donation to the hall committee.

Greenknowes Windfarm Extension: The scoping report has been published, although it doesn’t contain any details of exactly how many turbines are proposed or where they would be placed. Alastair has created a response requesting additional coverage of Visual Impact, Transport, Landscape, Biodiversity and Consultation. It’s important that this application takes account of the current gap between the previous Areas of Great Landscape Value and pending Landscape Designation, and isn’t allowed to fall between them.

Strathearn Forum of Community Councils: As reported last month, this group has sent a letter of complaint to Bernadette Malone. Since there are common areas with other CCs, then a meeting will be held in January to discuss a combined approach.

Overhanging Trees at Moubray Hall: Cllr Cuthbert reports that this has been reported to Richard Brough and it will be looked into. There seems to be some confusion about who owns the land where the trees are.

A977 Verge Cutting: Although some of the results of this exercise have been cleared up, there is still a large amount to do. Cllr Barnacle will chase.

Fly Tipping (Old Golf Course Road): This has been removed now.

New Business
Management of Temporary Gypsy/Traveller Encampments: This CC responded to the PKC consultation paper, and although the Council co-operated in slightly extending the time to respond it was still very short notice, giving no opportunity for the wider public to be involved.

Community Empowering Plans: The Community Empowerment (Scotland) Bill may provide the CC with an opportunity to request participation in the Community Planning Partnership; a local body consisting of the Council, Emergency services, NHS and Scottish Enterprise or Highland and Island Enterprise. The bill also includes provisions for communities to purchase small areas of unused land.

Community Council Business
Kinross Fund: Angus reports that there were no applications, so the next meeting has been held over until March.

Community Safety Meeting: Sandy, Trudy and Kevin attended this meeting which discussed improving communications between the Police and Fire Service and the Community.

Planning Users’ Forum: Sandy attended this meeting – Sandy will report at the next meeting. The
Minutes of the Training in Planning Issues workshop contain a suggestion that Kinross members were only interested in discussing specific local issues which was certainly not the case. A correction will be sent to the author.

Councillors’ Reports
Cllr Giacopazzi: Cllr Robertson’s motion at the E&I Committee on the 12th November was passed, and so in future, full reports from the Conservation Officer will be posted on the Planning website. Additionally, the Report of Handling will include a summary of the Conservation Officer’s position, together with the Planning Department’s response. There is currently some confusion about the detail of this motion, which will hopefully be clarified once the E&I minutes are published.

Cllr Cuthbert: Adds to Cllr Giacopazzi’s report above that reports from internal planning consultees (e.g. Roads) would only be submitted when they were “acceptable”, which could result in the reports being published too late to be of use to the members of the DMC.

Cllr Barnacle: Nothing further to add to items already covered above.

Planning Matters

An application has been posted for a single Wind Turbine at Gibsley Farm in Forest Mill, probably in Fife, which Alastair will review.

Correspondence: All the correspondence was available for viewing:
The TellMeScotland web site (http://www.tellmescotland.gov.uk/) enables the public to learn about Planning Applications, Traffic and Licensing Notices from almost all Councils and many other Public bodies in a single place. It’s possible to search for new notices based on your location and also to be sent email or text reminders of all new items within a specified radius of your postcode. Cllr Barnacle notes that as it’s Scottish law that only properties 20metres away are “Neighbour Notified” then it’s even more important to use this sort of website to find out what’s going on in your area.

There will be no waste collections on 25th/26th December or 1st/2nd January. Recycling centres will be closed on the same dates. Collections scheduled for 25th will be made on 27th, those for the 26th on the 28th, for the 1st on the 3rd and the 2nd on the 4th. There will be no garden or food waste collections between the 22nd December and 4th January.

There will be further closures on the Dunning Road over the next few months.

Does your community have an environmental project or a piece of land to improve, which could make a significant difference to your local environment?

Is your idea widely supported within your community?

Perth & Kinross Council could support you with a grant of between £2,500 and £10,000.

What is the Community Environment Challenge Fund?

The Community Environment Challenge Fund is for environmental projects. The projects are to be led and delivered by community groups and must make a significant difference to the local environment and be widely supported within the community.

What kind of projects will be supported?

Projects which can demonstrate any of the following are a priority for support:
● ‘Spend to save’, eg changing bedding plants to herbaceous plants to save on maintenance and materials.
● Physical environmental improvement projects which reduce waste, reduce carbon, increase reuse and recycling or use environmentally-friendly materials.
● Enhance/contribute to the local economy such as tourism or craft or use of local materials.
● Benefits to the wider community encompassing a range of age groups and abilities.
● Link to other existing or planned regeneration initiatives (eg conservation area appraisals).
● An ability to complete the project within 12 months.
● Demonstrate environmental sustainability, eg carbon reduction.
In addition, there is a requirement for a long-term maintenance commitment for any projects undertaken through the Fund.

What can the grant not be used for?

The fund will not be able to support the following:
● Internal renovations of buildings as the fund is aimed at environmental improvements.
● Asset transfer.
● Staff costs unless it is for implementing the works.
● Un-adopted road repairs or maintenance.
● An increase in infrastructure on sites which do not have a commitment to long term maintenance.
● Completed projects.
● A project which has received funding from the Council in the past three years.

How much would the grant be?

Each community group will only be able to apply for one grant in each financial year.
Grant requests must be at least £2,500 and up to a maximum of £10,000 with 50% match funding. The whole project can be of any size and there is no defined maximum project cost.
Several projects can be teamed up together into one application so as to meet the minimum funding level.
In exceptional circumstances, where projects can demonstrate a wide range of physical environmental benefits within a community, a larger award may be made. The maximum award is up to 50% of the total costs.

Match-Funding

The funding will only be paid to the community group when proof has been supplied that match-funding has been secured. Match-funding can include fundraising activities, cash contributions and in-kind support. The track record of the community group mobilising in-kind support will also be considered as part of the application assessment.

Monitoring the Project

An End of Grant Monitoring Form will be provided to each community group who has received funding so that the positive impacts on the community and the local area can be recorded, shared and celebrated.

Who can apply?

  • The organisation seeking funding must be a constituted group and could act on behalf of other community partners.
  • Projects must be developed by community or voluntary organisations.
  • The definition of a voluntary or community organisation is a body led by volunteers, is non-profit distributing, legally independent of the state, and is dedicated to a public good (CoSLA/SCVO 1998).
  • The project must have the written support of all local Councillors in the Ward where the project is taking place.
  • The project must also have the support of a range of local community groups such as Bloom Groups, Development Trusts, Youth Groups and Community Councils.
  • Before work starts, projects must have the agreement of the landowner and also any statutory consent such as planning permission or building warrants if required.

6th January, Blairingone Primary School

Police report: We are now in receipt of Commander Mike Whitford’s weekly bulletin, which is proving to be useful and informative. No local report was received from the Community Police Officer. We’ve received some details about the Powmill accident with a lorry, which didn’t shed its load even though it tipped over.

Minutes of the previous meeting: Were signed off without amendments.

Matters arising
Rumbling Bridge Hydro Scheme: The amended pipe route is now agreed, and an updated planning application will be submitted shortly. The meeting with local residents is now provisionally planned for the 21st January.
Blairingone War Memorial: No update.
Crook Moss Travellers’ Site: Sandy reports that there is no progress with the enforcement actions, pending the licence for the waste water disposal which has still not been granted. Complaints continue to be received from neighbours about noise from generators, which are still not enclosed in buildings or acoustic covers as required by planning condition.
Glenquey Quarry: We await a possible appeal against the refusal of the planning application.
Blairingone Community Workshop: We’re still waiting for PKC’s strategic plan.
Lambhill Chipping plant: No update – the proposed site meeting is still not arranged, Cllr Robertson will look into why not.
There was extensive discussion regarding the perceived lack of co-operation and involvement with the public and the CC by the PKC planning department. It was stressed that the CC does not wish to be in a permanent state of dispute with the planning department; it wanted to have a co-operative, respectful relationship. It was accepted that the parties would not always agree on outcomes, but at least the views of the community should be listened to, responded to, and discussed in a mature manner. It is essential that responses to matters raised by individuals and/or the CC are dealt with in the timescales laid down by the council.
Landscape areas in Kinross-shire: Kevin passed on Alastair’s analysis of the consultant’s report: Fossoway has lost none of its designated land in the Ochils area and the proposed area is now more coherent as it extends beyond the Kinross-shire boundary; whilst the old AGLV was a Kinross-shire only designation. The new area includes the sites of both current wind farm proposals. The loss is the Devon Gorge area, which could be argued for inclusion as Clackmannanshire have included a narrow riverside area up to the Kinross boundary. The CC will respond accordingly and notify the local councillors.
A977 Defects and Mitigation Measures: Cllr Barnacle has arranged a meeting of all interested parties on the 20th January at Loch Leven Community Campus.
Waulkmill Play Area: No update.
Overhanging Trees at Moubray Hall: No update.
A977 Verge Cutting: Kevin notes that the clean-up after this activity is not very thorough, and a large amount of litter has been exposed and not collected. Cllr Robertson will chase progress of the clean-up, and request a litter pick.

New Business
Draft Flood Risk Management Strategy: PKC is to hold a public consultation on this, and has contacted this CC for comment. We need clarification of whether our area is actually included in this strategy.

Community Council Business
No Meetings attended this month.
Fossoway Community Office: This organisation, which has been in operation for over ten years, has sadly now been made redundant by the onset of modern technology. Thanks to the many volunteers who have worked hard to keep it going over the years.

Councillors’ Reports
Cllr Robertson: It’s been agreed that Conservation Officer’s (and other internal consultee’s) reports should be made public on the planning portal and made available to all members of the Development Committee. Cllr Robertson is very hopeful that this will improve the transparency of the planning process.
With planning for the next budget currently underway, Cllr Robertson is hoping to be able to extend the opening hours of the Loch Leven Campus, perhaps reversing the previous closure on Mondays.

Planning Matters
There are no new applications to PKC in our area this month; however there is an application to Clackmannanshire for a 79m wind turbine at Meadowhill (14/00267/FULL) The top part of the turbine’s blades will be visible from Blairingone.

Correspondence: All the correspondence was available for viewing.

AOCB: MOP complains about the speed of traffic, especially lorries, through Blairingone. This has been raised with PKC and the Police on several occasions in the past with no result. Sadly our initiative to implement Community Speed Watch was closed down by the Police. The meeting on the 20th mentioned above will include this issue. The CC is also investigating the possibility of a community funded speed camera. Cllr Robertson will request the Police to conduct speed checks. Trudy reports that some of the speed sensitive signs are not working, and Cllr Robertson will report these to get them fixed.

3rd February, Fossoway Primary School

Attending: CCllrs: Sandy Morrison, Trudy Duffy, Kevin Borthwick, Angus Cheape, Alastair Lavery and Graham Pye; Cllrs Dave Cuthbert and Joe Giacopazzi; 13 members of the public.

Apologies: Cllrs Mike Barnacle and Willie Robertson.

CC Membership: Rod Paterson has unfortunately had to tender his resignation due to relocation of his job. The CC thanks him for all his efforts over the years. Kevin will take over as temporary Treasurer until the AGM.

Declarations of Interest: None.

Police report: The Commander’s Bulletin continues to be informative and useful. We have a new Community Sergeant, Geoffrey Goodison and a new Community Co-ordinator, Sergeant Amanda Nicholson.
PC Dougie Stapleton was unable to attend the meeting but sent the following report: Three large storage heaters were stolen from the grounds of a commercial property in Blairingone between 27th and 28th January, enquiries continue. Two males have been arrested in Cumbria for theft of quad bikes and other property, some of which came from this area. Roof lead thefts and break-ins to commercial vehicles have taken place recently; any information should be passed to the Police on non-emergency number 101.
Community consultation 2015-2016 on Multi-Member Ward Policing Plans is currently taking place, with feedback due by 15th February - http://www.scotland.police.uk/your-community/tayside/perth-and-kinross/
Cllr Cuthbert reports that w.e.f. from 2nd February the local Police have been restructured, including the new Community Officers mentioned above.
Speed checks will be carried out on A977, especially in Blairingone.
Cllr Robertson will be meeting Chief Inspector Mike Whitford later this month to discuss why Community Speed Watch is happening in Highland region even though we were previously told that Police Scotland wasn’t in favour of these schemes.
MoP reports that dialling 101 from Blairingone routes your call to Stirling who say that they’re not responsible for that location and you need to contact Dundee.

Matters arising
Rumbling Bridge Hydro Scheme: Hugh reports that the planning application for the amended pipe route has been submitted (see below.) Hugh has prepared a draft proposal about how a Community Benefit scheme might be structured – it would generate at least £5k per annum for at least twenty years, the funds being used to improve the environment in the gorge, but also other local activities. Paul Fair of Energy for All was present and described how the community could be involved in financing the project by joining a local co-operative society that would generate some income for the investors, but would also augment the Community Benefit scheme. There are examples of other schemes on Energy for All’s website which would give an idea of how the co-op would work. In response to question from a MoP Hugh thought that it might be possible for works to begin this autumn, but it’s more likely to be spring 2016.
Blairingone War Memorial: No update.
Crook Moss Travellers’ Site: Sandy has spoken to SEPA, and discovered that they had made a site visit which revealed that in the absence of PortaLoos the occupants were using buckets for black waste which was reportedly being disposed off-site. The application for a CAR licence covering a whole site processing plant has been withdrawn to be replaced by five separate applications for a processing plant per unit leading to soakaways. Cllr Cuthbert reports that there has been no change in the enforcement of the planning
conditions. Cllrs Cuthbert and Barnacle will bring a motion to the next DMC requesting that the planning application for the site be brought back to the DMC for the enforcement issues to be discussed. Cllr Giacopazzi has been pursuing the issue of generator noise and asked if complaints are still being received – Sandy explained that Public Health are responsive to noise complaints making site visits which result in the generators being temporarily moved, but there is no permanent solution.

Lambhill Chipping plant: No update – the proposed site meeting has still not taken place. Cllr Cuthbert has escalated this to the Chief Executive but still no response from Nick Brian.
A977 Defects and Mitigation Measures: There was a meeting of all interested parties on the 20th January at which it was agreed that a joint meeting needed to be held to discuss this issue.
Waulkmill Play Area: This is hoped to be open in March, after delays due to poor weather.
Strathearn Forum of CCs: Cllrs Cuthbert and Barnacle will be taking a number of proposals for improving the DMC to the Member Officer Group meeting in March; meanwhile Cllr Robertson has obtained an informal agreement from Nick Brian that objections from CCs would be given more weight than those from individuals.
Overhanging Trees at Moubray Hall: Cllr Cuthbert reports that this problem is being looked into, and will be addressed once the weather improves.

New Business
Main Issues Report: Comments to be supplied by 31st March. We should hold a Community meeting, probably in Crook of Devon, to discuss the local plan and existing policies.
CC Membership: We need new members representing all ages and sectors of the community – volunteers are very welcome. I t was suggested that we try to recruit people during the meeting to discuss the Main Issues Report.
Bollards Opposite Crook Village Hall: A MoP reports that another one has been knocked over. Cllr Giacopazzi has raised this with Chic Haggart who has involved the Road Safety Team. Cllr Robertson raised the issue with Garry McConnell and Stuart D’All and the latter replied that the former will look into fixing it shortly. Meanwhile, Cllr Barnacle is organising a site meeting with the Roads department and this CC to assess alternative possibilities for the footpath to the school around this junction.
DTR Scheme: This is the scheme to use local taxis instead of a bus service, which has been very successful, so an application has been made for a Securing the Future award to make sure the scheme continues.

Community Office has now closed down and distributed its final assets.
Reporting failed street lights via the PKC website doesn’t seem to be working, and the “Clarence” number goes to the wrong place.
MoP ask about derelict houses in Blairingone, Cllr Giacopazzi will look into it.
Discussion about where the school buses stop in Powmill, since they seem to be choosing dangerous places. Kevin will investigate.

Attending: CCllrs: Sandy Morrison, Kevin Borthwick, Alastair Lavery and Graham Pye; Cllrs Mike Barnacle, Dave Cuthbert and Joe Giacopazzi; 19 members of the public.
Apologies: CCllrs Angus Cheape and Trudy Duffy; Cllr Willie Robertson
Declarations of Interest: None.
Police report: No Officer was present; however a report has been received. There are no reported crimes in our area in the last month. Residents should be aware that bogus callers and workmen continue to operate in the area. Several thefts of power tools and equipment have taken place from vehicles and commercial premises across the Perth and Kinross area. Any information should be reported to the Police on the 101 number. Sergeant Sandra Williams retired on 27th February; the CC wishes her a pleasant retirement and thanks her for her assistance over the years.
Minutes of the previous meeting: Cllr Giacopazzi notes that Cllr Cuthbert is not a member of the MOWG as implied by the minutes, although he plans to attend the next meeting to address relevant points.

Matters arising
Rumbling Bridge Hydro Scheme: We have received information about how the Community Benefit Fund is to be set up, its membership and role. More details will be provided and further discussion will take place closer to the time.
Blairingone War Memorial: Cllr Barnacle reports that the contractor will carry out the move in the spring.
Crook Moss Travellers’ Site: Cllrs Cuthbert and Barnacle had intended to raise a motion to discuss this at a DMC meeting, but instead the Planners will bring a progress report to the March 17th DMC meeting. Cllr Barnacle has contacted SEPA regarding the CAR licence applications for individual systems, and PKC Planning Department are reported to be happy with this changed arrangement, even though it’s contrary to the original planning consent. Cllr Giacopazzi intends to raise the issue of planning enforcement at the MOWG.
Glenquey Quarry: We await a possible appeal against the refusal of the planning application, which must be made before the end of March.
Blairingone Community Workshop: At the request of PKC, the involved landowners have instructed Ballantyne’s to prepare a strategic plan, which is being produced as quickly as possible, with the aim of it being ready for consideration by the Community within the next six months, or hopefully sooner. There was extensive discussion about whether development would safeguard the school, and where it would be economically viable to develop new houses that would be supported by the Community.
Lambhill Chipping plant: John Anderson updated the meeting on progress of the application. The recently published Noise Assessment has been rejected by the Planners. John has been promised by Brian Stanford that a meeting will be held with the planners, local councillors and a representative of the CC, with an MP or MSP present as an impartial observer. Meanwhile John urges all local residents to object to the application.
MoP notes that there continues to be numerous lorry movements every day.
Cllr Cuthbert has been trying to arrange a site visit for a considerable time; however the publication of the Noise Report has made it clear that mitigation measures need to be put in place to reduce the noise – in the meantime, the Case Officer has agreed that the site should be issued with a stop order, which hasn’t happened as of the date of this meeting.
Several MoPs point out that even if a planning application is approved with conditions attached, the people of the village have no confidence that the conditions will be enforced. Cllr Giacopazzi agreed to look into whether the site is currently assessed as an agricultural or industrial site for Council Tax purposes.
As a result of the provision of the Noise Report, the site’s planning application 13/01174/FLL has been reactivated, and letters have been sent to prior objectors notifying them of this. (In fact the initial letter referred to the wrong application reference, and had to be re-issued.) The CC will write to PKC to seek clarification of the whereabouts of the noise mitigation measures, and to confirm that previously submitted objections would still be included.
Landscape areas in Kinross-shire: No policy has yet been published by PKC.
A977 Defects and Mitigation Measures: Cllr Giacopazzi attended a meeting with PKC where a report of the number of traffic accidents and volumes on the A977 compared to other trunk routes in the area showed that measures on the A977 are not a priority at the moment. Currently there are 4,500 vehicles per day, whereas the capacity of a road of this level is 13 thousand. The proportion of heavy vehicles is 6%. The accident rate has dropped from 13% to 9% since the Clackmannanshire Bridge was opened. The Roads department have agreed to change the style of drainage gullies to a type that make less noise when heavy vehicles cross them; Consideration will be given to installation of signs that actually show vehicle speed; Signage on the far side of the Clackmannanshire Bridge will be adjusted to try and to divert more traffic away from A977 and through Dunfermline.
Several MoPs raised the issue of speeding through the village and asked why it wasn’t possible to install speed cameras, Cllrs explained that cameras are not allowed in the absence of a bad accident record, although this rule is due to change shortly.
Waulkmill Play Area: This is expected to be completed this month.
Overhanging Trees at Moubray Hall: Awaiting weather improvement.
Main Issues Report: Comments need to be provided by the 31st March. During Sandy’s attendance at the LDP2 Pre-MIR drop-in surgery he asked how the Community as a whole could be consulted in the short timescale, with the response that the Community would be consulted once the MIR was produced. That was when major consultation takes place and the community can have input and changes can be made. Local councillors agreed that this was not how they expected the process to work, and that they thought that Community consultation should be taking place now.
Sandy suggests the following items should be included: Landscape areas; Gypsy Traveller’s Policies, including pro-active creation of sites; No retrospective applications should be allowed within the Loch Leven catchment area, with any required remediation measures being carried out before development begins; A wind farm policy needs to be developed; A977 mitigation measures; More detail on planning conditions to remove any ambiguities; Provision of employment development opportunities in areas outside Perth city; No development immediately adjacent to existing village boundaries; More development of brown field sites before green field sites are considered; Social and affordable housing should be built in areas where there is actually a need rather than insisting on them being created in every development; Concentrate new developments in the centre of existing communities rather than allowing ribbon development; Infrastructure needs to be developed in advance to encourage development; Enhance existing waste water processing capabilities to allow developments to take place. It had previously been established that development should take place at Blairingone and Powmill. The development at Powmill should focus on the old Hotel site and the centre of the village rather than ribbon development. At Crook of Devon the field beside the village hall could be looked at for possible development, provided the developer would put in a roundabout at the T-junction next to Fossoway Garage, but ensuring proper access for the garage. In Carnbo provision of public sewage in view of the extensive development which has taken place.
Any further items that the Community feels should be added to the above list are welcome to be submitted as well. MoPs suggest that the Blairingone by-pass should be added to the plan as it’s generally agreed that this would be the appropriate solution to the traffic problem in Blairingone.
Because of the views expressed by PKC officials the CC will submit the above items but any further input from members of the community would be welcome and should be sent to both PKC and the CC prior to the 31st of March.
CC Membership: We would welcome new members.
Community Speedwatch: Cllr Robertson was due to meet with Chief Inspector Mike Whitford to discuss why this is being launched in the Highland Region but not here, however Cllr Robertson was unable to attend this CC meeting so will report next month.
Bollards Opposite Crook Village Hall: Cllr Barnacle has requested a site meeting to discuss a more extensive solution to this problem, but hasn’t had a response yet.

New Business
Lambhill Forestry Project: Kevin passed on notice from the Forestry Commission that the footpath across the first field will be closed during project works; however access can still be made by going round the edge of the field, although MoP report that this is currently difficult due to the ground conditions. There is some concern from MoP about the nature of the work in process and continued access to the FC land without needing to cross ground belonging to other landowners. The FC would also welcome school visits, etc.
BT Adopt a Kiosk Scheme: BT are offering the opportunity to purchase unused phone boxes.

Cllr Barnacle: PKC has a Budget available of 40% towards the adoption of the road at the Village Hall, Crook of Devon, which will be actively pursued.

Police report: PC Sadie Allan attended, and a report had been received. There are no reported crimes in our area in the last month. Residents should be aware that bogus callers and workmen continue to operate in the area. Several thefts of agricultural machinery, power tools and equipment have taken place from vehicles and commercial premises across the Perth and Kinross area. Any information should be reported to the Police on the 101 number.
The CC asked PC Allan to remind Ron Brady, of Easter Muirhead stables, of his responsibility to keep the road by his property clear of mud for road safety reasons.
We’ve received notice about the launch of Community Watch, which is a new service replacing Rural Watch. Members of the CC will attend the launch meeting.
Cllr Robertson met with Chief Inspector Mike Whitford to discuss why Community Speed Watch is being launched in the Highland Region but not here. The explanation is that the scheme being deployed in the Highlands is not the same as here, its volunteers record speeds and report them to Police. PKC’s Community Safety Officer is investigating and will give us details as to whether something like that could be done in our area. Volunteers will need to be trained and Police checked.

Matters Arising
Rumbling Bridge Hydro Scheme:
No update.
Blairingone War Memorial: Work to be carried out in spring.
Crook Moss Travellers’ Site: Cllr Robertson introduced a paper, prepared by Cllrs Cuthbert and Barnacle, about the situation at this site to the 17th March DMC. He explained that the DMC needs to issue an ultimatum. The paper was discussed at length and the DMC members agreed that a report would be published in six months’ time, and if the majority of the planning conditions have still not been met by then, then the planning permission would be withdrawn.
Cllr Robertson had asked Environmental Health why offending generators were not confiscated when noise reports were received, and was told that lack of power could create a health risk for the users.
If noise complaints continue to be received, then Cllr Cuthbert will be pressing for fixed penalties to be imposed on the users.
Glenquey Quarry: An appeal against the refusal of the planning application has been lodged. Any additional objections need to be lodged with the Scottish Ministers by 9th April.
Blairingone Community Workshop: No progress.
Lambhill Chipping plant: Cllr Cuthbert reports that the decision letter refusing permission was issued on 25th March. It’s not clear whether the stop order has actually been issued. John Anderson wishes to thank Brian Stanford for his assistance in this matter.
Landscape areas in Kinross-shire: Cllr Robertson reports that this came before the planning committee last month, unfortunately Cllr Barnacle’s motion to add the Cleish Hills, and Devon Gorge was defeated, although the remainder of the paper was approved. There may still be an opportunity to designate these two areas via the Main Issues Report.
A977 Defects and Mitigation Measures: Cllr Cuthbert is challenging the published traffic statistics which show a much lower number of HGVs than is generally perceived. A survey conducted by a local resident nearly 15 years ago showed 4856 vehicles per day, of which 14% were HGVs, and it’s difficult to believe that those numbers have not significantly increased since then.
Waulkmill Play Area: The Park is now open! The old container has been removed. MoP reports that the play area is being well used; however the level difference between the ends of the Flying Fox is not sufficient to make it work. Cllr Robertson will look into this problem.
Main Issues Report: A response was submitted on behalf of this CC, which included the following points: Appropriate business development in rural areas, e.g. craft workshops; Emphasis on brownfield site development in town centres; Village development should be central rather than linear; Pre-emptive provision of sites for travellers by PKC; Overarching policy for windfarm development; Closer liaison with Scottish water to provide appropriate water and sewage supplies for proposed developments; Social housing to be provided in areas where there are adequate supporting services, and not mandated to all developments; Robust protection of Loch Leven catchment; Developments along A977 should contribute to mitigation measures, with a bypass for Blairingone as a priority; Crook of Devon: Development in conjunction with new roundabout at A977 junction by Fossoway Garage; Powmill: Develop old hotel site and in the village centre; Blairingone: develop between the line of the previously proposed bypass and the village, and elsewhere as previously suggested; Carnbo: Needs public sewerage provision. The CC’s full response is available in the correspondence, and on PKC’s website.
CC Membership: We would welcome new members.
Bollards Opposite Crook Village Hall: The bollards have now been replaced. A site meeting was held with the PKC Roads Department, members of this CC and elected members to discuss a possible barrier or pavement widening. Kevin reports that the Roads Department are investigating what possible changes can be made to improve the safety of this section of road.
Lambhill Forestry Project: We’re awaiting a response to our question about access during works.
New Business
Crook Moss Community Involvement:
Sandy has established the name of the current landowner and contacted them. The landowner has suggested a joint venture with the CC to protect the land against undesirable development, and provide ecological benefits. A meeting will be set up to discuss this proposal.
Flood Risk Assessment: The first phase of this report, received previously, didn’t appear to be relevant to us, but there is now a new report which will be examined.
Gritting and Snow Clearance: PKC have asked for comments on the performance of this activity. A number of comments have been received via the CC’s Facebook page, which will be summarised and returned to PKC.
MoP points out that the recent tanker crash on the A977 was attributed to ice on the road, hence the priority of this road should be raised so that it is gritted 24/7 like other major roads.
This led to a comment that the bridge fence damaged by the above crash has not yet been repaired and a more substantial temporary barrier needs to be erected to make the pavement safe for pedestrians pending full reinstatement. Cllr Robertson will chase this.
Signage in Fossoway Area: Cllr Barnacle has requested PKC to add a footpath sign at Crook of Devon Village Hall car park (SW corner) to Waullkmill Park/Fossoway Church. The sign on the Devon bank directing walkers through Lendrick Woods is incorrect, and instead a choice of continuing along the bank and through Naemoor Estate should be offered. During the discussion of this item a MoP suggested it would be good to get the Criminal Justice Unpaid Work Team to clean signs generally, and the CC will contact the team about this.
Station Road Adoption: Angus and Cllr Barnacle attended a meeting on 2nd April to discuss this, and other local issues, however in the absence of both of them, Kevin passed on that there was general consensus about the adoption, with the possibility of further funds being found.

Councillors’ Reports
Cllr Robertson: The Boundary Commission has suggested that the Kinross-shire ward be changed to make it smaller and reduce the number of Councillors to three. Everywhere north of the A91 would be moved to the Earn Ward, which takes no effect of local areas. This was considered to be completely unacceptable by all present – one of the implications would be that this CC would now cover more than one ward, and would need attendance of two additional councillors from the other ward. Cllr Robertson will pass on our concerns to the relevant department.
Cllr Cuthbert: Is also preparing a paper to comment on the Boundary Commission change. This area has fewer constituents per Councillor than others, and hence why it’s being targeted for reduction.
Rumbling Bridge planning application was turned down by the Local Review Board, of which he is a member.

We now have 90 likes to our Facebook page, the posting about the tanker crash and the road closure for its recovery were viewed by over a thousand people.

Briefing for Community Councils: Charitable silent auction of Perth & Kinross Council’s Ryder Cup street dressing items

The Provost and Council Leaders have agreed that Perth & Kinross Council will operate a silent auction of Ryder Cup street dressing items. This will take place from 20 April until 31 May. Ryder Cup Europe is supportive of this initiative.

All proceeds from the silent auction will go to the two official local Ryder Cup charities: Perth & Kinross Disability Sports and Friends of St Margaret’s Hospital. The charities are also supportive of this initiative.

Up for auction will be a varied collection of street dressing items, such as flags, posters, banners that were hung from lamp posts and road-side signs. These were used to decorate the local area and present a smart and warm welcome to Ryder Cup visitors when the prestigious golf tournament took place in September last year. This is a chance for members of the public to gain a small piece of historic occasion, which was credited by many as the ‘best ever Ryder Cup’. The Junior Ryder Cup at Blairgowrie Golf Club was also credited as being the most successful event.

The items feature the Ryder Cup logo and include wording such as ‘Perthshire Welcomes The Ryder Cup’ and ‘Blairgowrie Welcomes The Junior Ryder Cup’, and winning bidders will also receive a certificate of authenticity with their item.

The full list of items up for auction, a bidding form and a silent auction brochure are available to view online at www.pkc.gov.uk/rydercupauction. Hard copies of the silent auction brochure which contains the list of items will also be available to read in local libraries and mobile libraries across Perth and Kinross, as well as in Perth Museum & Art Gallery, the Fergusson Gallery and at reception in the Council's offices in Pullar House in Perth city centre.

Police report: PC Nick Shembri attended the meeting, and gave the report. There were no reported crimes in our area in the last month. However, individuals have been selling chainsaws/generators in the Perth & Kinross area – on one occasion, further enquiry is to be made after a member of the public contacted the police and the person concerned was traced. If you are offered goods being sold in this fashion, make sure you are aware of what you are buying before any money is exchanged. SCAMS – the persons carrying out scams are finding more ingenious ways of making you part with your money – remember banks will never ask for details of your account over the phone. Make sure you research a company to which you are divulging your details and ensure they are genuine before making any payments.

Matters Arising
Rumbling Bridge Hydro Scheme: There is now a solution to the pipe run issues through Rumbling Bridge Village and progressing with legal, design, financing etc. No certainty it will proceed to construction but a major hurdle cleared.
Blairingone War Memorial: Work to be carried out in spring.
Crook Moss Travellers’ Site: Noise from generators on the site continues to be a problem. All noise issues should be reported to the Environmental Health Dept. at PKC and possibly ask for a statutory nuisance check. Cllr Barnacle reported that he had contacted Eddie Jordan, the Enforcement Officer, regarding the broken fence and litter which is an eyesore, but was told focusing on new problems would mean giving the residents of the site more time to comply with conditions. He was also told that the travellers were looking to have an electricity supply installed.
Glenquey Quarry: An appeal against the refusal of the planning application has been lodged, and the DPEA will be making a site visit on 7th May. Alastair will attend the meeting to represent the views of this Community.
Lambhill Chipping plant: The site was refused planning permission, and an enforcement notice will come into force on 8th May. Cllr Cuthbert reports that, although it was suggested that a stop order should be issued, PKC legal department would not do this due to a possible financial risk to the council.
It would seem that there is reluctance for the council to take any enforcement action on large applications for the fear of being sued. An appeal to the Scottish Government has been lodged by the applicant, but as the refusal was under delegated powers, the decision should come back to PKC.
Landscape Areas – Kinross-shire: The LLA’s have now been adopted, but unfortunately the Devon Gorge, and Cleish Hills were not included. There will be no further opportunity to make any changes until the public consultation stage for amendments to the Main Issues Report. Cllr Barnacle still wants to raise the issue again with officers in a bid to try and have these sites added.
A977 Defects and Mitigation Measures: Cllr Barnacle reported that there didn’t appear to be any political will to spend any money on the road, and he intends to call a meeting with Cllr Kellas, Cllr Giacopazzi, and others to look at a business case for mitigation measures. It was also reported that speed reactive signs displaying the actual speed drivers were doing would replace the current slow-down signs. This is to happen in this financial year.
Waulkmill Play area: The CC was contacted by a local resident regarding an incident in the refurbished park, where a boy, unfortunately broke his leg on the basket swing. They said that the council had already been notified about concerns the swing was too low, and that the swing had been raised the day before the accident, but it would appear not to have been by enough. The Council checked the site the following day, and the swing was raised further. Cllr Robertson will ask Stephen Kane (PKC Landscape Architect) for a report to clarify the situation, and will report back to the CC at the June meeting.
CC Membership: The CC made an appeal to the public, to encourage people to put themselves forward to become members. When the election takes place in November, two of our current members will be standing down, and this means there will be only four of the current team standing again for re-election. There are 8 places available on the CC, and we will be making every effort to try and fill all the seats. The timetable for the CC election this autumn is that nomination forms will be available from July, with nominations to be submitted between 27th August and 24th September, and the votes being counted, if an election is required on 6th November.
Bollards Opposite Crook Village Hall: We’re awaiting a report from PKC Roads Department on how the safety of this section of road could be improved.
Lambhill Forestry Project: The CC received a response to our question about access during works and the Forestry Commission will continue to investigate the no man’s land where the large ditch is to try and improve access, but hopefully ground conditions should improve over the summer months as grass cover establishes.
Crook Moss Community Involvement: A sub-committee meeting is to be arranged in due course.
Flood Risk Assessment: The first phase of this report, received previously, didn’t appear to be relevant to us, but there is now a new report which is currently being examined.
Gritting and Snow Clearance: We’ve received a response from PKC to our comments about this which stated that the A977 is a category 1a road which is treated between 5am and 10pm 7 days a week. There should be no noticeable difference in road conditions where the A977 crosses into Clackmannan at Blairingone, if anyone can provide any more concise details of this being the case please let the CC know. The response also stated that the maximum speed that vehicles should be doing when gritting should be 30mph, again if this appears not to be the case then please let the CC know the details and we will pass it on to the council. Cllrs Barnacle, Cuthbert, and Robertson will ask for 24h gritting to be carried out on the A977, considering the number of accidents involving HGV’s and also the number of HGV’s using the road during the night.
Powmill Bridge Fence: Cllr Robertson reports that the bridge railings would not be repaired for some time, but the wooden fence would be fixed soon. Kevin reported that the fence had already been repaired.
Footpath Signage in Fossoway Area: The situation is still ongoing.
Unpaid Work Team: Kevin contacted the team about undertaking road sign cleaning in the Fossoway area, but it would be unlikely to happen due to health and safety issues.
Station Road Adoption: Cllr Barnacle reported that there was no further funding available from the Education, or Environmental Services departments, and that more information is required from the Village Hall Committee to see what they are proposing to do. Currently depending on the hall situation the cost per household will be £398.00 +Vat, or £427.00 +Vat.

New Business
Perth & Kinross Community Watch: The Community Watch scheme was launched in our area on 30th April 2015 and is an exciting new service for communities to receive local community safety information from Police Scotland, Scottish Fire and Rescue Service, Perth and Kinross Council, SEPA, SSE and many more. It is a two way web based messaging system which we will be using to send to you crime alerts, appeals for information, crime prevention advice and much more. The CC recommends that people should register via www.pkcommunitywatch.co.uk to receive the e-mail information. Stay Informed, Stay Safe!
Burst Water Main Aldie Road: Cllr Robertson contacted Scottish Water and PKC to inform them about the leaking pipe at the A977 end of Aldie Road, and will report back to the CC at the next meeting.
Flooding, Aldie Road: A MoP contacted the CC regarding a section of Aldie Road that was constantly flooding, and because of this in poor weather flood water was running down his unsurfaced road. The CC contacted Cllr Robertson, who contacted Garry McConnell of the roads department, who came out to assess the problem. Garry then cleared the problem and dug an offlet to allow the water to drain away. All this was done in less than 24hrs. The MoP and the CC wish to thank Garry for the speedy response.
Boundary Commission: There will be a full council meeting on the 13th May where the council will propose that the boundary for the Kinross-shire ward should remain unchanged. The local councillors will prepare additional information to be added to the council’s response. Once this has been received by the boundary commission there will be a public consultation.
For clarification purposes the commission propose to reduce PKC numbers by one councillor, from 41 to 40. This would be lost in the Ward 8 Kinross-shire. The Ward 8 boundary would shrink in size using the M90 and A91 as boundary lines. This would transfer around 1300 electors into ward 9. In theory this could put half of Carnbo, and possibly parts of Milnathort, and all of Glenfarg into Ward 9.

Draft Minutes Fossoway and District Community Council
4th August, Carnbo Village Hall

Attending: CCllrs: Sandy Morrison, Trudy Duffy, Angus Cheape and Graham Pye; Cllrs Mike Barnacle and Joe Giacopazzi; 12 Members of the Public (MoP).
Apologies: CCllrs Kevin Borthwick and Alastair Lavery; Cllrs Dave Cuthbert and Willie Robertson.
Declarations of Interest: Angus declared an interest in planning application 15/01110/IPL.

Police report: Sgt. Sam Greshon attended the meeting, and gave a report. Fossoway Church was broken into and a small amount of cash stolen, this is under enquiry; Power tools were stolen from garage at Blairingone. Garden machinery was stolen from a house in Crook of Devon; Attempted break-in at Powmill. MoPs report that the long straight stretch of the B9097 from Fossoway Garage has frequent speeders. Also, after any event at Knockhill people are speeding along the surrounding roads, especially the A823 towards Powmill.

Matters Arising
Powmill Bloom Group: The group has met several times and applied for funding from various sources. It is extending its remit to address untidy items, including cleaning road signs, etc. they have got PKC to cut verges around overgrown footpaths, and some extra work on this has been done by members. A Facebook page has been set up. A concern is the state of the derelict Ivy Cottage - Cllr Barnacle says that there might be a case for compulsory purchase, since the owner is not in the country and doesn’t respond to correspondence. If the community is in favour of this idea, they should write to Isobel Butt, PKC’s Vacant Property Development Officer, at Pullar House, Perth, expressing their support.
Rumbling Bridge Hydro Scheme: Hugh reports that the landowners are signing leases. Tenders are being sent out to three contractors with the aim of getting prices and timetables by the end of August, allowing work to commence later this year. Assuming that the tenders are favourable, then community meetings will be held to invite investment in the scheme, with a minimum of £350.
Crook Moss Travellers’ Site: SEPA have refused to grant the CAR licences, leaving the occupants with no valid disposal method for grey or black water, and no prospect of connecting to mains drainage in the foreseeable future. After ten weeks of reasonable peace, generator noise became a problem again in July. Approaches to PKC’s Environment Department from both Cllr Giacopazzi and Roseanna Cunningham MSP have not received satisfactory responses. Cllrs Giacopazzi and Cuthbert will be meeting with Environment Services this week. It also appears that the site is currently being extended, with new fences being erected, in direct contradiction of planning conditions. It was stressed that the community was not opposed to the Travelling Community in principle, but the community expected both SEPA and PKC to enforce the regulations and planning conditions uniformly on all sections of the community. The site has now been in operation for three and a half years and the major conditions relating to drainage and noise have still not been satisfactorily addressed. It was unanimously agreed by those present that the CC should, in addition to continually raising their concerns with SEPA and PKC, also contact the newspapers to express those concerns.
Glenquey Quarry: The appeal against the refusal of planning permission was turned down by the Reporter on 27th July.
Lambhill Chipping plant: The DPEA made a site visit in July prior to ruling on the appeal against the enforcement notice. Subsequently, the appeal has been dismissed. The appeal to the LRB of the planning application is yet to be held.
A977 Defects and Mitigation Measures: PKC’s roads department have declined to do a business plan for roundabouts, so Cllr Barnacle has assembled a list of other measures to be considered, with the intention to have another meeting with all interested parties to discuss them.
CC Membership: The CC once again appealed to members of the local community to put themselves forward as Community Councillors. Several members of the current council will be retiring in November and we need more people to fill their places. Anyone living in the area, and listed on the electoral register can apply. The timetable for applications was published in the May minutes, but briefly, nomination forms are available now, and must be submitted between 27th August and 24th September.
Station Road Adoption: Residents are being canvassed by Cllr Barnacle to contribute to the adoption, one has refused, eleven have already agreed, and a very small number are yet to respond. Consequently this should go ahead shortly.
Burst Water Main Aldie Road: Cllr Robertson was not present to report on this.
Boundary Commission: The Local Government Boundary Commission for Scotland have rejected PKC’s unanimous objection to the Commission’s proposal to reduce the size of historical Kinross-shire and hence the number of our local Councillors in Ward 8 from four to three. The proposal is now out for public consultation until 22nd October, and comments can be lodged by letter or directly on the LGBC’s website at https://www.consultation.lgbc-scotland.gov.uk/node/31
Blairingone War Memorial: Cllr Barnacle had written to the developer asking for an update. The developer’s stone mason has now decided that it will not be possible to move the memorial without damaging it, contrary to previous opinions. Cllr Barnacle is seeking a report to get further details of what has changed.

Councillors’ Reports
Joe Giacopazzi: TRACKS have now secured funding for the first part of the Crook of Devon to Kinross Multi-Use Track, which will be a 2km section running from Broomhill Cottage to the Aldie Road. It is hoped that work can begin in late autumn this year. It was pointed out that this road/track was currently used extensively by dog walkers and horse riders and had been to the Chair’s personal knowledge for at least 67 years. The track was also used by householders on the route and farmers to access fields with their equipment and to move stock. In addition, there was occasional use by through traffic particularly when there were roadworks on the A977 in Crook of Devon, so it was essential that if the route were to be used by cyclists there would need to be effective segregation to ensure the safety of the current users.

Attending: CCllrs: Sandy Morrison, Kevin Borthwick, Trudy Duffy, Alastair Lavery and Graham Pye; Cllrs Mike Barnacle, Dave Cuthbert and Willie Robertson; 21 Members of the Public (MoP).
Apologies: CCllrs Angus Cheape; Cllr. Joe Giacopazzi

The normal CC meeting was preceded by a presentation on proposed input to the local development plan by Cllrs Barnacle and Cuthbert. The proposals were based on previous consultations which had taken place within the communities, together with some additional ideas. If anyone would like a copy of the slides used during the presentation, which include maps of the proposed development areas, they should mail Cllr Cuthbert (ku.vog.ckp|trebhtucd#ku.vog.ckp|trebhtucd) and he will send them on.

Declarations of Interest: Sandy has an interest in the proposed multi-use track.

Police report: PC Rhiannon Lorimer attended the meeting, and gave a report. There was a break-in at Blairingone resulting in theft of two quad bikes, and another at an Equestrian centre in Blairingone where a saddle was stolen. The public are reminded to take suitable precautions to protect their property. The Fossoway Church, Blairingone and Crook of Devon break-ins are under enquiry.

Crook Moss Travellers’ Site: There are still problems with noise, although some residents are doing their best to alleviate this. There appears to be some development in the paddock area contrary to planning consent, and a stop notice has been issued. SEPA have been invited to attend the next meeting of this CC to explain the drainage situation. Scottish Water has told Sandy that there is no plan to expand the Drum treatment plant in the foreseeable future.
Lambhill Chipping plant: The appeal to the LRB of the planning application has been deferred pending a site visit and further information being provided by the developer.
A977 Defects and Mitigation Measures: Cllr Barnacle reported that drains will be replaced by a type that are quieter when HGVs cross them later this year.

Station Road Adoption: Cllr Barnacle reported that of the fifteen householders, twelve are on board, two have not replied (one due to change of ownership), and one has refused. Hopefully the adoption will be able to go ahead shortly.
Burst Water Main Aldie Road: Cllr Robertson reported that Scottish Water have no plans to replace the main in the short term, and will fix bursts as they occur, although they realise that the main does need replacing.
Boundary Commission: Cllrs encourage everyone to object to this proposal. There are more details in Cllr Cuthbert’s article in the newsletter. There will be a meeting to discuss this proposal at 7:30pm on the 3rd September in the Kinross Community Campus.
Powmill Bloom Group: The group now has about twenty members, and continues to tidy the village as much as possible, with some caution to ensure the safety of members. The group thanks Cllrs and others who have helped.
Blairingone War Memorial: Cllr Barnacle reports that the Monumental Masons have now decided that it was safer to leave the memorial where it is, even though it was previously agreed by all parties that moving it was both acceptable and possible. Cllr Cuthbert suggested that approaches could be made to the P&K Heritage Trust to raise the necessary funds. A MoP suggested that an alternative plan would be to create a new memorial at the proposed location.
Footpath Signage in Fossoway Area: Cllr Barnacle reported that the footpath in Crook of Devon, between the Village Hall and the Playing Field is going to be permanently diverted from its current route, and signage adjusted accordingly.
Broomhill Cottage to Aldie Road Multi-Use Path (TRACKS): Cllr Robertson explained that the work includes culvert work, etc., and the result of the work will make it possible to travel the entire length off-road. Sandy expressed a concern that an upgrade of the existing path will be used by cyclists travelling at speed which will reduce the amenity for existing users. However there seems to be some confusion about the proposed route, and this has subsequently been clarified and does not involve the existing track.

Councillors’ Reports
Willie Robertson: There are problems with knowing when buses are due at the Park and Ride at Kinross, so Cllr Robertson is campaigning to get an interactive sign provided. We’ve already heard from Cllr Barnacle roadside drains can be changed to a type that do not make a noise when HGVs pass over them, but Cllr Robertson is now requesting this change to be made whenever the current type of drain is found to be broken everywhere.
Dave Cuthbert: The Kinross roadworks are finally due to finish at the end of September, and the road will be closed on the 3rd October, this time for a street party to celebrate the completion! Children’s rides and a performance by the Red Hot Chilli Pipers will be included.
Mike Barnacle: The speed sign by garage at Crook of Devon has been reported, but not yet fixed. Cllr Barnacle is pursuing a proposal to create a car park at Drummond Park, although local funding would have to be found.

Police report: no officer was able to attend. There were no reports of any crime in our area.

Minutes of the previous meeting: Minutes were amended: Mike Barnacle is not creating a car park in Drummond Park but is looking at wider parking issues and the impact of parking on the Main Street. After this amendment the minutes were signed off.

Matters Arising
Crook Moss Travellers’ Site: Sandy reported that are still problems with noise from some of the generators although some are now screened and put down the embankment. The travellers have complied with PKC’s request to put the generators down the bank. It is hoped that the site can sign up to mains electricity, which would address the noise issue. At the recent DMC meeting the following conditions were set: to complete the access road, address the noise and the landscaping/fencing within the next two months, and address the waste water within twelve months. One problem is that there seems to be conflicting information: the CC are told that the Drum waste water treatment has no spare capacity, while the Travellers are being promised they can connect to it soon.
Lambhill Chipping plant: Cllr Cuthbert explained that last month the review board had deferred a decision pending a site visit and further information being provided by the developer. A site visit is still not organised (despite requests dating back a year); the plant has stopped and the timber is being moved.
A977 Defects and Mitigation Measures: Cllr Barnacle reports that investigations are being made into whether the A977 should be re-trunked. Transport Scotland now says that the signage will not be amended, the A985/A9 are not the preferred routes north anymore. That added to the fact that sat-navs send the traffic up the A977 makes the A977 the busiest route for HGVs in Perth and Kinross. Re-trunking the road may result in some money from the Scottish Government for the upkeep and mitigation measures, as Perth and Kinross Council is not going to spend any money on this road.
CC Membership: A total of six nominations for the CC were received by the closing date for applications. Since there were fewer nominations than the maximum number of members allowed, the six nominees will become the members of the CC as per November. Sandy explained that in the absence of nominations being received by the closure date it is possible to co-opt other people on to the Community Council from May onwards.
Station Road Adoption: Cllr Barnacle reported that of the 15 residents, 13 are agreed to contribute and 2 will not contribute. The next step is to organise a residents’ meeting with road officers to determine whether this can move forward with 13 people agreed.
Boundary Commission: Cllr Cuthbert, who has done of lot of work on this, explained the implications of the proposal, and the flaws in the Boundary Commission’s analysis. The CC has submitted an objection and encourages everyone else to do so. Information on what to include can be found on Facebook or in the Kinross Newsletter. Comments can be lodged by letter or directly on the LGBC’s website at https://www.consultation.lgbc-scotland.gov.uk/node/31 and must be submitted by 22nd October. Ways on getting involved: Sign the petition (see Facebook), lobby the commission, send a letter of objection and tell others about this issue.

Powmill Bloom Group: Is continuing to thrive and has recently received a grant of £1500 from the Kinross-shire fund.
Crook Moss Community Involvement: Sandy reports that the Moss has now been acquired by a group who are sympathetic to the Community’s concerns and involvement. In the future we may look at ways of making the Moss more accessible; through walks, access for children etc.
Lambhill Forestry Site: Lynn Daley from the Forestry Commission attended the meeting and updated the community on the access situation with an available map. There are 4 access points. The Forestry Commission hopes to link the paths to the Core Path network. There were some questions from the public regarding access for horses and access close to the chipping plant. There is a distinction between industrial use (when the owner can deny access on health and safety grounds) and agricultural use, when access falls under the access legislation. Lynn proposed to set a day for a walkabout. This will be announced on Facebook.
A977 Roadside Drains: At the last meeting Cllr Robertson took an action to request clearing of these drains, since they are no longer cleaned on a routine basis. Kevin passed on Cllr Robertson’s report that they have now been cleaned.
Signage at Vicar’s Bridge Road: Last month a MoP noted that this road was only signed from one end. PKC has now requested a replacement.
Rumbling Bridge Hydro Scheme: Hugh Wallace gave an update. The work is to start very soon; there is a meeting on Thursday 15 October in Crook of Devon Village Hall for people interested taking out shares in the Hydro Scheme. See Facebook for latest news.

New Business
Farm Snow Ploughs: Kevin passed on Cllr Robertson’s report that this winter a farmer will not be able to use his snow plough, but the Council are going to deal with this problem.
Potholes in Craigend Road: Cllr Giacopazzi /Dave Cuthbert: from 26 October this road will be closed for two weeks to carry out maintenance.
Safer Route to School – Drum: A member of the public contacted the CC who would like a safer route for children to walk to school along the B9097. A request was made for a 40mph speed limit on the B9097 at the sewage works to slow the traffic and make it safer for children, for dog walkers, for walkers and cyclists to use the road and access Drum and the walk to the kennels. Cllr Barnacle reported that he would look into it; there may be a little budget for Safer Routes to School, and it could tie in with possible development proposals in Crook of Devon.
State of Road Through Drum and Missing Grit Bin: Kevin passed on Cllr Robertson’s report that he had contacted Stuart D’All about the condition of the road, and that the grit bin there was missing. No update yet.
Noise Problem from Solsgirth House Hotel: A MoP has contacted the CC about noise from evening events at Solsgirth House Hotel. Although they live in Clacks, the hotel is in P&K. PKC’s Environmental Health department are investigating. The residents and the owner/manager have met and the latter promised to take action, but has failed to do so. The managers/ duty managers do not seem to have a lot of control about the noise the wedding party makes. The marquee is not a licenced premise, but they get an occasional licence for functions. Cllr Giocapazzi is on the Licencing Board and will investigate. See also Planning below.

Meetings Attended: Trudy attended the meeting on the Boundary Commission’s proposals for Kinross-shire.

Councillors’ Reports
Dave Cuthbert: Street party in Kinross on 3 October was well attended. Feedback on the party of those at the meeting who attended was very positive.
Joe Giacopazzi: Nothing other than already described above.
Mike Barnacle: All the proposals for the Local Development Plan Report of Handling are submitted. We will need to see how well the comments after local consultations will be incorporated; many of the development sites put forward will not be needed at present. Also, at the next DMC the Shiehallion site near the Scout camp will come up. Possibly a proposal for a less densely developed site will find favour. However, there is the question of waste water and drainage: the Drum plant is full and connecting in the Crook of Devon plant (over the river) is less likely. Anything attached to the Drum plant is also deemed to be in the Loch leven catchment area. The report fails to address these issues.

Police report: No officer was able to attend. A report was received but it was very generic. We know of at least six incidents that were not mentioned. We are worried about this under reporting of crime. From the Commander’s Bulletins we have learned of a theft of oil from a tank in Rumbling Bridge. Also in our area: a car was damaged in Dunning Glen, there was a house breaking in Powmill, a sit-on mower was stolen from the Milkbar and a pick-up was stolen in the area and used for the attempted robbery at Sainsbury’s.

Presentation by SEPA
Colin Anderson of SEPA addressed the meeting, and explained the current situation at Crook Moss. SEPA has been out to inspect several times and found no evidence of the tipping of grey water. The water supply to the site is fairly restricted, so there is not much opportunity to produce grey water, it is a minimal amount in the grand scale of things. There are Portaloos onsite. SEPA has been looking for options for foul water: the CAR licences had been refused as the ground was unsuitable. Now an interim solution -building one toilet block connected to the sewer- is being investigated; while there is also a feasibility study in the pipeline for a more permanent solution. Scottish Water is not clear whether and how much capacity there is in the current Drum sewage system.

The CC is unhappy with the time it takes to find a solution; is worried by the lack of clarification given; it seems that PKC gives the CC and the Travellers community different information and Scottish Water is also not very clear in its reply to our questions. The CC is unhappy that double standards are used; when any development takes place in the LL Catchment area the rules are very strict. Sometimes it is not clear whether an application falls in the Drum or the Crook of Devon sewage system.

Mike Barnacle mentions the collective agreement between PKC, SEPA and SNH; a protocol for planning in the LL Catchment area. Allowing retrospective planning applications causes all kinds of problems. Joe Giacopazzi adds that PKC has to deal with 100 retrospective applications.

Powmill in Bloom
Has now been in operation for 6 months; so far that have received £3000 in grants. PKC will plant daffodils; Powmill in Bloom has 4 large and 2 small planters. MB suggests entry in the Best Kept Village Competition in 2016.

Rumbling Bridge Hydro Scheme
James Buchan from Local Energy Scotland (advising Rumbling Bridge Hydro Scheme) explained that this scheme has the obligation to offer community benefit of £10,000 per megawatt per year, because of having granted a loan with the Scottish Government. This would mean a minimum of £5,000 for the Fossoway and District community. FDCC could act as the recipient of this money (provided there are separate accounts) and with the help of a sub group with representatives from the whole community this money can be used for community projects. We are happy to enter into a contract with the Rumbling Bridge Hydro Scheme.

The CCllrs stayed behind after the meeting to agree on a few amendments to the contract with Hugh Wallace, the developer of the scheme.

Matters Arising
Crook Moss Travellers’ Site:
In addition to the discussion earlier, Joe Giacopazzi reported that he and Dave Cuthbert will make a site visit to the Crook Moss camp to see how the generators are baffled. Willie Robertson mentions that he now has the specs for baffling the generators and he will pass them on to our contact in the camp. The resident travellers are keen to improve the situation; at the moment it seems to be the transient residents who are causing noise problems.

Lambhill Chipping plant:
The Local Review Body meets on the 10th of November- the appeal will be heard then. Chipping has stopped.

A977 Defects and Mitigation Measures: Cllr Barnacle referred to a letter he has published in the Kinross Newsletter. Willie Robertson reported that Transport Scotland will soon commence a review of the Trunk road system; this may be the best moment to bring up re-trunking of the A977. A MoP mentions the poor state of the road in Blairingone, near the Vicar’s Bridge Road. Willie Robertson will take this up.

CC Membership: At the next meeting of this CC, Cllr Giacopazzi will initially chair the meeting until the new CC chair is selected. Then the new chair will take over the meeting and the remaining officers will take up their roles. Since the CC is allowed to have a further two members, there is an opportunity for any other interested persons to be co-opted onto the CC in six months’ time.

Station Road Adoption: Cllr Barnacle reported that after meeting the residents there is a shortfall of around £650 plus VAT, he is looking at ways of securing that money so the adoption can go ahead.

Boundary Commission: The CC’s objection to the proposed changes has been acknowledged. Cllr Cuthbert was commended for his work. There have been many representations from the length and the breath of Kinross-shire. However, the Boundary Commission intends to stick to the original timetable so we can only hope that they will take all the comments into account.

Lambhill Forestry Site: Kevin reports that there will be a Ranger-led walkabout on the 21st November from 11am to 1pm, meet at the corner of the A977 and the Cycle path. This walkabout is to see how the site can be used and accessed.

Signage at Vicar’s Bridge Road: Cllr Barnacle reported that this has been requested.

Potholes in Craigend Road: This work is now taking place.

Safer Route to School – Drum: A request to bring down the speed limit on the B9077 between the junction with the A977 and Drum has been received. Cllr Barnacle reported that Darren McKeown suggested a meeting in the framework of the School Travel Planning programme.

State of Road Through Drum and Missing Grit Bin: Cllr Robertson’s had previously contacted Stuart D’All about the condition of the road, and that the grit bin there was missing. However, there is no budget for road repairs this financial year, there are no resources to refill the bins in bad weather. The CC found this strange. Also, big lorries cannot use this road but still try. Mike Barnacle will take this up.

Noise Problem from Solsgirth House Hotel: Cllr Giacopazzi reported that there is pressure on the Solsgirth House Hotel to apply for a permanent licence. The CC has withdrawn the objection to the planning application if a condition to abate the noise issue is included in the report of handling. Alastair reported that the application has been approved with conditions.

This may be an opportunity to keep the issue about the landscape status of the Devon Gorge alive. MB has also written to residents on the Main Street, Crook of Devon, about parking on the Main Street and the access to the shop/ post office. MB will also write to BT who, yet again, dug up the road in Crook of Devon without any prior notification or consultation.

Willie Robertson: Has written to City Link and all the MSPs. The buses between Edinburgh and the North stopping at Kinross are being cut back substantially, with no direct buses to Edinburgh between 4 and 7pm.

Following the appointment of the new Community Council members in November, it was necessary to hold an EGM. Cllr Barnacle took the chair of the EGM, in the absence of Cllr Giacopazzi, to elect the officers of the new Council as follows:

Cllr Barnacle then handed the chair over to Trudy and the normal meeting commenced. After the meeting was over, it was discovered that we had not followed the official process for the EGM, and had omitted some items. These will be covered in a brief EGM before the start of the next normal CC meeting.

Declarations of Interest: None.
Police report: The CC had contacted Sgt Nicholson, stating that the police reports that submitted don’t always cover local crimes. This was apparently due to the officer being new to the job and not knowing exactly what was required. Sergeant Sam Greshon attended this meeting and a report had been received, covering the two crimes in our area that we knew about from the weekly Commander’s reports: Housebreaking in Naemoor Road Crook of Devon (17th November) and Mill Gardens, Powmill (5th November). Sgt Greshon told the meeting that these are under enquiry. The community is concerned that there seems to be an upsurge in rural crimes in this area, hopefully more patrols can be provided. There will be a police drop-in day at Kinross Police Station between 2pm and 7pm on Friday 4th December where any local concerns can be discussed. Cllr Barnacle has reported another instance of fly-tipping at on the Carnbo end of the Gelvan Road. The officer said she would report it.

Matters Arising
Crook Moss Travellers’ Site: Works are being carried out at the site entrance, hedges planted and other landscaping, in order to comply with one of the planning conditions. Cllrs Cuthbert and Giacopazzi have been trying to arrange a site visit with Jim Valentine. Drum residents are still reporting that there is a noise issue. Cllr Barnacle has received a letter from Scottish Water confirming that a “growth project” is required to trigger an increase in the capacity of the Drum sewage system, and this will not take place for at least two and half years. Consequently it will be impossible for the residents to meet the planning target of achieving a drainage connection within a year.
Rumbling Bridge Hydro Scheme: An agreement has been signed between the developers and this CC to define the Community Benefit that will be made available once the scheme is operational. At that time, the CC will set up another bank account, and a committee consisting of some CC members and members of other local community groups, to decide on how the benefit is to be used. There was a problem signing the agreement as the date for signing was during the period when the Community Council had not been reinstated after the elections.
Lambhill Chipping plant: The Appeal was not heard at the Local Review Body meeting on the 10th of November, it may be heard at the 8th December meeting. Meanwhile twelve of the most affected residents have written to PKC to reiterate their concerns.
A977 Defects and Mitigation Measures: Cllr Barnacle is sceptical about whether the government will agree to the re-trunking, but pressure continues.
Station Road Adoption: Cllr Barnacle reported that the funding gap has now been met by the Village Hall, and assuming that all participants meet their agreed commitments, then the adoption will take place, hopefully next spring. Cllr Barnacle will now hand over the continuing responsibility for the project to the Village Hall committee.
Lambhill Forestry Site: There was a Ranger-led walkabout on the 21st November, which was well attended and informative, showing the various access points into the site.
Signage at Vicar’s Bridge Road: Cllr Barnacle reports that it’s been ordered.
Potholes in Craigend Road: KB reported that this work is now taking place, and the fly-tipped asbestos has been removed.
Safer Route to School – Drum: Cllr Barnacle and KB met with Darren McKeown of PKC’s Roads Department. They discussed moving/adding the 30/40mph speed limit on the B9097 further out to beyond the road into Drum, and also possibly extending the footpath. There is a new initiative, due in January, to implement 20mph speed limits through the villages of Crook, Powmill and Blairingone. As well as the immediate effect in the villages, this might send a message to road users that the A977 is not a road that provides a quick route across country.
State of Road Through Drum and Missing Grit Bin: We have received a response from PKC to say that there is no budget to provide new grit bins, and only existing ones are filled.
Landscape Areas – Kinross-shire: The consultants, who did the study for PKC’s Landscape areas, are currently doing the same exercise for Clacks. There is also an opportunity to ask for change in a meeting in January. Cllr Barnacle will provide details when available.

New Business
Scottish Government Planning Review:
This review of the planning process seems to be being hurried through with little, if any, community involvement. Kinross-shire Civic Trust have sent a strongly worded letter to the Scottish Government pointing out that there was hardly any time to respond, especially at this time when all the CCs are being reformed. The review was announced in mid-October with formal evidence required by 1st December. Additionally the review body consists of only three members. This CC supports the views expressed by the trust.

Community Council Business
Meetings Attended:
GK attended an inaugural meeting where the creation of a Community Sport Hub was proposed by Kirsteen Ross, PKC’s Community Sport Hub Officer. This would be an opportunity for various sports clubs, or any person or organisation interested in sport, to combine their resources and possibly enable the clubs to get cheaper lets, access facilities, obtain grants, organise community transport, etc., by acting together. It would also help to widen participation in sport by the general public. The attendees were positive about this idea, and so a meeting will be held on 14th January to formalise the setting up of the hub. A £200 grant is available from PKC to cover start-up expenses. GK will attend the next meeting with a view to taking an active part.
KB attended the meeting about Drum speed limits as described above.

Councillors’ Reports
Mike Barnacle: Cllr Barnacle has written to City Link about the cut in inter-city services between Perth and Edinburgh due to commercial pressures. The Scottish Government should be supporting these services which connect the Park and Ride car parks to the cities.
Cllr Barnacle has managed to find the owners of Ivy Cottage, and let them know that the Community is concerned about the state of the building.
The Council has discussed the Main Issues Report, and three amendments were passed: The policy on Gypsy Traveller sites has been amended to ensure adequate separation from other developments in the absence of a grid connection, i.e., when generators would be used; There will be a report on infrastructure development in the MIR; There was to be no development in Kinross-shire other than Blairingone, but a development in Crook has been added as an option for community consultation, which would mean changing the settlement boundary.

The Demand Responsive Transport system (DRT1), which enables people to book taxis for approximately the cost of a bus fare, has been extended to a wider area. The scheme operates from 7am to 10pm Monday to Saturday and is available between any two points in the service area, or between the service area and Dollar, Kinross and Milnathort. As mentioned in last month’s minutes we omitted some agenda items from the EGM, so another one was held before the start of the normal meeting:
Election of Vice Chair: Richard Nesbitt; Proposed: Trudy Duffy; Seconded: Graham Pye.
The Constitution, Standing Orders and Code of Conduct were adopted.
The treasurer gave a brief financial statement: The current balance is £148.10.
Dates of the meetings for the rest of the year are as follows: 2nd February, 1st March, 5th April, 3rd May (AGM), 7th June.
There were no outstanding training issues.
This concluded the EGM, and the normal meeting followed.

Police report: Sgt Hughes and PC Sturgess attended the meeting. No report had been received by the time of the meeting, although the officers present had a copy of the report and will email it. Recent crimes in our area include the theft of a money box from Crook of Devon, for which a suspect has been arrested. The CC complimented the Police force for their increased presence, especially on the A977, during the Forth Road Bridge (FRB) closure and for their management of the resulting increased traffic. The increased presence will continue during the restriction of HGVs over the FRB. MoP asked if the Kinross Police station was still open – yes, it is still in use by officers 24/7, although there is no longer a constantly manned public desk. KB had asked for his concern about the number of incidents (at least 12) in Kinross-shire in the last few months, PC Sturgess pointed out that the majority of these incidents were not in our immediate area, which continues to be fairly safe. It’s not clear why the number of thefts is increasing, but the Police will continue to maintain vigilance, including night patrols, within the limits of their available resources. MoP asked if there had been any increase in accidents during the FRB closure – the three incidents known to the Police all involved drivers who would have been using that route anyway, but possibly the increased traffic resulted in more congestion during the handling of the events which made them more obvious.

Matters Arising
Crook Moss Travellers’ Site: Councillor Giacopazzi noted that the review of the compliance with the 2012 permission will be at the DMC meeting next week. The paper to be presented at that meeting reports that all generators have now been fitted with acoustic housings, and there are no new noise complaints; SSE are working on an electricity supply and discussions continue with Scottish Water on how to address the drainage issue. Councillor Barnacle reported a conversation with Nick Bryan who said that there was currently an enforcement notice in place, but it was not clear which condition this applied to. Councillor Barnacle also pointed out the inconsistency in the current planning application (see below) in which Neighbour Notifications had been made to six addresses on the site, even though the existing consent only allows five.
Rumbling Bridge Hydro Scheme: Work has started, but is held up by the weather.
Lambhill Chipping plant: At the 8th December meeting of the Local Review Body (LRB) it was decided that the Appeal would not be decided until the applicant had attended and made a presentation. The LRB will inform the applicant what they wish to be covered in this presentation. A MoP stated that it seemed only fair that local residents should also have a chance to make such a presentation, and Councillor Barnacle has contacted the LRB convenor with the same request. The LRB are being scrupulous in ensuring that there is no bias in their deliberations by not allowing any local councillors to sit on the LRB, and the Convenor, who has declared an interest in this application, is handing over the chair to another councillor during this appeal’s review.
A977 Defects and Mitigation Measures: Cllr Barnacle notes that progress towards re-trunking will be a very long process. Once the FRB is fully re-opened, PKC Roads department should check for any damage to the A977 as a result of the increased traffic during the diversion, and apply to the Scottish Government for funding to repair it.
Community Sport Hub: GK will attend the next meeting on 14th January.
Cuts in Inter-City Bus Services: Cllr Giacopazzi reports that there is to be a new X56 service leaving Edinburgh about 5pm to carry commuters back to Kinross.
Station Road Adoption: Cllr Barnacle wrote to all the residents on 17th December; he reported that the funding gap of £800 has now been met by the Village Hall Committee, who have set up a sub-committee to take the adoption forward. The first event to raise the funds will be a Burn’s Night Supper on the 5th February.
Landscape Areas – Kinross-shire: There is an opportunity to ask for change in a meeting this month.

New Business
Emergency Support Centre: During the FRB closure, the CC was asked if they would help set up a centre to receive people stranded as a result of accident or bad weather. Several of the CC members have agreed to be contacts and a request has been made to use the Village Hall, although we have not yet had a response from the Committee.
Waymarking of Core Paths in Blairingone: Consultation documents have been sent out to affected parties. It appears that the proposed signs are acceptable.
Broomhill Cottage to Aldie Road Multi-Use Path: George Lawrie was present at the meeting and reported that a contractor has been appointed and work on this path will start shortly. The surface will now be tarmac, and the existing railway ballast will be re-used for the path founds meaning that only tarmac will need to be brought in. Self-closing gates will be installed at each end of the path. Over the next three years, the path will be extended to Kinross. George recommended that the CC should consider setting up a “Paths Group” to help maintain existing paths and champion the creation of new paths – similar groups have been very successful in other CC areas.
LDP2 MIR Consultation: The Main Issues Report (MIR) has recently been published. This document contains proposed variations to the Local Development Plan (LDP) which defines where, and how, development can take place in Perth and Kinross-shire. Comments on the MIR must be made before the 16th March, preferably on the form obtainable at http://www.pkc.gov.uk/mainissuesldp2. There will be consultation events at LLC on Saturday 16th January from 11am to 3pm and Tuesday 23rd February from 3pm to 8pm. Main items of interest in this area are: Proposals to review infrastructure (roads, sewage provision, etc.); Additional development site at Crook of Devon (to get community benefit to provide roundabout and to trigger Sewage plant expansion); Development proposals in Blairingone (to elicit community comment).
Road Closure Fossoway School: The road will be closed to allow works by BT from 11th to 25th January.

Councillors’ Reports
Mike Barnacle: A constituent has approached Cllr Barnacle to request a traffic direction priority sign on the bridge at Naemoor Road. It’s possible that some works to the A977 in Blairingone will be in this year’s budget.
Joe Giacopazzi: Cllr Giacopazzi is attending a meeting with the Scottish government planning department next week, and will raise the issue that the current rules for neighbour notification of 20m radius rather than the old rule of adjacent landowners don’t seem to be working.

Planning Matters
15/01971/FLL Erection of stables at Kingswood, Drum, Kinross, KY13 0UN. No Community Council comment.
15/02078/FLL Change of use from paddock to form 3no gypsy/traveller pitches and erection of a fence (in retrospect) at Crook Moss, Fossoway. Object due to insufficient capacity in sewage system and noise pollution.
15/01997/FLL Erection of a dwelling house at land at Blashieburn, Vicar's Bridge Road, Blairingone.
Comments for this application were due by the 21st December, but the CC obtained an extension until the 8th January. However, the applicant submitted a revised block plan on the 5th which seems to be a material change to the application. Substantial local objection to this development was voiced at the meeting. Cllr Giacopazzi said he would speak to Nick Bryan on the 6th to clarify whether there would now be a further opportunity for public comment, and indeed whether the application needed to be resubmitted. The CC will decide on its position once these matters have been clarified. Cllr Barnacle pointed out that the proposed changes to the Blairingone settlement boundary in the MIR would have a bearing on this application.

Correspondence: All the correspondence was available for viewing: Tracy Ramsay of PKC has sent extensive details of funding opportunities for local groups; the annual “Better Place to Live” fair will take place at LLC on 5th March from 10am to 2pm.
AOCB: When will the Rumbling Bridge car Park be ready for use? Cllr Barnacle explained that the responsibility for constructing this has passed from Thomson to another developer, but that the Planning Department are comfortable with this arrangement and expect the work to be completed in due course.
It appears that the work on the Kinross roundabout has been suspended during the FRB diversion.
Some time ago it was suggested that road signs could be cleaned by the Unpaid Work Team, but this was ruled out for H&S reasons. However, the signs are still not getting cleaned and this is becoming a serious problem. Are PKC going to do it? Cllr Giacopazzi explained that this is one of many services that are no longer financed.
Water is coming off the Tom Thumb road in Carnbo presenting a possible road hazard were it to freeze. Cllr Giacopazzi will investigate.

Police report: No report received – we have received an email from Police, to say that the previous author of monthly reports is no longer with the force, but the officers will still try and attend where possible. No officers were present at this meeting.
KB has reviewed the Commander’s Reports and P&K Community Watch alerts and there are still a number of offences being committed in this area, however there has been an arrest of three people. Cllr Barnacle points out that not all crimes that we know about are included in the Commander’s Reports.

Matters Arising
Crook Moss Travellers’ Site: Cllr Cuthbert reports that the review of the conformance to the previous planning conditions was discussed at the DMC – a further report will be brought back in three months after Scottish Water have studied whether the Drum processing plant has capacity to connect this site. Cllr Barnacle added that he has recorded his objection to the soundness of the current policy on Gypsy/Traveller sites.
Lambhill Chipping plant: There is as yet, no date for the proposed hearing agreed at the 8th December meeting of the LRB, although the three councillors to sit at the hearing have been chosen.
A977 Defects and Mitigation Measures: TD notes that the number of potholes on the road is increasing rapidly. Cllr Barnacle has suggested to PKC that they should approach Scottish Government to fund work required as a result of the FRB diversion. Cllr Cuthbert notes that the Scottish Government are paying for additional winter treatment during the diversion. Cllr Giacopazzi reminds us all that road problems (including potholes) can be reported to CLARENCE (the road report hotline) on 0800 232323 between 8am and 6pm.
Station Road Adoption: Cllr Barnacle reports that this is currently held up pending a surface water investigation.
Emergency Support Centre: GK who is now on the Village Hall Committee reported that the Committee wanted further information about the requirements for this scheme. KB requested this information from PKC and has forwarded it to GK for the Committee to study. Even though the FRB diversion is now almost over, it’s still worthwhile putting the basic arrangements for such a scheme in place.
Setting up of Paths Group: Call for interested parties to help set-up such a group – money and training is available.

Community Council Grant:
GP reports that due to an administrative error by PKC, our annual grant was paid into the wrong bank account. The bank has been asked to retrieve the money and return it to us; this is in progress but has not yet been completed.

Community Council Business
Meetings Attended:** GK attended a meeting of the Community Sport Hub on 14th January – A disappointingly small number of organisations attended. The catchment area of the hub was agreed to be the same as that for the High School. Terms of reference were also agreed. It was noted that the Management Group should ideally be made up of people actively involved in sports.

Councillors’ Reports
Mike Barnacle: Some budget has been made available by the Scottish Government to address damage due to flooding, especially for farmers rebuilding flood barriers. Cllr Barnacle received a reply from Open Reach explaining why roads are dug up without warning – this is because it’s not possible to predict whether underground ducts are blocked until attempts are actually made to pass new fibre optics cables through them. Cllr Barnacle’s attempts to re-add the AGLVs which were not included in the new landscape designation have failed. A further opportunity will be available in September when the LDP comes up for further comment.
Dave Cuthbert: PKC Budget discussions are in full swing. There is a great amount of confusion about the size and distribution of funding.
Joe Giacopazzi: Attended the Scottish Government’s Planning Conference. There was general agreement amongst attendees that the current rules on neighbour notification need to be widened, and that the charges for planning applications need to be substantially raised to come closer to covering their cost.

KB contacted the Scouts who have addressed the problem. The CC has received a briefing note from David Blundell about the Scotland Bill.

AOCB:
MoP commented that a litter bin has been placed by the westbound bus stop in Powmill, it would be more sensible for it to be by the eastbound stop which is much more extensively used. Cllr Cuthbert will look into this.
The CC’s secretary, Kevin Borthwick, needs to reduce his involvement for the next few months due to family commitments. Consequently his secretarial duties will be shared amongst the other CCllrs. Police report: No report received. PC Stapleton was due to attend. The PK Community Watch system reported that there was a break-in at a property between Crook of Devon and Cardenden (probably actually Carden) on 24th February.

Matters Arising
Crook Moss Travellers’ Site: The DMC will receive an updated report next month. Scottish Water are currently conducting a flow and load survey to assess the capacity of the Drum processing plant.
Lambhill Chipping plant: The hearing agreed at the 8th December meeting of the LRB, was held today (1st March.) John Anderson reported that the hearing took four hours and after extensive discussion the LRB decided unanimously to uphold the original decision, i.e. to turn down the application.
A977 Defects and Mitigation Measures: With the re-opening of the FRB, the HGV traffic on the A977 has now reduced. Local Councillors have held a meeting with PKC Roads department, and a business case will be prepared to implement mitigation measures in a phased way. Example measures in the first phase would include 40mph speed limits, speed indicating signs, more obvious road furniture to indicate village entries and side mounted drains. The CC has received an email from Jim Pritchard of the Fossoway School Parent Council asking whether mitigation measures could be implemented on the A977 in order to improve the safety of children going to and from the school. The CC will write to the Chief Executive to seek a review of the Safer Routes to School programme. Cllr Giacopazzi has had a meeting with the MD of Tayside Contracts (road contractors) who has assured him that potholes are being repaired properly, although there were widely held opinions by those present that this is commonly not the case. Currently there are 6014 potholes being repaired and efforts are being made to catch up on the backlog. Road problems (including potholes) should be reported to CLARENCE (the road report hotline) on 0800 232323.
Emergency Support Centre: CCllr Kilby reports that the Hall Committee has this on the agenda for their next meeting.
LDP2 MIR Consultation: The Main Issues Report (MIR) has recently been published. Boundary Commission: Awaiting their decision after our comments. The decision will be announced at the end of May, i.e. after the Scottish election, so it is important to ascertain the position of all candidates on this issue as the Scottish Government has the final decision.
Community Council Grant: Cllr Pye reports that the bank has not yet been able to retrieve the money, but have sent a reminder to the incorrect recipient. Next step is to ask PKC to resolve.
Ivy Cottage Powmill: Owner has been identified, and they are due to propose a plan this month. The property is in imminent danger of collapse.

Mike Barnacle: PKC Roads are investigating whether the Naemoor road bridge could get signs indicating that traffic from one direction has priority.
Dave Cuthbert: Is attending a Property sub-committee meeting discussing the disposal of an old school building in Scone, which appears to be being handled in a different way from the old Kinross High school site.
Could Crook of Devon football pitches be developed? Local teams are developing pitches in Milnathort instead.
Powmill in Bloom are doing a great job, are there similar groups for Crook of Devon or Blairingone, if not, why not? Could someone be found to lead them?
Joe Giacopazzi: Has asked Darryl McEwan to look at signposting the bends by Hillside farm on A91 where there have been several accidents.
DMC allowed the development of the bungalow in Vicars Bridge Road in Blairingone as there were no planning grounds for rejection, however there continues to be local difficulties on this site.
Willie Robertson: Citylink Buses are about to publish their summer timetable. Cllr Robertson has written to Citylink asking them to reverse the changes made to their timetable which reduced the number of stops at Kinross P&R.
PKC’s Education budget for the next year includes reduction in “back room staff”, which will probably mean that teachers have less time to actually teach.
