Community Policing: Community police officer (PC Riches) was not present, but sent a report – there are no incidents to report in this area. Speed checks continue to be made on major routes. PC Douglas Stapleton will be the Community Police Officer for the next three months.

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
• Blairingone War Memorial: Alastair reports this is still on-going.
• Crook of Devon Church Car Park: The Church is now progressing this.
• Signposting Core Paths and Rights of Way: Cllrs Barnacle, Cuthbert and Giacopazzi were not present to give feedback on this.
• Lambhill Wood Chip Plant at Blairingone: Calum Snowie will not be presenting to this meeting and will let us know when he will attend. SEPA have strongly objected to the application because run-off from building waste stored on concrete hard standing might contaminate water courses – this objection was not known about by the Planner. Cllr Robertson will write to the Planner to ensure he is aware of the SEPA objection. Gordon Banks MP had written to PKC asking for an update, PKC’s response included the information that the decision on whether an application was major or not could only be based on the area measurements provided by the developer. Also that the application will be handled under delegated powers due to insufficient objections and that part of the application will be treated as retrospective. The CC will send their objection to the Planners again, and reinforce the noise issue.
• Travellers’ Site at Crook Moss, Crook of Devon: Sandy reports that Phase 2 responses have been received to both complaints. Two of the objections have been upheld regarding incorrect information in the Planner’s Report and the next version of the Report will be updated to include the missing information, “the omissions will be flagged to insure that councillors are made aware of these errors”. There was considerable discussion on this item and those present reiterated their concerns regarding the department and the way the matter had been handled. The CC have decided not to elevate the complaint to the Ombudsman, but have arranged a meeting with David Littlejohn on 17th January to discuss the Community’s concerns regarding his department, and to try and develop a better relationship between the CC and the Planning Department.
• GlenQuey Quarry: Alastair reports that the CC received a letter asking for comments on the traffic implications, although the quarry itself is not in this CC’s area. The letter contained figures from a new traffic count taken on the road where the quarry access road would join it. The CC repeated its objections that the 80 heavy (20 tonne) lorry movements per day (figures provided by the developer) would impose an unacceptable load on the surrounding roads and bridges. The application is expected to come before the April Planning Meeting. Cllr Robertson will write to the Council asking for a traffic impact analysis before the Application is discussed. There was significant discussion on this item, particularly on access to the M90 going south.
• Crook of Devon water supply: The CC received several complaints about the quality of water. Kevin reports that a notice agreed with Scottish Water was put in the Crook of Devon notice board and the shop. Several residents contacted Scottish Water and the situation has now improved.

CC Business: A Special CC meeting was held to consider the Local Development Plan, from which several items have been submitted to the PKC councillors to be brought up at the full council meeting where the plan will be discussed: Strategic Planning does not address land for Employment, Education requirements, Transport infrastructure, Areas of Great Landscape Value. Emphasis should be made on using brownfield sites in preference to greenfield.

PKC Councillors’ reports:
Cllr W Robertson: Local councillors will be meeting to review submissions about the LDP and agree amendments to the plan to be submitted to the Council meeting on the 23rd of this month.
Scottish Government are encouraging the use of Gallic, and PKC will invest money, some from the Scottish Government and the rest from PKC, in providing Gallic on the website, road signs, responses to letters, etc.
Later this month PKC will publish a paper on “Green Roads” (roads made more suitable for cyclist, pedestrians and horses) regrettably the U222 will not be included because there is not deemed to be enough heavy traffic on it, and there won’t even be a weight limit. Cllr Robertson plans to propose an amendment to include the U222. It would help if the CC wrote to Gillian Robinson to support this, mentioning that heavy Lorries do use this route and a weight limit would be a sensible alternative.

Planning: No applications this month.

AOCB:
A977 Blairingone road closure (for two weeks) has been postponed to 11th March. The closure of the B9097 has been cancelled for the foreseeable future.
The details of the River Devon poisoning that happened 18 months ago has not yet been reported, possibly because legal proceeding are still outstanding. The CC will ask SEPA for information.
The Carnbo phone box has now been removed and the pavement reinstated, but not levelled properly, creating a trip hazard and a water trap. Discussions are taking place between PKC and BT over the financial responsibility before this can be fixed.

What is it?
• Choose from either a 6km (3.7miles) or 11km (6.8 miles) sponsored walk
along the stunning Heritage Trail around Loch Leven National
Nature Reserve.
• The routes start and finish at the Boathouse Bistro in Kinross. Both routes
are along well-maintained, traffic free footpaths. The walks are
signposted, with fantastic views, and there will be event marshalls to
cheer you along.
• Walkers can sign in and start their walk at any time between 10am and
11.30am. Every walker will receive a certificate and medal.
• The walk is suitable for walkers of all ages and fitness levels. Wheelchair
users, buggies, groups and well-behaved dogs (and owners) are all very

Community Policing: Community police officer (PC Douglas Stapleton) was not present, but sent a report – Theft of pedal cycle under enquiry, thefts from outbuildings in particular plant and diesel, also theft of a quad bike. Speed checks carried out at Drum.

Matters arising:
• Blairingone War Memorial: Alastair reports this is still on-going.
• Crook of Devon Church Car Park: The Church is now progressing this.
• Signposting Core Paths and Rights of Way: Cllrs Cuthbert and Giacopazzi were not present, so no information about this at present.
• Lambhill Wood Chip Plant at Blairingone: Alastair asked PKC planning about the two applications being separate, but although they acknowledged the letter they didn’t answer the question. Local residents have been approaching MPs, MSPs and others who have supported their objection. There is currently no date for the applications to be determined.
• Travellers’ Site at Crook Moss, Crook of Devon: Kevin reports that a meeting was held between the CC and the Planners (David Littlejohn and Nick Brian) following the upholding of the CC’s complaints. Several current applications were discussed, with the aim of improving the CC’s relationship with the planning department in the future. Cllr Barnacle notes that the decision was deferred in August 2012 to allow the applicant to provide further information that has not yet been received; meanwhile the applicants are still on site without planning permission. A local resident has asked the Council if they can force the applicant to connect to mains electricity to reduce noise from generators, but was told this could not be enforced.
• Glenquey Quarry: Alastair reports that the CC has submitted information about the traffic impact of this development, which has received a standard acknowledgement. No date yet for determination.
• Crook of Devon water supply: Kevin notes that the CC has received a copy of an email from a resident to Scottish Water reporting that the water was cloudy. The resident was informed that the CC had success with our previous complaints to Scottish Water by collecting similar complaints from other residents.
• Glendevon Pollution Incident: Last summer an unannounced pollution event occurred – SEPA responded that the incident was in the hands of the Procurator Fiscal so no information could be given at the moment.
• B9097: Resurfacing work now scheduled for 18th March for two weeks. Sandy and Cllr Barnacle have communicated with PKC to suggest that better diversion signs and physical barriers be used.

CC Business: Green Routes: Sandy and Kevin met with Brian Cargill of PKC Roads Department with a view to extending the scheme to include the loop road. PKC said that their seven day traffic survey showed only ten heavy goods vehicles per day, with a few lighter goods vehicles and the majority being light vehicles, but they would look at it again. Cllr Barnacle added that the majority of the proposals are good; however the U222 has not been included in its entirety and asked for it to be reconsidered. This is currently a pilot scheme, and if it is successful then it might well be extended in the future. Cllr Robertson has contacted PKC Roads regarding TRACKS applying for funding for a Kinross to Crook of Devon cycling route.

Kevin reports on a focus group Sandy attended concerning Police and Fire reorganisation where it was stressed that there will be no diminution of existing services. There will be three Police hubs in Perth and Kinross, and an unchanged number of Police Officers in the community, with three year placements of officers to ensure continuity and help develop relationships.

PKC Councillors’ reports:
Cllr M Barnacle: Power cuts in this area – complaint sent to Scottish Power who will investigate. Kevin notes that this has been previously attributed to geese flocks hitting power lines.
Grass verge cutting – Budget discussions currently in progress, Roads seem to have agreed that even if all verges can’t be cut twice, at least areas around junctions should be.
The Councillors had a special meeting for a major debate on the proposed Local Plan on the 23rd January, even though 1500 representations had been made to the original plan it had been proposed to be passed without change. Seventeen amendments were discussed, ten affecting Kinrosshire which were all accepted except one. Motions affecting Fossoway include: Safeguarding disused railway lines to be reinstated or turned into Core Paths; Blairingone to have zoned housing plan in accordance with CC and resident comments; Blairingone to have mitigation measures on A977; Powmill – master plan will include the whole village.

Declarations of interest: None

Community Policing: PC Sadie Allan reported a rise in rural thefts, mostly quad bikes, farm equipment and fuel oil. There is now an action plan “Operation Purvis” to address the problem. Vigilance is called for and any information should be given to police.
The non-emergency number to contact the police is 101
The CC asked for feedback on the Community Speed Check operation. Other community groups were interested to pursue it if it had been a success.

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Outh Muir Wind Farm: Tom Wood, Community Liaison Officer, gave a talk about the proposed Wind Farm on Outh Muir. An application has not been lodged yet, but he is inviting a member of the CC to join the group in order to feed back information to the community. This will enable them to be aware of local issues, such as noise impact, visual impact, flora, aircraft, birds, and water course impact. Also the community benefit aspect. The 6 turbines proposed are 115m tall and will be seen across a large area. Public meetings planned are 18th March, Saline, 19th March Oakley, and possibly Knockhill on 20th March. Next Committee meeting 18th March 7:15pm at Knockhill.

Matters arising:
• Blairingone War Memorial: Nothing further to report.
• Crook of Devon Church Car Park: Nothing further to report. Subsequent meeting at which church requested support for funding applications. Sandy agreed that the Community Council would assist if possible.
• Signposting Core Paths and Rights of Way: Dave Stubbs gave the details of signage proposals in the area. The plan is ready to go ahead and he is consulting with local farmers/land owners, in order to get the way-markers in the best position and with the correct information. There was considerable discussion on this item. Farmers are concerned about paths going through land containing vulnerable/dangerous livestock at certain times of the year, ie. lambing, calving etc. Signage to warn dog owners in particular was considered to be important, with particular signage stressing the dangers at calving time, indicating the months that this would apply. There was also concern about the amount of signage on particular routes, and Mr. Stubbs said he would consult with the affected landowners. Core Paths in Blairingone and Carnbo are to follow in future years. The CC thanked Mr. Stubbs for attending the meeting to assist in the discussion.
• Lambhill Wood Chip Plant at Blairingone: Awaiting feedback. Alastair would write again to PKC.
• Travellers’ Site at Crook Moss, Crook of Devon: A generator has been relocated and the noise from it has abated. Environmental officers from PKC said that there should be a condition that the site was connected to mains electricity. However PKC legal dept. had advised that this was not enforceable. The legal basis on this condition had been queried, and a response from PKC legal dept, stated that they could not discuss the basis of the advice as it was covered by legal privilege. The CC proposed to challenge this interpretation.
• There is still no answer as to why the site is needed considering the local, and surrounding, area has the largest concentration of sites in Scotland.
• Glenquey Quarry: nothing further to report.
• Crook of Devon water supply: no further complaints so the matter is to be dropped.
• Glendevon Pollution Incident: Nothing further to report.
• B9097: Resurfacing work now scheduled for 18th March for two weeks. A977 in Blairingone, re-scheduled to 22nd to 29th April.

CC Business:

Green Routes: We had been notified that the loop- road green route has been extended to the old road leading to the back Crook. At the meeting Cllr. Giacopazzi advised that this had been extended to cover the whole of the U222 at the meeting considering green routes. The CC thanked Cllr Giacopazzi for his efforts in having the route extended. It was pointed out by members of the public that the widening of the footpath along the A977 between Powmill and Rumbling Bridge meant that there would be no barrier between the footpath and the A977 (a very busy road), which would increase the danger to children walking and cycling. The CC supported this view and asked the PKC councillors to take the point up.

T in the Park: Kevin and Trudy attended a meeting about T in the Park. There were few points raised as it had all gone well last year. However, there were concerns about amplified music in the camp site being allowed until 2am.

CPKCC: Kevin had attended a CPKCC meeting. There were only 3 people present so there was no quorum.
It was recommended by those present that the CC organised a quorum in order to close the organisation through lack of interest.

Local Development Plan Stakeholder Evaluation: Alastair attended a meeting to discuss the Local Development Plan Stakeholder Evaluation. The aim was to improve the consultation on the Local Development Plan when it comes up for review in 5 years time, with a new plan in 10 years. PKC were first to submit their plan to the Scottish Government, which would take around 6 months to process. After much consultation, it is felt that we have ended up with much of what we wanted. There is to be a zoned site for houses in Blairingone.

PKC Councillors’ reports:

Cllr W Robertson: Willie reported that budget cuts were inevitable, resulting in less grass cutting etc. The Council were seeking to achieve a surplus to avoid future cuts and to keep money for staff severance pay when reducing the service.

Cllr D Cuthbert: Dave reported that he had a meeting with local residents on the Muirhead Stables road to the Fife border in Blairingone. Progress was being made and 2 passing places were to be provided by P&K. It was acknowledged that the 3 passing places already provided were too small.

Cllr M Barnacle: Mike has asked for a meeting with J Valentine to deal with the A977 mitigation measures. He also commented that 45 minutes given in Council to discuss the region’s budget was insufficient. He also feels that the representations about the Local Plan were ignored.

AOCB: The snack bar at Powmill was discussed and the CC agreed to email Cllr. Barnacle and say, as a result of the planning decision, there was now a considerable amount of litter and parking of vehicles causing obstruction. In addition it would appear that this additional temporary facility had precipitated the closure of the village shop, which was the only amenity in the village.
A member of the public raised the matter of signage at Gartwhinzean Loan which he had taken up with the council in 2011 but no action had been taken. The CC would follow this up. Also the state of the hotel site, and redundant signage was an eyesore and the CC was requested to ask Mr. K Thompson to take some action.

Community Policing: No officer present this month, however report received after the meeting: Warning of bogus workmen in area; Theft of batteries from temporary traffic lights at Powmill under enquiry; Speed checks continue at Rumbling Bridge. Note that the new non-emergency number (101) to contact the police, mentioned last month, is subject to a 15p flat rate charge from any phone (land line or mobile.)

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
• Outh Muir Wind Farm: John Anderson reported that the liaison meeting covered the risk to private water supplies from the works, although the hydrologist assured residents it would be safe. Proposed turbine numbers down from eight to five and reduced to 110 metres in height. Road shows by developer will be held 18th, 19th and 20th April at Saline, Gowkhall and Kelty. Fife has produced a consultation document recommending that turbines be placed only on low areas rather than hills. Next meeting of the liaison group will be at 7pm on Wednesday 24th April at Knockhill.
• Blairingone War Memorial: Alastair reported that nothing has happened this month.
• Crook of Devon Church Car Park: No news yet from the church about funding.
• Signposting Core Paths and Rights of Way: A number of local landowners and farmers met Mr Laurie, and Mr Stubbs, to discuss the core path through Craigton Wood, and along the old railway line. It was unanimously agreed that this should be replaced by a circular path through Craigton Wood. Although some work (bridging ditch, clearing branches, etc.) will need to be done to complete it, possibly with community help. The CC fully endorsed this result. Thanks were recorded to Mr Stubbs for his flexible approach on this matter.
• Lambhill Wood Chip Plant at Blairingone: Alan Kinloch’s letter to Bernadette Malone of 27th March (escalating his letter to Nick Brian) elicited a reply from Mr Brian the same day. However there’s no change on the separation of the two applications even though one site needs the other to accommodate its turning circle, and meanwhile work on the site continues in the absence of approval. Nevertheless, the valid points raised in Alan’s letter have still not been addressed prior to the application being submitted to Committee, so he has written to Mr Brian again. Mr Lavery would write again stressing the 4 planning law points which were in Mr Kinloch’s letter and reiterating the CC’s view that this was one site, and should be treated as such.
• Travellers’ Site at Crook Moss, Crook of Devon: Cllrs Giacopazzi and Robertson described the contents of the Contamination Report which says that the contamination is not sufficient to prevent the application going forward, and any risk can be eliminated with Radon barriers under each pitch. Traces of lead and nickel were found in the groundwater, and grey asbestos found in one borehole, however PKC do not believe the amounts are significant. No investigations were done on the part of the site which was previously a waste dump as that is not included in the current application even though a successful application might result in expansion into that area in the future. The CC would expect there to be an exclusion on any development out with the original site until a full contamination report had been completed on the remainder of the site.
Grey water is still being disposed on the site, but that is also not considered to be a concern. A new proposal for sewage disposal is being prepared by the applicant who hopes to include other existing properties in the area, in order to meet the Loch Leven Catchment 120% criteria.
Cllr Barnacle points out that even with the above points being addressed by the applicant there are still the matters of the site being contrary to the local plan, and adequate provision for travellers already being available at other sites. The CC still believes that the calculation of need is incorrect and will be resubmitting their calculations on this matter.
Councillor Giacopazzi reported that the planning department had confirmed that the occupants were in breach of the timescale allowed for submitting plans, but this had been exacerbated by the death of their agent. However planning’s patience was not everlasting.
• Glenquey Quarry: May be on the Agenda for the DMC meeting on 24th April or 22nd May.
• Glendevon Pollution Incident: Nothing further to report.
• B9097 works: Sandy reports that the signage was installed as agreed. A977 in Blairingone: work now re-scheduled for 22nd to 29th April – See also Cllr Barnacle’s report.
• Green Routes: Cllr Giacopazzi confirms that the Green Route including the loop road has been extended to the old road not the A91.
• Local Development Plan: The proposed plan has been submitted to the Scottish Government for approval.
Kinross Civic Trust mounted an appeal against the way that PKC had conducted the public consultation, but the Reporter stated that they thought the process was adequate.
Cllrs Barnacle and Robertson made similar representations to the Recorder, with the same response.
• Gartwhinzean Loan Signage: The CC contacted PKC - This is not currently a high priority, however PKC will attempt to resolve.
• Gartwhinzean Hotel Site: the CC contacted Ken Thompson who has agreed to take down redundant signage and trim overhanging bushes’, the latter has been done and the former will be dealt with over the next week. The CC thanked Mr Thompson for his prompt response.
• Powmill Snack Bar: The CC emailed Cllr. Barnacle regarding problems with parking, litter, etc., discussed at the last meeting – the complaint has been passed to Ray Short. Parking is a Police matter, other concerns have been passed to the appropriate departments, and our complaint will be passed to the Case Officer if the planning application is renewed, since the current permission expires in September.
• Church Community Office: Meeting on Friday to try and find more volunteers.
• PKC Ground Maintenance Review: Kevin reports that PKC have held this review – various cost-saving measures have been proposed, e.g. verge cutting stops at 30mph signs, poor condition flower beds returned to grass, etc. Full details were made available for inspection. There is an opportunity for the community to retain the maintenance of these areas, but proposals would have to be discussed with PKC, also taking into account health and safety requirements.
There main concerns from those present was that reduced verge cutting would be a safety issue; it was also stressed that verge cutting should not be left until T in the Park, but should be dealt with when required. Any comments about these proposals should be sent to PKC by 12th April.
• Dead sheep in River Devon: The CC was contacted by a MoP to report a dead sheep in the river above the Scout camp, having not gained any useful response elsewhere. Angus removed it and contacted the owner.
• Community Plan Consultation: Sandy reports that he will respond in accordance with discussions held in meetings of this CC.
• Gritting and Snow Clearing: PKC have asked for comments on this process – The general view of those present was that a good job has been done in spite of the conditions. However in some areas the bins were unable to be emptied due to bad weather.

PKC Councillors’ reports:

Cllr J Giacopazzi: A Crook of Devon resident had complained about a letter from PKC concerning the Electricity supply to Crook Moss. He had investigated with an independent legal source and was informed that the response was legally correct, although the terms of the letter could have perhaps been better phrased.

Cllr M Barnacle: Area at end of Aldie Road – PKC will look into tidying up.
Carnbo Post Box: Royal Mail are investigating Cllr Barnacle’s complaint about removal of this box.
Development Management Councillors are taking a tour of Wind Farms in Kinross-shire to compare the reality with photo-montages submitted with previous planning applications.
PKC have agreed to create a business case for A977 improvements, as the first step towards actually doing something.
New HGV sign put up at the Drum road end.
MoP notes that the A977 closure will result in diversion via the Knockhill road, which is already damaged (and has temporary lights) so is not appropriate for this use. Cllr Barnacle will investigate.

Cllr W Robertson: Loch Leven Heritage trail – work should commence at the end of May as all the landowners have agreed the route, and all other requirements in place.
Greenknowes Wind Farm: Why weren’t Fossoway CC consulted about this? Cllr Robertson will find out whether this community should receive some benefit from this.
Yesterday was the start of the new Policing structure, so it’s important that we make sure the contact with the community continues as before.

Community Policing: PC Jim Pentley attended and reported that speed checks continue on major roads. Theft of two road rollers in Blairingone is being investigated – plant thefts are very prevalent at the moment, please take extra precautions. Community Speed Watch has been recommended for continuation, however with the new Police organisation it may take some time to reach the right people. Trudy notes that the Community would need to raise the funding for the equipment.

Rumbling Bridge Hydro Scheme Update: Hugh Wallace of Glendevon Energy gave a presentation about the scheme. Output will be 500kW P/A, costs up to planning stage £170,000 final cost £2.5Million. Return of water type scheme with a 1.3km pipeline. SEPA specify a compensation flow – the amount of water bypassing the turbine and continuing down the river. In periods of low water the scheme will not operate. Intake weir will be just downstream of the deer farm, follow line of Devon Valley railway, running roughly parallel to A977 going underneath Rumbling Bridge road and finally re-joining the river SW of Rumbling Bridge close to Scottish Water pipeline. Test drilling to establish ground conditions currently taking place. The work involving Rumbling Bridge road can be compressed into 4/5 weeks to minimise disruption. The aim was to minimise disruption to landowners during the construction period, and have things in a better state than when the scheme commenced. There is a new opportunity for Community investment via the Scottish Government’s Community and Renewable Energy Scheme (the charity Community Energy Scotland can help with this) to borrow up to £250k, repayable over eight years, to invest in the project, however the originally proposed Community benefit is still on the table. Cllr Barnacle asks if it would be possible to reinstate the missing bridge as part of this scheme – that could be looked at, however the intake weir would be designed to enable it to act as a public crossing. Aim is to submit planning application in late May or early June this year. There was considerable discussion on the project, and contributions from various Members of the public. G Lawrie suggested that the CC should contact Glenfarg CC, who were involved in a community energy project. The CC’s position was one of general support but it required considerably more detail and regular updates to determine its position on community involvement.

Matters arising:
• Outh Muir Wind Farm: No CC member was able to attend the last meeting, and minutes have not yet been published. However a new wind farm is being proposed at Blairadam, there will be presentations about this on 20th May at Saline Community Centre between 2pm and 8pm, and at Kelty Community Centre on 23rd May between 2:30 pm and 7:30pm - the concern is that the two schemes might eventually expand to join each other.
• Blairingone War Memorial: Alastair reported that the developer has invited the CC to a site meeting to discuss the new location with the Planning Officer and PKC’s Graves department. It is important that the memorial’s new location is achieved before the significant anniversary of 2014.
• Crook of Devon Church Car Park: No news yet from the church about funding.
• Signposting Core Paths and Rights of Way: George Harley has not yet had the meeting with D Stubbs.
• Lambhill Wood Chip Plant at Blairingone: Nothing further to report, no response to CC’s letter.
• Travellers’ Site at Crook Moss, Crook of Devon: Still awaiting the application to be resubmitted. Cllr Barnacle has requested Nick Brian to meet with the four councillors to discuss the proliferation of Traveller Sites in this area – it would be a good idea if the CC was also represented at the meeting.
• Glenquey Quarry: No date for DMC meeting.
• Glendevon Pollution Incident: No progress to report.
• Local Development Plan: Is with the reporters unit, and 4 reporters have been assigned to consider the plan.
• Powmill Snack Bar: Sandy reports that correspondence had been received from the owner, who had been invited to attend this meeting. At the meeting the owner challenged the previous reports of litter, parking problems and closure of local shop. Sandy replied that the CC meetings are not secret and their minutes are published. Minutes are merely a recorded summary of comments made by attendees at these meetings. The CC was not taking sides with any party. It was purely recording concerns raised by members of the public. The owner asserted that there are currently no litter problems, no parking problems, and the business was not responsible for the closure of the local shop. MoP present observes that the litter at the site is now no worse than it was before the opening of the Snack Bar.
• Church Community Office: Angus reports that a new committee has been created. The original purpose of the Office was to enable access to computing, which is no longer a common requirement, but the Office is a very good resource for high quality and good value printing, and urged that the resources be utilised.
• PKC Ground Maintenance Review: Email sent to Community Green Space Team. No response as yet.
• Community Plan Consultation: Reply sent.
• Gritting and Snow Clearing: Response sent in line with the discussions held at CC meeting.
• Core Paths: George Lawrie has been liaising with local landowners about signage on behalf of PKC. Core path plan has now been approved by Central Government and is now fixed. Proposing creation of a Community Group to improve/create path through Craigton Wood – Funding can probably be obtained to finance this. The CC approves of this plan, and a sub-group chaired by Kevin Borthwick with an initial membership of Duncan Carmichael, Karen Heriot, and Sheila Anderson was set up. Other members from the community would be welcome to join the group.
• Green Routes: PKC have now received some more funding. A MoP has raised concern regarding the foot/cycle path between Aldie Road and Rumbling Bridge, since there is now no barrier between the path and the A977 – This concern was supported by the CC as the A977 was a very busy road for HGV’s, and the downdraught from these vehicles could de-stabilise a child on a bicycle. It was felt a barrier of some sort was necessary. This has come about because the previous verge has been removed to allow the path to be widened to 2.5m, which is a requirement for dual-use paths. Cllr Barnacle points out that part of the Green Route programme will be to lower some speed limits which should help allay this concern. Millennium Path: This will join core paths and old railway line to create a cycle path connecting Kinross and Crook of Devon – currently being researched and £300k needs to be raised. MoP thank George for all his (and his committee’s) efforts in creating paths, and raising funds. G Lawrie suggested asking Brian Cargill to the next meeting to discuss Green Routes.

CC Business: No meetings this month.

PKC Councillors’ reports:

Cllr M Barnacle: Track between Naemoor Road and River - PKC has funding to resurface this, but landowner is currently refusing access to the contractor.
Carnbo Post Box – Could not be returned to its original location due to increased traffic, and boxes are no longer put in walls. Royal Mail replied that where there is no local Post Box, then post can be handed to delivery staff.
U213 Passing Places – meeting to discuss these with various PKC Officers, local residents and Councillors will be 28th or 29th May.
Alan Briscoe’s complaint about litter has been passed to the appropriate departments in PKC.

Planning:

13/00658/IPL Erection of a dwelling house (in principle.) Land 40 metres West of Devonlade Main Street, Crook of Devon. CC notes that it’s not qualified to comment on detailed flooding issues, although there was robust discussion about this amongst the MoP present. Following the meeting, PKC’s the Report of Handling for 12/01189/IPL was reviewed. This confirms that previous applications were rejected on grounds of road safety at the access point on to the A977. However, new Government regulations and the reclassification of the A977 in 1996 remove these grounds for refusal. While the CC has consistently disputed the “local network” status of the A977, it is clear that there is no valid abjection on grounds of road safety would be recognised by the PKC planners.
Recommendation. No CC comment.

Profile Projects sent details of a proposed new house east of Blairingone. This was noted and the CC will take no further action till an application is submitted.

AOCB: There seems to be a shortage of signs for Powmill. Alastair explained that there is an agreed hierarchy of towns which are signposted on major roads; sadly it appears that Powmill didn’t make the cut…

Community Policing: No Police officer was present, but a report sent: No crimes of note in this area last month. T in the Park is coming up in July and the Police will try to ensure minimum disruption. Sergeant Sandra Williams, Constable Sadie Allan and Constable Victoria Riches are the main points of contact – please don’t hesitate to contact them. Thefts of heating and diesel oil are prevalent due to the prices, so it’s good idea to take precautions to protect tanks. Concern from MoP that although there are frequent checks of 30mph limits, people seem to be ignoring the 40mph limits – could checks be done in these areas? Cllr Robertson has asked senior Police Officers when the Community Speedwatch will be reinstated. Cllr Barnacle reports that PKC is preparing a business case for further speed control measures on the A977.

Wind Co-operative: Paul Phare of Energy4all (a not-for-profit organisation) and Ian McLean of Locogen gave a presentation about two wind turbine developments at Carden Farm, 1km South of Crook of Devon, and South Kilduff Farm, 2km South-west of Balado. Planning is likely to be submitted start of July and end of June respectively, expecting a decision by October. The 45m high (30m tower, 15m blade) turbines would be slightly shorter than the Bankhead turbines. Turbines will be placed to maximise separation from residential developments. Ownership to be based on the Danish model – a co-operative set up to be run by a board of local people and funded by a public share offer, minimum £250, maximum £20k, with further finance being sought from other co-operatives and normal sources if necessary. Similar schemes have generated 10% return over the life of the project. Any extra profits would be distributed to community, of the order of £5k to £10k per annum. The landowner will receive a ground rent. Energy4all will assist in setting up co-operative, which will probably take about three months after planning approval. Cllr Barnacle points out that the whole area is being surrounded by multiple schemes, and this proposal will add to that cumulative impact. Further it has been demonstrated that photo-montages being prepared for planning do not reflect the reality of what gets built, and new rules are coming into force to address this. Discussion ensued about paying for end-of life restoration- The planning authority will insist on a bond to decommission site, and the co-operative could choose to extend the planning permission and continue with the site or replace the turbine with a newer one.

Green Routes: Brian Cargill from PKC explained the thinking behind these. Local Cllrs had requested the scheme, and after consulting with Clacks, who reported that they were very successful, PKC investigated. In conjunction with surrounding councils it was possible to make continuous routes. Simply putting up speed limit signs doesn’t work, so other measures are needed to make the limits effective. There are sixteen routes (twelve in this CC’s area) proposed, currently the process of consulting local CCs, allowing any legal challenges to be resolved, etc. is taking place. Sustrans passed over £61k which they couldn’t deploy last year, and addition of other finance has allowed two of the schemes to be implemented already. Two more locations have been funded by Sustrans this year. Speed limits corresponding to current actual speeds will be imposed, together with signs advising drivers the road is also being used by cyclists, walkers and horse riders. Concern had been expressed about the loss of separation between the pavement and the road on the A977 due to the widening work – Brian replies that there is no evidence that this increases risk. MoP point out that there are other areas that don’t have pavements at all, why weren’t they fixed first? Brian replies that there is a long list of outstanding requests for pavements, and there isn’t a budget for those. There was extensive discussion about whether these schemes will actually improve safety. Long term traffic analysis has shown gradual increase in traffic volumes on A977, but no more than on other roads, and the percentage of HGVs has not increased. Speed data shows that it’s private cars and not HGVs that are exceeding the speed limits. Police traffic cameras are being used to reduce accidents, and hence are deployed in the same places where accidents have occurred in the past. Brian would welcome suggestions for other locations to become Green Routes.

Matters arising:
• Rumbling Bridge Hydro Scheme: CC requires considerably more detail and regular updates to determine its position on community involvement.
• Outh Muir Wind Farm: John Anderson sent a report – the liaison group is currently discussing distribution of any potential Community benefit (estimated at £62,500 per annum) should the scheme go ahead. The Planning Application is expected to be submitted to Fife Council later this month. Next meeting of the liaison group is at 7pm on 10th June at Knockhill.
Blairadam wind farm will have eleven turbines with a height of 115 metres. Seven to nine will be visible from Yetts of Muckhart, four to six from Carnbo and one to three from Crook of Devon. At the presentation about the wind farm it emerged that the developer is substantially owned by a Canadian Pension Fund and the turbines would be constructed outwith Scotland! A PAN (Proposal of Application Notice) for this major scheme was registered on 23rd April, implying that the planning application could not be submitted before July.
Heads Hill Wind Farm – Proposal for 25 Turbines five miles North-west of Kinross, i.e. above Carnbo. Cllr Barnacle suggests that this is the same location as a previous scheme that was turned down. Kinross Civic Trust wants to arrange a joint meeting of Community Groups to discuss the further proliferation of wind farms in this area. It was agreed that the CC would attend.
• Blairingone War Memorial: Cllr Barnacle reported that he’d written to relevant parties to propose a site meeting to mark out the exact new location.
• Crook of Devon Church Car Park: No news yet from the church about funding.
• Signposting Core Paths and Rights of Way: George Harley has still not had the meeting with D Stubbs. Craigton Wood – The landowner had not been contacted, and did not wish a circular path to be constructed: legal advice was being taken. The CC had understood that a core path had been designated and that a meeting had been held with D Stubbs, and adjacent farmer, and others, on site. The CC had therefore put in place a working group from the Powmill area to take the mater forward. It was now apparent that agreement had not been reached with the land owner, and the CC therefore disbanded the working group. The CC unreservedly apologises to the landowner for any distress caused by this misunderstanding.

Cllr Barnacle has requested a meeting with Nick Brian, PKC Forward Planning and local representatives to discuss the continued deferral of this application, and the proliferation of gypsy sites, which is due to take place later this month.
• Glenquey Quarry: The traffic and tourism report has been received. Alastair has replied on traffic matters. The next DMC meeting is 19th June, but it’s not yet known if this application will be on the agenda. Also noted that Cemex propose to extend the quarry near Falls of Clyde.
• Glendevon Pollution Incident: No progress to report.
• PKC Ground Maintenance Review: Response has been received from PKC that they are awaiting a detailed report after Committee decision.

PKC Councillors’ reports:

Cllr M Barnacle: The resurfacing of the track between Naemoor Road and the River is still being held up by the landowner’s refusal to allow the contractor to access the site.
U231 passing places – Cllr Barnacle has been told that he can’t set up this meeting, it can only be arranged by Development Control, discussions continue.

Cllr W Robertson: Has suggested to PKC Roads department that they set up a “flying squad” of two or three workers who could quickly go and fix small problems without needing to arrange an external contractor – this idea will be carried forward. PKC has no policy on red squirrels, so Cllr Robertson is proposing some measures to be put in place to encourage reds and discourage greys.

A previous related application, 10/01768/IPL was rejected on the grounds that it detracted from a listed building. The Community Council did not comment on this application. A 1.5 storey bed roomed house on a site beside a consented garage to the East of Blairingone Church. The site is outwith the settlement boundary and no justification is given under the Houses in the Countryside Policy other than being part of a group of buildings near the church. The site is within the Kinross Local Plan AGLV.
Since this application’s comment date was before this meeting, it was discussed by the CC members who agreed to Recommend Rejection, on the grounds that the application is contrary to the Kinross Local Plan, as it is within the AGLV and is outwith but adjacent to the Blairingone settlement boundary.

Lambhill, Blairingone

12/01354/FLL Storage of waste wood material on concrete hardstanding (in retrospect), land At Lambhill Blairingone for Barnhill Estates has been Given Approval.

PK/97/1665 Modification of existing consent to allow change of use of agricultural shed for the processing and storage of biomass materials, land at Lambhill, Blairingone for Barnhill Estates has been Withdrawn.

The CC considered that these two applications should have been taken as a single development. Activity related to the withdrawn application has been carried out on the site for some time and has been subject to scrutiny, but not stopped, by PKC. It is not at present clear what is now going to happen at this site. The CC should keep the matter under review. Cllr Barnacle spoke to Nick Brian who says that storage of approved material is acceptable, but not the previously proposed change of activity. Cllr Barnacle says that it would be a good idea to make a site visit along with PKC’s planner, enforcement officer, and CC representatives. The CC agrees.

Note: 11/01225/FLL Erection of dwelling house and garage. Land 420 Metres South-west of Middleton, Fossoway. This application was submitted in July 2011 and was not discussed at any CC meeting. It was given approval, without objection, in January 2013 and was only then brought to the CC’s attention. Following investigation, and thanks to Councillor Cuthbert, the CC has established that the application was listed properly but not picked up by the CC or others in the community. The site appears to have no “neighbours”.

13/0658 (from last month) The CC has written to PKC asking for clarification on the Report of Handling referring to traffic issues.

Draft Minutes Meeting Fossoway and District Community Council
Tuesday 6th August 2013, Carnbo Village Hall

Attending: Sandy Morrison, Trudy Wigman-Duffy, Kevin Borthwick, Alastair Lavery, Rod Patterson, Cllrs M Barnacle, D Cuthbert and J Giacopazzi and 18 Members of the Public (MoP).

Apologies: Sheila Anderson, Angus Cheape and Cllr W Robertson.

Community Policing: PC Euan Mitchell reported: No recent crimes in the area, but the public should continue to be alert to rural thefts which have occurred in the wider area of oil, trailers, etc. Speed checks have been carried out in the Powmill 40mph section, but no offences were detected. During school holidays operation MIRFAK (not an acronym) was run to target anti-social behaviour, although this is not a big problem in this area. There has been Police concentration on drunkenness, litter, etc., offences in the countryside during summer months. There is no date fixed yet for the TiTP debrief, but there will be one.
PC Mitchell is the Police Liaison Officer for Ryder Cup 2014. A large (up to 3,000 cars) Park and Ride car park will be created at Balado, on the festival site, with buses to Gleneagles taking a circular route through the Glen and back down the M90. Peak traffic times will be morning and evening, but hopefully outside normal commuting hours. There may be some traffic restrictions to facilitate bus movements, but more detail will be provided later. A Community Forum, similar to that for TiTP will be set up, the first meeting will be Monday 16th September at Kinross Community Campus. Currently there are no plans for the Park and Ride buses to pick up at any other points, since the occupants will have been security screened as they board. MoP notes that this operation will take place during school terms – will the Park and Ride buses conflict? PC Mitchell suggests that there might be an In Service day on the Friday which will be the busiest day of the event thereby reducing the risk. MoP asks if there is a plan for diverting HGVs coming from the North that might cause congestion around, for example, Auchterarder. PC Mitchell assures us there won’t be a problem!

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
Glendevon / Rumbling Bridge Hydro Scheme: The CC has previously suggested that there should be a public meeting to discuss any potential community involvement. Hugh Wallace reports that the planning application has been submitted, as well as seeking permissions from SEPA and Scottish and Southern Energy. Discussions have taken place with SEPA to ensure that water levels are maintained satisfactorily – The scheme will not operate when water levels are lower than that designated by SEPA. Alastair asked for clarification about the grid connection – It will be via an underground cable, for its entire length, to a transformer on a power pole near Over Dalkeith Farm. There will be no additional poles required. Alastair also asked about potential noise from the generator being transmitted along the pipe, which has been reported at other sites - This is unlikely to be an issue as the pipeline is almost all buried: Hugh will check on the coverage near the houses. The turbine itself will generate some noise, but the design of the turbine house is intended to suppress this.
MoP then asked several questions: Have all the landowners along the pipeline have given their permission – Yes, this was an early part of the process. What will be the impact on the Millennium Path while the weir is being constructed – A temporary diversion will be put in place. What about trees around power house - Some will need to be felled; however the wood could do with some thinning anyway. Could the power house be sunk into the ground rather than being 5.5 metres high - This is constrained by the flood level of river. Could the outlet pipe come out further down - A conflict with the Scottish Water pipeline prevents this. How will “mining” under A823 be done without risk to all the main services that run along that road, the contractor appointed will be experienced in this type of work so there should be no problem. - No guarantees can be given, but all possible care will be taken, and any problems will be addressed immediately. What are timescales - It’s a six to eight month project, with about a month for the work through Rumbling Bridge.
Cllr Barnacle notes that although we probably all believe that this sort of scheme is a good idea in principle, he has already received five letters of objection to this particular scheme. Cllr Barnacle suggests that a Community Public meeting be held to enable full information to be provided and all questions to be answered. Hugh proposes to hold this meeting on an evening within the next two weeks, with his consultants present to give detailed responses to any questions, and he will ensure that adequate publicity is provided in advance of the meeting.
Heads Hill Wind Farm – Clarification from Cllr Barnacle that it’s not yet an application, but currently just an initial investigation. Until the planning application is submitted, or the pre-application consultation takes place we won’t have any further details. Alastair notes that other applications have avoided being treated as major applications on the basis that the roads are already in place and the only change of land use is the footings for the turbines. Cllr Barnacle says that the most important thing is to get the PKC planners to create Landscape Designations – Fife Council has already submitted theirs. This CC has previously written to PKC asking for a co-ordinated policy on Wind Farm development and to confirm the advice already given that the existing AGLV criteria will be followed until a new code is developed, consulted on, and implemented by the council. Alastair reports that there was discussion at the Kinross Civic Trust meeting of how cumulative effects of wind turbines should be addressed, but he was told that there is not going to be any specific policy on this.
Blairingone War Memorial: Cllr Barnacle is having difficulty in agreeing a date with the developer to discuss this – It’s important that this is done before the 2014 Anniversary.
Crook of Devon Church Car Park: No news yet from the church about funding.
Signposting Core Paths and Rights of Way: George Harley has still not had the meeting with D Stubbs. MoP reports that George Lawrie is still trying to establish the path in Craigton Wood; however this will obviously require the landowner to agree.
Travellers’ Site at Crook Moss, Crook of Devon: Still waiting for the application to be resubmitted, it may be discussed in the September DMC meeting. Cllr Barnacle has been trying to a get a meeting with Nick Brian and Peter Marshall to discuss Traveller’s Sites in general. The local resident affected by generator noise has been told that the applicant will have a planning condition that the generators must be baffled and situated in a structure which is also baffled.
Glenquey Quarry: Application has still not been to the DMC, and will not make the meeting on the 21st.
Glendevon Pollution Incident: No progress to report.

CC Business:
Kevin reports that the CPKCC has been wound up following its final AGM – Final minutes and arrangements for distribution of any remaining funds are not yet available.

Community Workshops will be held in Powmill and Blairingone to discuss local issues. An initial meeting with the CC will take place on the 10th September to discuss the format for the meetings timing and location. The results will then be publicised to local residents. Cllr Barnacle stresses that previous work done on the local plan must be taken into account during these workshops.

Community Speed Watch: Kevin has been contacted by local reporters in response to a Police statement that this would not be continued. Cllr Robertson has had discussions with the Police and the issue has been re-opened.

PKC Paralegal Department have sent information about proposed changes to speed limits, new footpaths, etc., mostly to implement Green Routes. Kevin notes that the details including maps are available for inspection.

Friends of the Earth have informed this CC that the Fossoway area is one that could be subject to future Fracking developments. PKC do not currently have a policy on these developments.

KCCN: Sandy reports that there has been a proposal to only hold meetings when required, together with an annual meeting – The CC supports this idea.

TiTP: The application for a licence to hold the event in 2014 has been submitted, and a copy is available for inspection. The CC believes that this event is now fairly well managed and hence would not object to the application. Cllr Barnacle notes that no complaints were received this year, which supports this view.

Bus Investment Fund: This has money which could allow development of local transport services, which would be operated by local taxi firms at the same price as a bus fare – Bus passes would be accepted. Muckhart CC has submitted a letter of support; this CC will do the same. Rod notes that there are no Sunday bus services, and asks Cllrs to look into whether this should be provided to create a Community Benefit.

PKC Councillors’ reports:

Cllr D Cuthbert: The Kinrosshire Local Events Organisation proposes to hold a Winter Festival in December.
Constituents reported that there was a problem with Maths and English in both Primary and Secondary Schools. However after research it appears that the problem lies more with the Secondary School. Having met with the Head of Service for Teaching at Secondary Schools and going through statistics it was agreed there is a problem, especially in English, and have proposed a plan be put in place to resolve this issue, and hope it can be addressed successfully.
The new Ryder Cup signs state that “Perthshire Welcomes…” – but don’t mention Kinross – Cllr Cuthbert has asked for this to be rectified.
Cllr Cuthbert is investigating accuracy of Planning Reports, this CC is aware of several examples.

Cllr M Barnacle: A further meeting with Environment Services about verge cutting will be held next week to address their position that there will only be one cut per year, whereas junctions need to be cut more often. There is a proposal to reduce budgets for crossing patrols, which will result in lunch time patrols at Pedestrian Controlled junctions being removed.

Cllr J Giacopazzi: Nothing to add to points already made.

Cllr W Robertson: Not present but reports that we will be notified about Planning Applications that are outwith Perth and Kinrosshire.

Complete your electoral registration form

Angus and Perth & Kinross residents will shortly receive their annual electoral registration
form through the post and are being encouraged to complete and return it promptly.

Included with this form will be a Young Person’s Registration form to allow 15 year olds who
will reach 16 years of age, on or before 18 September 2014, to register to vote at next year’s
Scottish Independence Referendum.

Electors do not have to return the Young Person’s Registration form if there is no-one within
your household who meets the criteria to be included on the form.

Electoral registration staff are working closely with schools, colleges and all other
educational establishments in both areas to gather data on all 15 to 18 year olds for the
2014 referendum.

Alastair Kirkwood, Electoral Registration Officer for Angus and Perth & Kinross, said
“Registering to vote is quick and simple. All you have to do is update your electoral
registration forms with details of everyone who lives in the household and is eligible to vote;

Declarations of interest: None.

Community Policing: PC Sadie Allan reported recent crimes including a theft of a Massey Ferguson utility vehicle from Easter Muirhead, Blairingone. Rural thefts continue to be of concern. There is an on-going local initiative: Kinross-shire Rural Watch Launch, a local “neighbourhood watch” scheme for rural areas. Checks for speeding in the area are continuing.

Matters arising:
Glendevon / Rumbling Bridge Hydro Scheme: A public meeting was held in Crook of Devon Hall where there was robust discussion. Glendevon Energy acknowledged local concerns and were addressing them in the planning process. SEPA have said the scheme will not add to the flood risk. A noise study will be provided and the CC will review it when the report is available. MoP raised the question of extracting too much water, and affecting the river downstream. Mr Wallace responded that SEPA were setting the level of extraction allowed, and the scheme was modelled on a worst case scenario of only being able to operate 60% of the time, which still made it a viable proposition. Another MoP felt none of the concerns had been addressed and that blasting rocks close to houses and damage to services were still an issue. There was considerable discussion on this matter and Mr Wallace confirmed that experienced contractors who are used to dealing with these problems would be used. The scheme will be revisited by the CC but it can only comment on planning issues.
Heads Hill Wind Farm – This is not in the planning process yet. The CC may wish to comment.
Blairingone War Memorial: Cllr Barnacle, K Borthwick, A Lavery, G Pye, the Developer and a Council Official met to resolve the moving of the War Memorial. The meeting identified a place on the back wall of the cemetery for the Memorial and where vehicles could access the site. This will all go ahead soon. It proved to be a positive meeting.
Crook of Devon Church Car Park: No news yet from the church about funding.

Travellers’ Site at Crook Moss, Crook of Devon: W Robertson is still investigating drainage issues. The mitigation measures involved a property which is on the border of Loch Leven catchment area, but the issue was where did the drainage go to? Nick Brian would be investigating the issue. The other area of concern was where the treated effluent was being pumped to a raised area, which was being created. The area concerned was on top of the original rubbish tip and it had not been part of the phase 2 site investigation. The CC had previously requested that if any development was to take place on this are that a full contamination investigation should take place.
Glenquey Quarry: Application has still not been to the DMC.
Glendevon Pollution Incident: No progress to report.

CC Business:

Community Speed Watch: Cllr Robertson has had discussions with the Chief Inspector about the scheme and the police are encouraged with the results. They are hoping to see 6 speed watch areas with the communities sharing the equipment. The Police cannot bear all the costs and it was agreed that investigations should begin as it whether the Kinross Fund could be used. Capital costs could be met but on-going costs may prove to be a problem. Police are keen for the scheme to be rolled out. Trudy has had a letter from Emma Bowman apologising for the lack of information given to the Community after the project. 211 warning letters had been sent out, 93 fell within the scope of police enforcement. There were no repeat offenders.
Fracking: A meeting is to be arranged with Kevin and Sandy with Friends of the Earth to discuss the issue.
Bus Investment Fund: CC now on board as a partner. Final submission made.
Film Festival: JAM (Just About Movies) festival is planned at Tullibole Castle. Rod had attended the presentation day and based on his report the CC was supportive of the proposal.

PKC Councillors’ reports:

Cllr D Cuthbert: The poor HMI report of Fossoway Primary school was discussed and a plan for a way forward was agreed at a school meeting. The head teacher is moving on and the HT from Cleish will act as an interim. A presentation was planned to show how improvement would be achieved. MoP felt that teachers worked hard and should receive more support and encouragement. The HMI will re-visit in June 2014.
Work on the U213 will be starting on 16th September. Road repairs and passing places would be carried out.

Cllr W Robertson: The last details of the Heritage Trail have been agreed and it is due to finish in spring 2014. Safe Cycle routes between Kinross and Crook of Devon are on-going. The idea of having the pedestrian traffic lights in Crook of Devon permanently on red (changing to green) to slow traffic will be explored.

Planning:

A Lavery has had a reply from PKC regarding the Landscape and Wind farm Policy. It was a full and very useful document. Development on the Lomond Hills and the Benarty basin are likely to be limited.

Recommendation. Object, on grounds of proximity to housing, contrary to Environmental Health guidance.

AOCB: Kevin went through the correspondence which was all available for viewing and highlighted a number of areas. E.g. a Dog Fouling Campaign by Keep Scotland Beautiful was highlighted by Kevin.
Please get in touch with Kevin if any areas were thought to be a priority for verge cutting. It was suggested that all junctions onto the A91, A977, B9097 and one junction on the A823 after Rumbling Bridge, should be prioritised.

Draft Minutes Meeting Fossoway and District Community Council
Tuesday 1st October 2013, Blairingone Primary School

Attending: Sandy Morrison, Kevin Borthwick, Alastair Lavery, Rod Paterson, Cllrs D Cuthbert and M Barnacle and 7 Members of the Public (MoP).

Apologies: Sheila Anderson, Angus Cheape, Trudy Duffy-Wigman, and Cllrs J Giacopazzi and W Robertson.

Declarations of interest: None.

Community Policing: PC Sadie Allan reported: Recent crimes including a housebreaking in Vicar’s Bridge road and the theft of a large aluminium gate from Powmill. There is an on-going local initiative: Kinross-shire Rural Watch Launch, a local “neighbourhood watch” scheme for rural areas, currently there are 30 members, but you can join by going to www.neighbourhoodwatchscotland.co.uk and clicking “JOIN” – Choose “Kinross-shire Rural Watch” from the drop down box at step 5.
Speed checks continue at Drum, two people were charged and six warned.
Kevin reports that new 40pmh speed limit signs in Aldie Road are being tampered with – PC Allan was not aware of this.
Cllr Barnacle has had an email from Inspector Steve Sangster, who is based at the Crieff Police Office and is now responsible for this area, phone 01738 892720. His deputy is Sergeant Sandra Williams on 01738 892712.
Cllr Barnacle asks PC Allan if it is possible for traffic to be stopped outside Crook of Devon Village Hall during the minute’s silence on Remembrance Day.

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
• Glendevon / Rumbling Bridge Hydro Scheme: The planning issues which the CC raised have been addressed and hence the CC will advise the council that these issues have been met. Alastair stated that the way the developer had responded to concerns, by holding public meetings and commissioning reports was the way that he would like to see maters of this kind dealt with in the future by developers. As a goodwill gesture, the developer proposes to replace the foot bridge that was washed away, as long as agreement can be reached regarding design and costs with PKC. Cllr Barnacle points out that it isn’t essential that the bridge is replaced at the original location, due to possible problems there.
• Blairingone War Memorial: No progress.
• Crook of Devon Church Car Park: No news yet from the church.
• Signposting Core Paths and Rights of Way: George Harley has still not had the meeting with D Stubbs.
• Travellers’ Site at Crook Moss, Crook of Devon: A report about the drainage issues has been received from PKC showing the proposed arrangement to be acceptable. Cllr Barnacle reports that Mark Williams has told him that the application will return to Development Control Committee next week (9th October) with a recommendation for approval, since all the issues have now been resolved. However, the location of a traveller’s site at this location is contrary to PKC’s own policy, which Cllr Barnacle will make clear during the committee meeting. Cllrs Barnacle, Joe and Nick Brian will visit the two traveller’s sites to review the proposed expansion of the Green Acres site. The CC will write to PKC again reiterating its objections, and A Lavery will address the DMC.
• Glenquey Quarry: Application has still not been to the DMC – next meeting is 13th November.
• Glendevon Pollution Incident: No progress to report.
• Dunning Glen: Kevin received a call from the Police to identify the landowners because there was an event planned. The relevant land owner had given permission for the event to take place, so the Police stressed that suitable measures be taken to avoid nuisance. Correspondence also received from a MoP reporting various issues.

CC Business:

Community Workshops: The meeting to discuss the format of the workshops to be held in Powmill and Blairingone to discuss local issues has been rescheduled to 10th October.

Community Speed Watch: Nothing to report this month.

Fracking: A meeting is to be arranged with Friends of the Earth, attended by Kevin, Sandy, local Councillors and other CCs in the area, to discuss this issue. Kevin is trying to organise the meeting for November. Cllr Barnacle reports that a briefing note has been received from PKC, listing sites in Kinross-shire where applications have been made. This issue could also be discussed in conjunction with Landscape Designation.

Bus Investment Fund: Cllr Cuthbert reports that it’s with the Scottish Executive for review.

Ryder Cup: Rod attended a meeting to discuss traffic and parking arrangements – Three park and ride car parks will be provided, the largest being of 8,500 spaces at Balado; buses will drop off at a newly constructed bus terminal at Gleneagles. Overall the organisation seems to be very thorough, and the team are responsive to local feedback. Next meeting will be in March where more details will be available, particularly of traffic management plans.

Outh Muir Wind Farm: John Anderson sent a report from the liaison meeting on 11th September. Objections, including those from this CC and the Airports Authority were discussed. Discussion then moved on to disbursement of Community Monies – it’s not yet clear whether Fossoway is included, but a map will be made available at the next meeting in November. There was also discussion of public access to the site including links to existing path networks.

PKC Councillors’ reports:

Cllr D Cuthbert:
Fossoway School’s head teacher has been replaced, currently with an acting head from another school, while a new head is recruited. An additional teacher has also joined the school.
A review of Waulkmill Play Park in Crook of Devon, which is due to be upgraded next year, is being consulted on now. Cllr Barnacle notes that the wider area of the Park needs to be reviewed, since it’s currently not being fully utilised.
Work on the U213 to repair the road and construct passing places has been carried out; however the passing places have still not been constructed to standard size.
Railway path in Crook of Devon now has dog waste bins.

Cllr M Barnacle:
On-going planning is taking place into A977 mitigation measures, so they can be put into the budget.
Feedback has been received on verge cutting, with the intention of applying for additional funding in next year’s budget to return to more than one cut per year for certain locations.
Fisherman’s signs (warning of overhead power lines) are broken on the Millennium footpath – he will find out who the provider is.
Naemoor Road to river Devon foot path has still not been maintained, although there is now an acceptable offer from the local landowner to do the work, but it has not yet been agreed by PKC’s finance department, which is preventing the work being done.
Crook of Devon crossing patrol is potentially at risk, Cllrs are working on this.

Annual campaign to encourage people to sign up for Electoral Register, especially important this year since it will allow 16-18 year olds to register for the independence vote.
The CC’s annual grant of £528.32 has been received.
The CC thanks John Anderson for repairing the Blairingone notice board.

AOCB:
MoP asks about the current status of the Lambhill application – Alastair reports that the application for change of use from agricultural to commercial use has been withdrawn. PKC’s position is that the current activities are covered by existing consents. Cllr Barnacle has previously asked Nick Brian for a site visit to Lambhill, and will try again.
Rhodders Wind farm has gone to Scottish Ministers on appeal.
Note – next month’s meeting is Wednesday 6th November, a change from Tuesday for one month only.

Draft Minutes Meeting Fossoway and District Community Council
Wednesday 6th November 2013, Moubray Hall, Powmill

Attending: Sandy Morrison, Kevin Borthwick, Alastair Lavery, Rod Paterson, Cllr M Barnacle, and 10 Members of the Public (MoP).

Apologies: Sheila Anderson, Trudy Duffy-Wigman, Angus Cheape and Cllrs D Cuthbert, J Giacopazzi and W Robertson.

CC Membership: Sheila Anderson has resigned from the CC – The CC thanks Sheila for all her work, and hopes she will continue to be involved in Blairingone issues. Graham Pye has been co-opted to the CC in Sheila’s place.

Declarations of interest: None.

Community Policing: PC Victoria Riches has now left South Section and the CC wishes her well. PC Euan Mitchell was present. Recent crimes in the area: Several quad bikes stolen from farms, two thefts from vehicle, two thefts from houses. All are under investigation, and some suspects have been identified. Since several quad bikes have been stolen, the CC observed that it would be useful to have more evening patrols. PC Mitchell says that is now happening. There was also an incident raised by a MoP, where a 4X4 had been targeted, and the house broken into to obtain the car keys, despite two dogs being in the house. Advice was requested regarding the storing of car keys, the response was not to leave them in any obvious places. Eg, key racks, kitchen dressers etc. Is there a Crime Prevention Officer? Yes, contact PC Sadie Allan who is the local Community Liaison Officer.
People are also encouraged to sign-up for Farm and/or Rural Watch – the latter is available to all householders. MoP points out that red diesel thefts are frequent in this area (she’s had three incidents) could the Police make more checks on vehicles to discover if they are using red diesel. MoP comments on tonight’s TV news about sheep theft and asks if trailers could be stopped at night to potentially address this.
Consultation has concluded on proposed changes to Police provision at local stations – public counters at these stations are not used as much as before, and hence opening hours will be reviewed, with some closing, including the ones at Kinross and Auchterarder. Dunfermline will continue to be open 24 hours. Contact will instead be principally by using the 101 non-emergency number or 999 as appropriate. There will be no reduction in the number of officers covering the area. Full details are available on the Police Scotland web site, where comments can also be made. Cllr Barnacle comments that Local Cllrs have discussed the proposed cuts with Senior Police Officers, and made it very clear that it’s important that personal contact with Police Officers is maintained in some way.
Rod observed people cold calling on all the houses in his road that appeared not to be occupied. Is there an equivalent to the Cold Calling Ban areas that’s available in England? No, and this isn’t illegal, however MoP should report any suspicious activity, together with car registrations if possible, to the Police. Reputable companies often report their plans to the Police in advance.
Ryder Cup – Potential road closures affecting this area would include restricting the section of the A823 from Yetts of Muckhart to Gleneagles to local residents only. Passes will be available to those who have a genuine need to pass through this area. State schools will be closed on the Friday of the competition.

Matters arising:
• Glendevon / Rumbling Bridge Hydro Scheme: Kevin reports that the SEPA water extraction licence has been granted and SSE have offered an initial grid connection, but at an exorbitant price, so the output cable will now be run upstream in the pipeline channel, to make a connection at a place that will be more reasonably priced, which has the added benefit of reducing impact on local residents. Glendevon Energy had been in touch with a local farmer regarding his concerns about the impact on his business. Hugh apologises for not being able to be present at this meeting.
• Blairingone War Memorial: No progress yet, however with the approach of 2014 Cllr Barnacle will ask what the developer’s plans are.
• Crook of Devon Church Car Park: No news yet from the church.
• Signposting Core Paths and Rights of Way: George Harley has still not had the meeting with D Stubbs.
• Travellers’ Site at Crook Moss, Crook of Devon: Planning permission has now been granted, with conditions. Cllr Barnacle had addressed the DMC and stressed all the issues raised by the community. In addition Lochleven catchment area has a new memorandum of understanding which replaces the section 75 agreements, which was not correctly applied in this case. Peter Marshall said that it can’t be used with retrospective applications, which Cllr Barnacle points out means that the new memorandum cannot be implemented.
Further discussion will take place about this issue with local CCs of the two policies being incompatible, and how this can be rectified. This application will be included in discussions with local councillors regarding badly handled applications. Alastair notes that the applicant’s representative said that the statement of need for travellers contained in the report was not relevant to this application, which was supported by the convenor on the grounds that the existing policy appeared to enable travellers to choose to stay wherever they identified an area which was suitable for them.
The CC had written objecting to this application in the strongest terms to the Convenor of the DMC, members of the Committee and local MPs – Reply from Roseanna Cunningham said that there was nothing she could do, since the application had received consent. A supportive reply was received from Gordon Banks MP.
It’s important that we continue to report to PKC Planning any contraventions of the planning conditions at this site, especially any signs of expanding outside the approved area, with the hope that they might be enforced. Extensive discussion followed this announcement.
Alastair will report at the next meeting on the conditions imposed.
• Glenquey Quarry: The application will be considered at the DMC meeting on 13th November. Four presentations are already being made, so it won’t be possible for this CC to present. Our most important issue is the number of HGVs using Rumbling Bridge and the road, which have been deemed to be adequate for the increased traffic by PKC. The CC will remind local Cllrs of our concerns.
• Glendevon Pollution Incident: No progress to report.
• Dunning Glen: Kevin had a report from PC Victoria Riches that patrols had been carried out during the summer, but no offences had been detected. A positive relationship with the campers was developed by the Officers, resulting in less litter being left than previously.

CC Business:

Community Workshops: Following a meeting attended by Sandy, Alastair, and Kevin the dates for these workshops have been set for Blairingone and Powmill. Once availability of rooms has been checked, more details will be published.

Community Speed Watch: No update from Trudy. Cllr Barnacle reports that Cllr Robertson has written to, and had meetings with, senior Police officers and it has been agreed that the trial scheme was successful so the idea will not be forgotten.

Fracking: This issue will be discussed at the Kinross-shire Community Council Network on the 20th Nov and once the position has been clarified a meeting between the CC and Friends of the Earth will be organised.

Bus Investment Fund: Has progressed to the next stage.

Walkmill Play Park: Kevin has distributed the Council survey to various interested parties, asking them to copy their comments to this CC as well as the Council. There is still time to comment on this issue and the public were invited to do so.

Meetings Attended: Angus attended a meeting of the Church Office.

PKC Councillors’ reports:

Cllr M Barnacle:
Cllr Barnacle has written to Nick Brian concerning the direct inclusion of text from the developer’s application into the planner’s report on Bankhead Turbines, which were granted under delegated powers. Nick Brian replied that cumulative impact is always considered.
The reporter’s finding on the Local Development Plan has been published: Land at Blairingone for additional 30 houses has been allocated; Housing plans at Powmill have been reduced to 30, excluding existing permissions, and all development was to be on the north side of the A977. A977 will receive traffic mitigation measures; Protection of former railway lines and core paths; Naemoor road development is removed from the plan; Land north of Schiehallion in Crook of Devon had been included in the village envelope. Alastair pointed out that policy 48 which had been removed from the proposed LDP by PKC, had been reinstated by a similar condition by the reporter. The plan and report will come before the Council on 18th December, when full details will become clear.
Rod asks about reduction of Ground Maintenance of areas not actually owned by the Council, for example St serfs Road, Crook of Devon – Cllr Barnacle says that this is happening as a result of budget cuts, but he’s objecting to it when it applies to footpaths.

Planning:

The Fossoway area has approved turbines at six sites (nine turbines, 20m to 47m), with two sites (three turbines, 45m to 47m) pending, plus the above application. At least one other site has been proposed but the application withdrawn at present. The land use and environmental impact of these proposed and pending developments is minor, the major impact being visual and cumulative. The only PKC guidance available is Policy ER1A of the proposed Local Development Plan, which is brief and very general, simply saying that cumulative effects should be considered. A small to medium scale turbine policy is being developed, but no timetable for it has yet been announced. It is impossible for the Community Council to form an opinion on the cumulative visual effect of the many proposals that are coming to us.
It was therefore decided that the Community Council will object to ALL proposals for turbines until PKC have a policy in place.

Rod reports that Fife has granted permission for a wood processing plant at Bowhill, in Fife. This site is an example of a professionally planned and operated site, which may be a good reference for further discussions about the Lambhill site with PKC.

The overhead power line between Kincardine and Blairingone is due to be upgraded by replacing the insulators with ones that will allow the line to carry 400kV instead of 275kV; the towers will not be changed. There was some discussion on this item and MoP’s felt pressure should be applied to have the lines put underground.

Kinross-shire Community & Learning Group Better Place to Live Fair is planned for March 2014 – volunteers to help organise this please attend meeting at LLCC on 13th November at 10am.

Community Environment Challenge Fund

Does your community have an environmental project or a piece of land to improve, which could make a significant difference to your local environment? Is your idea widely supported within your community? Perth & Kinross Council could support you with a grant of between £2,500 and £10,000.

What is the Community Environment Challenge Fund?

The Community Environment Challenge Fund is for environmental projects. The projects are to be led and delivered by community groups and must make a significant difference to the local environment and be widely supported within the community.

What Kind of Projects Will be Supported?

Projects which can demonstrate any of the following are a priority for support:
● ‘Spend to save’, eg changing bedding plants to herbaceous plants to save on maintenance and
materials.
● Physical environmental improvement projects which reduce waste, reduce carbon, increase reuse and recycling or use
environmentally-friendly materials.
● Enhance/contribute to the local economy such as tourism or craft or use of local materials.
● Benefits to the wider community encompassing a range of age groups and abilities.
● Link to other existing or planned regeneration initiatives (eg conservation area appraisals).
● An ability to complete the project within 12 months.
● Demonstrate environmental sustainability, eg carbon reduction.
In addition, there is a requirement for a long-term maintenance commitment for any projects undertaken through the Fund.

Co-option. Graham has now been approved by the Council, and the CC now formally adopt him.

Community Policing: Report received too late for meeting, but abbreviated comments added for information.
Full report is available in correspondence. Theft from insecure motor vehicle – Under investigation. Front Counter Service Provision previously discussed and being taken up by local councillors.

Minutes of the previous meeting: There was an amendment. The meeting discussed the wind turbine application of Hilton of Aldie stating that it was outside the CC area. It is, in fact, within our area. There was also discussion and clarification of the CC’s position on wind turbine applications.

Matters arising:
• Glendevon / Rumbling Bridge Hydro Scheme: on-going
• Blairingone War Memorial: Cllr M Barnacle has been given an assurance that the memorial will be moved in Spring 2014. It should be well established in its new position for Remembrance 2014.
• Crook of Devon Church Car Park: on-going
• Travellers’ Site at Crook Moss, Crook of Devon: The application was approved with a number of conditions with timescales for their implementation. The process now moves from planning to enforcement. The enforcement officer has to check on progress and if they think it appropriate they can extend the timescales for implementation. In any event a notice of enforcement has to be issued and the recipient has 28 days to comply. There was considerable discussion on this item and a general feeling from those present that the council did not have a good record on robust enforcement.
Councillor Giacopazzi clarified his position and stated he had not voted for approval. There had been no vote taken as there was no motion to reject the application. All the other Ward 8 councillors were barred from voting, and therefore he had no one to second a motion as the mood of the rest of the DMC was to support the officials recommendation.
• Glenquey Quarry: There was still no information on why the application had been pulled from the last DMC meeting.

CC Business: Alastair reported on the KCCN re the Loch Leven catchment. There were 2 communications from MoP. One communication was regarding the excessive generator noise, and the other stating that development work, not covered by the planning permission, was taking place at the site.

Community Workshops: Details of the dates for the workshops in Powmill and Blairingone will follow when available.

Community Speed Watch: on-going. Willie is trying to find funding for someone to take on the paperwork.

Bus Investment Fund: The application has been approved.

Walkmill Play Park: The CC submitted a form to the council with suggestions. It is hoped that interested parties such as the PTA, Village Hall, Toddler’s Group etc, could get together to discuss funding and improvements.

Meetings Attended: KCCN. Alastair reported on the removal of section 75 in the Loch Leven catchment area. He also reported on the possible non-conventional gas extraction and the exploitable deep coal extraction in the Loch Leven area. The AGLV policies are to finish in February.
T in the Park didn’t sell out this year, so next year the organisers have requested an extension to the Saturday licence to accommodate a famous headline act until 1 0’clock in the morning. There are 21 days for consultation but it was agreed that the CC should not object.
Angus reported on the Kinross-shire Fund. It has, over the years, shrunk from £40,000 to £15.000 which is insufficient considering the adverse effect that T in the Park has on local businesses.
Sandy reported on the planning user’s forum. PKC intended to accept the reporter’s findings on the LDP. A notice of attention to adopt the plan will be published on 06/01/14. The current policy on LGV’s will fall in February : New supplementary guidance including maps will be issued in May 2014. The reporter had put in a new policy PM4 to replace policy 48 which PKC had taken out. Enforcement was also discussed extensively and Fossoway stated it had no faith in the council enforcing conditions, particularly in relation to the traveller’s site. Other CC’s also felt enforcement was not followed up robustly.
Angus attended the Kinross-shire Fund meeting, and reported on the reduced contribution from T in the Park. It was generally felt that this reduction did not appear to be fair or justified considering the amount income generated by DF Concerts.

PKC Councillors’ reports:
Cllr. J Giacopazzi: Joe updated the CC on the implications of unconventional gas extraction from coal deposits and the protest in Airth. It appears that the extraction of coal bed methane by pumping water would produce minimal visual impact, and SEPA had policies in place for the disposal of contaminated water. It was suggested that the CC should be vigilant in examining any applications. The CC also felt that the council should have an overall policy in order to eliminate piecemeal development.
Cllr D Cuthbert: Dave commented on a possible under-spend of the council. Even allowing for the headroom/carry forward policy, there could be additional money. This money could well be used for mitigation measures on the A977 or for planning resources. Dave also reported on the Local Christmas Market in Kinross which was well attended.
Cllr M Barnacle: Mike suggested that the CC should not seek to make any changes to the local plan and accept what the reported had said. The overall package seemed reasonable and was in accordance with the majority views of the community. Mike also stated he would like to see more money spent on the A977. He is also going to attend a meeting in the Village Hall to discuss local paths and their maintenance.
Cllr W Robertson: Willie has written to Keith Brown seeking an upgrade to the junction 7 on the M90 to give full access to the motorway in both directions. After vigorous discussion it was agreed that the CC should write in support of this proposal.

Planning: Kevin reported on the Kincardine to Blairingone overhead power line upgrade. Although it is expected to provide little visual impact, it is hoped that reinstatement of any damage to fields will be forthcoming, and the CC would write to the appropriate body to ask them to commit to reasonable reinstatement.
Ken Thompson is lobbying PKC on the reporter’s decision to allow only 30 houses in Powmill. He feels this reduced number would not allow for infrastructure improvements.

AOCB: Trudy told the CC that the High School was planning a change to the school hours. They would have a longer day for 4 days and have a ½ day off. She also said that the library was going to shut on a Monday and earlier on a Saturday to save money. She feels the Monday closure was harmful to the school children who use the library. It was agreed that Monday closure to school children was not appropriate and the CC and local councillors would take this up with PKC.

East Coast 400kV Reinforcement Project (Blairingone to Kincardine)

Fossoway & District Community Council held a meeting on 6th December where several points were raised regarding the upgrade of this power line. The Community Council Secretary has been in touch with the company carrying out the works to seek clarification. The answers are provided below:

Question:
The Community Council reported at the meeting that the pylons were already suitable for 400kV transmission lines, and that they did not need replacing, only the insulators needed to be replaced. Several members of the public stated that this was not the case, and that pylons would also have to be upgraded. Can you clarify what the situation is please?

Answer:
I can confirm that the existing towers will remain in situ and will not require to be changed in either height or location. The only exception to this is within the Kincardine power station site where two existing towers are to be removed and replaced with a new terminal tower to tie the line into the proposed substation. The existing towers on the remainder of the line are of a specification that can be used for either 275kV or 400kV lines.


Question:
The public were also very concerned about the mess that is made in fields etc. during the period when this work is being carried out. Can you let us know what assurance you can give that the land will be reinstated to a reasonable level?

Answer:
Access to towers and the working area around each tower are the most susceptible to ground disturbance during the works. To what degree these areas are disturbed is obviously dependent on local ground conditions and the weather conditions at the time the work is undertaken however this can be mitigated by planning the timing of the work and agreeing the most appropriate access routes with affected landowners. In addition, the contractor responsible for undertaking the work will be required to work to an agreed construction method statement and environmental management plan that governs the mitigation required to avoid, reduce and offset disturbance to people and the environment during the works. Reinstatement work will be agreed with landowners/stakeholders (such as local authorities) and undertaken by the contractor following completion of the work.


Question:
Are the landowners compensated at all for any inconvenience and loss of business during the period when the work is being carried out?

Answer:
Affected landowners will be compensated for any losses sustained as a result of our work. The Wayleave Officer will have initial discussions with all landowners involved to inform them of the overall proposal and to agree access routes etc. over their respective land. On completion of the project the Wayleave Officer will then arrange a further meeting with the landowners to discuss and agree the level of compensation. Should any planned outages, that would affect any electricity supplies to individual properties, be required as part of these works then residents would be formally notified of the time and duration of these works in advance.
