The Plan

The Local Development Plan proposes areas for new houses to be built, which is an important issue for Kinross-shire and Fossoway in particular because there is a lot of pressure to allow many new houses to be built in the area. In fact there are numerous examples of inappropriate development taking place in recent years, resulting in detriment to the area.

You may already know that Perth and Kinross Council have recently published a draft Local Development Plan, which has been the subject of discussion at a series of well-attended local meetings. This plan is now available for consultation, click here to view on the PKC website. Key Points to Note

  1. Deer Farm on Naemoor Road: If you support the decision of the Council to reject development at the site of the Deer Farm on Naemoor Road on the edge of Crook of Devon (this is currently designated as outside the village boundary and therefore not earmarked for housing) then you must say so in your response to the Council. If you don't, you can be sure that G S Brown will seek to overturn this proposal so they can build houses on that field as well as the surrounding fields on the opposite side of Naemoor Road, which they also own.
  2. Overdevelopment of Crook of Devon: The Crook of Devon has been overdeveloped. The Naemoor Road site requires an expensive and obtrusive bridge onto the A977 at a dangerous point. The building of a bridge to access the site would open up all of the fields owned by G S Brown for development, which would see the village turned into a small town. There is also the prospect of increased risk of pollution in the River Devon.
  3. Expansion of Fossoway School: There is no significant new housing proposed for Crook of Devon but 120 houses are proposed for Powmill (paragraph 7.1.14.). The school at Fossoway is to be expanded to accommodate this new housing (paragraph 7.1.16).
  4. Waulkmill and other Playparks: There is an open space retention policy which may have implications for Waulkmill/other playparks (paragraph 3.7.5).
  5. Gypsy/Travellers' Sites: There is a policy on gypsy/travellers' sites (paragraph 3.5.9)
  6. Powerful Housebuilders' Lobby: Although there are now not any proposals for significant housing in Crook of Devon, the house builders will be putting their view to the contrary. And they will get their way unless local residents speak out in opposition.
  7. Lack of Supporting Infrastructure: There is no sufficient infrastructure to cope with a large increase in village population for schools, medical cover (doctors, dentists, etc), etc

Crook of Devon Community Speed Watch Pilot

For many motorists the sight of a yellow jacket and a speed detector is an uncomfortable one, even when they are driving within the speed limit. Soon, a group of volunteers clad in high-viz jackets will join Tayside Police in the drive to get Scotland’s roads safer; the Community Speed Watch Pilot will start in Crook of Devon on 13 April 2012.

Crook of Devon is one of the communities along the A977 (Kincardine to Kinross), a road that has seen a considerable increase in traffic since the opening of the Clackmannan Bridge. The community has campaigned for mitigation measures along the route but it has proven very difficult to get the traffic to slow down.

‘We live on the Main Street, along the A977 and have noticed this increase,’

says Maxine Gray, one of the volunteers.

‘When bringing our children to school, we are very aware of the vehicles, heavy lorries among them, and there is so little to separate the traffic from the pedestrians.’

A sentiment echoed by Victoria Sutherland, whose young son was hit by a car when crossing at the pedestrian crossing.

‘It was a miracle he escaped with only minor injuries, but you cannot expect miracles all the time. There have been several bad accidents along this route in the last few years.’

Trudy Duffy-Wigman, secretary of Fossoway and District Community council explains:

‘We’ve got a group of 13 volunteers together, who were vetted and trained to a high standard by Tayside Police. We follow the same protocol as officers from Tayside Police. Our primary aim is not give out speed tickets; it is to make people aware that this is our community they are passing through. All of us have been guilty by going on the auto-pilot and then realising we were doing 38mph in a 30mph area. We want to raise awareness of speed restrictions so that we can all live in a safer community.’

If the three-month pilot is successful, the group may try to raise funds to obtain their own speed-detecting equipment to continue with the project, rolling it out over other villages.

When the volunteers take to the road, they do so with the support of Tayside Police, who will also be monitoring the results. Inspector Emma Bowman of Tayside Police:

‘Community Speed Watch is a scheme that has seen much success south of the border and allows communities to take control of one of the issues that commonly affects quality of life and safety i.e. speeding motorists. For years now there has been a speeding problem in the villages along the A977, and although Tayside Police along with the Tayside Safety Camera Partnership regularly enforces the limits, officers cannot be present as often as they would like. It is a known fact that an increase in speed increases the dangers for road users, and often those responsible for speeding are not doing it deliberately but have either failed to observe a speed limit sign or have not really been paying attention to their speed. Initial monitoring suggests that almost 41% of vehicles travelling through Crook of Devon do so in excess of the 30mph speed limit. Of these a disproportionate number of those are drivers of small commercial vehicles. The presence of volunteers in their high visibility clothing provides a gentle reminder of the speed limit causing the driver to adjust their speed accordingly. All volunteers are trained to Police standards on type approved equipment which is correctly maintained and calibrated, and the Road Policing Unit in Perth will be looking out for patterns of repeat offending and acting upon it. The scheme will run for three months during and after which we will assess the speeds and ascertain if there has been a significant speed reduction. It is hoped that if the scheme is successful it can be rolled out elsewhere across Tayside.’

Rod Paterson, traffic specialist of Fossoway and District Community Council:

‘Volunteers will monitor traffic speeds at various times of the day and week; motorists who choose to ignore the existing speed limit and the additional advance warning signs that will be in place will be at risk of being reported to the Police, and will receive a warning letter through the post. Several warning letters or excessive and dangerous speed may result in more serious action being taken by the Police. All information passed to the Police will be shared with other agencies as would be the normal case, including the DVLA and VOSA (the latter for Large Goods Vehicles). For the Community and volunteers it is more however about trying to change motorist’s attitudes when driving through all the communities along the A977 and A91 in the area; respecting our speed limits and the reasons why speed limits are in place in our village communities and beyond.’

The pilot will start on Friday 13 April and will continue for three months.

Minutes of Meeting Carnbo Village Hall
Tuesday 3 April 2012

Apologies: R Paterson, S Anderson.

2. Declarations of Interest: There were no declarations of interest.

3. Community Policing:
Officer not present but report sent.
• There had been an increase in the number of bogus callers
• No calls had been received regarding the occupancy of the caravans at the Crook Moss
• Smart Water – Trudy has contacted Victoria Riches regarding this matter, short explanation followed. Anyone interested, please get in touch.
• Cheap alarms can be obtained via the police

4. Minutes of the Last Meeting:
Mr Carmichael felt his point that the planning consent was only for 15 children at Seamab should be recorded. The Chair pointed out that the minutes recorded that the numbers stated were in accordance with the planning consent as reported by Joanna McCready. However, the minutes were adjusted to record Mr Carmichael’s point.

5. Progress on Matters Arising:
a. Blairingone War Memorial: Sheila had received correspondence rejecting the planning application until various items such as land ownership certificate etc were received. Cllr Barnacle had understood that J McCrone was assisting with this matter and would follow it up.
b. Community Speed Watch Programme: Training had taken place and the programme would commence in early April. It was hoped this would result in a significant reduction in the speed of the vehicles through Drum and Crook of Devon. Cllr Robertson said other areas are very interested in this project and it could be a subject for Kinross-shire CC Group to discuss.
c. Crook of Devon Car Park: The matter is still with the church authorities.
d. Olympic Flame: It will be coming through Crook of Devon early on the morning of 13 June.
e. Local Development Plan: The CC had put forms in the shop and garage at Crook of Devon for people to sign if they agreed with the plan for Crook of Devon or individuals could write or register their views on-line. Another group which was opposed to the Monarch Deer Farm Development had also submitted forms and collected 160 signatures supporting the Crook of Devon Plan. Cllr Barnacle had held meetings in Powmill, Fossoway and Blairingone and the Strategy Group had met on 29 March. The CC recorded its thanks to Cllr Barnacle for the considerable work he had done in informing the community about these matters. The CC would be sending in comments by 10 April and all residents were urged to send in whatever comments they had by that date.
f. Gartwinzean Fire: A letter had been received from the Fire Authority stating that the water pressure was normal and would have been adequate to deal with a hotel or care home. If the building had been in use there would have been fire doors etc which would have delayed the spread of the fire. The letter was on the table with the correspondence.

6. Community Council Business
A Cheape attended the Kinross-shire Partnership. Note change of date for June meeting to 12 June.

7. PKC Business – Councillors’ Reports
Cllr Barnacle reported regarding the Carnbo Post Box. There was lengthy discussion on this item as people had received different answers from the Post Office. Cllr Barnacle will follow up. He also gave a brief report on his meetings regarding the local plan and confirmed he would be submitting a detailed report to the Council. The” loop road” was discussed and the Chair stated that Ms Robinson was taking the matter up with a view to putting a weight restriction on the road.

Cllr Robertson reported on the LDP, saying there should be more houses at Blairingone and less at Powmill. He congratulated the community on its efforts regarding Dunning Glen. He reported that a decision on the Glendevon Quarry had been deferred and would be considered again after the elections.

8. Planning Matters

12/00546/FLL. Formation of five permanent gypsy/traveller pitches (partly in restrospect). Land 300 Metres South East Of Fossoway Garage Fossoway. Recommendation: Object as contrary to Policy 81of the Kinross Area Plan and Policies RD5a, d, f of the proposed PKC Local Development Plan.
12/00553/IPL . Erection of a dwellinghouse and garage (in principle). Craigielin, 14 Gartwhinzean Loan Powmill Dollar FK14 7LU. Recommendation: No Community Council comment.

There was considerable discussion on 12/00546/FLL and the following points were made:
• The site was outwith the current and proposed Village Plan
• It was wholly in retrospect
• There were now 7 caravans, not 5
• There were other sites locally
It was agreed there should be a special meeting of the CC to discuss this item and a representative of the Planning Department should be asked to attend. The meeting was subsequently arranged for 7.30pm on Thursday 12 April in the Village Institute, Crook of Devon.

9. Correspondence
All outgoing and incoming mail was available for viewing.

10. AOCB
Questions were raised regarding Rights of Way and Core Paths. Rights of Way do not need to be signposted but Core Paths are signposted. Does there need to be an agreement with the landowner where signs are put? Kathleen will deal with this matter. The number of potholes on the Gelvan Road was raised. Willie will take this up.

Kevin reported that the sign had been erected in Dunning Glen.

Member of the public asked if the speed warning signs on the A977 were now all activated. Mike to investigate.

Minutes of Meeting Mowbray Hall, Powmill.
Tuesday 1st May 2012

2. Declarations of interest:
There were no declarations of interest.

3. Community Policing-
The police are continuing their speed checks and it was hoped that a safety camera might be able to be used in Drum, but this is not possible due to poor sight lines. A bus stop is not considered a suitable site.
If the public have any information about any potential protest during the Olympic flame run through Crook of Devon, could they please contact the police.

4. Minutes of the last meeting –
There were no amendments so the minutes were signed off. A member of the public was concerned about the number of pupils at Seamab School. Stating that according to planning consent there should only be a maximum of 15 children in the school at any given time. Cllr. K Baird said she would investigate the situation.

5. Matters Arising:

- War Memorial, Blairingone
There has been helpful correspondence from the council and OS maps of the site have been obtained. A Lavery will make the planning application to obtain planning permission to move the war memorial.

-Community Speed Watch
This is proving very useful and there has been a noticeable slowing down of vehicles through Crook of Devon. The project will be monitored by the police and if it is a success, equipment may be purchased by the community, and checks could be carried out throughout the Fossoway area. The aim of the project is not catch people speeding, but to change their behaviour, and to observe the speed limits.

-Olympic Flame
The Flame will pass through Crook of Devon at 8.15 am. 13th June. The runner will start in Drum.

-Crook of Devon Church Car Park
Plans are progressing, and the church has provided a cheque for the planning application. The CC will submit the application. People are invited to register their support, once the planning application has been lodged.

-Tayside and Local Development Plans
The date for comment has passed. Local meetings run by Mike Barnacle were by and large well attended and appreciated. Thanks to Mike Barnacle. The results of the consultation are due in Sept.-Oct.

-Core Path signposting
There was concern that landowners should be consulted about signage and it is hoped that David Stubbs would contact them. Requests may be made for new gates. The council will try to maintain the signs, but this will be subject to budget constraints.
-Travellers’ Site
There were 44 objections to the site and the application is due to be heard by 27th May.

6. Community Council Business-
Kevin attended the Outdoor Access Forum in Crieff. The main topic of the meeting was the core path network. Areas of success were discussed, such as the Loch Leven path. Types, and styles of gates were also mentioned, one example being a large field gates, with a smaller public access gate contained within it.

7. PKC Business, Councillor’s Report –
K Baird reported that the councillors had all been very busy owing to the local elections.
She also stated that in general the Local Plan was favourably received by the public.

8. Planning Applications
12/00564/FLL.
Alterations and sub-division of existing house to form 2 dwellings.
Schiehallion, Crook Of Devon, Kinross, KY13 0UL.
Recommendation. No Community Council comment.

12/00655/IPL. Residential development (in principle). Former Church, Main Street, Blairingone.
12/00654/FLL. Erection of triple garage with ancillary accommodation above.
Recommendation. Refusal as contrary to the Kinross Area Local Plan and the proposed Local Development Plan as outwith a settlement boundary and not fitting with any of the Houses in the Countryside policy categories.

9. General Correspondence –All outgoing and incoming correspondence was available for viewing.

10. A.O.C.B –
As the next meeting is to be held in Blairingone, it is hoped that someone from the Forestry can attend to update the residents on the Lambhill Forest development.
Rod Paterson brought to the meetings attention that the length of time between uplifts of brown bins over the Christmas period was too long because of excessive food waste at that time of the year. Clarification was sough as to whether food waste could be put in the green bin.

Minutes of AGM

2. Minutes: Minutes of the 2011 AGM meeting were read, approved, and signed off.

3. Chair’s Report:
Perth and Kinross Council produced a Scheme of Establishment of Community Councils in the Perth and Kinross Council Area to implement the Scottish Government’s proposals regarding Community Councils. The Scheme included a Constitution for Community Councils, Standing Orders and a Code of Conduct for Community Councillors.

This meant elections had to be held in November and a new Community Council was formed in December. There were five nominations for eight places but two existing Councillors were co-opted. They had been unable to be nominated because they were on holiday when nomination forms were issued. These had to be signed by the person being nominated and this was not possible in their case.

The elected members of the Community Council are as follows:-
• Trudy Duffy-Wigman
• Rod Paterson
• Kevin Borthwick
• Alistair Lavery
• Sandy Morrison

The co-opted members are:-
• Sheila Anderson
• Angus Cheape

The main changes in the new constitution are:-
• Councillors are elected for a four year term
• All Community Councils have their AGM in May
• The financial year is 1 April to 31 March
• Elections for all Community Council’s take place in November and are organised by Perth & Kinross Council

The Community Council has had a very busy period and has been involved in a number of issues:-

• Blairingone War Memorial now progressing with some assistance from PKC staff

• Fossoway Church Car Park progressing slowly through Church procedures. Good assistance has been provided by PKC Planning Department

• Dunning Glen clean up achieved and sign erected. Thanks to Kevin for all of his efforts.

• Local Development Plan – The CC has been involved in the Strategy Group and has assisted Councillor Barnacle with his meetings. Many thanks to him for his considerable efforts to provide information on these matters and engage with the community. The CC also organised forms for residents to sign if they agreed with the village plan for Crook of Devon.

• Community Speed Watch Programme has been introduced and is strongly supported by the CC, because there have been a number of serious accidents recently in Crook of Devon and Drum.

• Crook Moss Planning Application for a travellers’ site. The CC has been very active on this issue and has responded to community concerns by holding a special meeting of the CC. The issues were explained along with how and on what grounds individuals can object to the application if they so wish. A detailed objection has been lodged by the CC.

Apart from these specific issues, there have been numerous planning applications to consider, presentations by developers and a significant number of meetings to attend. These have included the T in the Park Forum, the Kinross-shire Forum, Kinross-shire CC Network, Outdoor Access Forum etc.

I wish to record my thanks to my fellow councillors for their support and the considerable efforts they have made in attending external meetings and dealing with the areas they have accepted responsibility for. Thanks also to Councillors Barnacle, Baird and Robertson for their support in taking up issues raised by the CC.

4. Secretary’s Report:
Trudy gave a short verbal report on the paperwork involved in running the CC. She announced her resignation from the post of secretary due to work pressures, thanking the committee for all the support she had received.
Sandy thanked Trudy for all her hard work.

5. Treasurer’s Report:
Accounts were approved and signed off. The surplus for the year was £219.84 mainly due to reductions in the cost of hall lettings. The closing balance for the year after all payments had been made was £547.96.

6. Confirmation of Office Bearers:
The Office Bearers all resigned from their current posts, and all were happy to continue on the committee.

Minute of Special Meeting
Held at 7.03pm on Thursday 12 April 2012
in Crook of Devon Institute

Attending: S Morrison, A Lavery, K Borthwick, A Cheape, R Patterson, Cllr M Barnacle, 38 members of the public

The Chair opened the meeting and welcomed everyone to the Special Meeting which had been convened to consider one topic – Planning Application Number 12/00546/FUL.

The format of the meeting was as follows:

3. Cllr Barnacle to add his views and comment on the CC’s approach
4. Questions from the floor

1. Report by the Chair - Action to Date

The CC had sent an initial letter pointing out the site was outwith the Village Plan. The CC had now submitted a formal objection which Alistair would go over.

The CC had requested a member of Planning be present at the meeting but they had declined as it was not policy …. to enter into public discussions on a live application. The CC had accepted this position. However, Nick Brian had been helpful in finding out answers to some local questions:-

• The Council had not provided portaloos for the site.
• In the event that planning was given and children resided on the site, they would be treated the same as any other resident in terms of schooling, no priority being given.
• If permission was given the Council gives no guarantee on connection to mains drainage. This was a matter for Scottish Water. There was currently a queue to get onto the new Drum system. If they were not connected they would use Klargester Bio Disc Treatment Plant which would have to show a 125% net improvement.
The Council’s approach was to deal with this under the Planning process because if it was refused the appeal would be within the Council. Using other means would have meant involving external agencies.

The Council had reacted very promptly and had visited the site on the Monday after the people moved in at the weekend. The Chair thanked Cllr Robertson for his prompt assistance in the matter.

2. Planning Matters

Alistair explained that the CC had objected on a number of grounds. It was contrary to Policy 81 of the Kinross Area Plan and policies RD5 a,d,f of the proposed PKC Local Development Plan.

He went on to explain that the main grounds for objection were:-

1. It was outwith the settlement boundary both existing and proposed for Crook of Devon.
2. The site had previously been a village tip and was therefore liable to have contamination of various sorts.
3. Foul water – the Drum Treatment Plant currently has a waiting list. If a bio disc system is used it would have to show net gain which means other houses have to give up using plant or not proceed with applications. The fields on both sides flood and a cottage currently has to be sandbagged in periods of heavy rain because of water from this area. Even if foul water were connected there is still the question of surface water and extra flooding. The area is in Loch Leven catchment and this development would have an effect on water quality.
4. There are already sites at Greenacres and Gairneybridge and a Council one at Abernethy therefore any further provision would be excessive within such a short radius.
5. There is considerable visual impact on approaches from the north and east which comes under the policy on amenity and visibility.
6. Crook of Devon Moss is listed as a wildlife site by SNH.

There was considerable discussion on these items and a member of the public felt that if the water was treated there would be no real issue but this ignored the flood risk point.

3. Cllr Barnacle

Cllr Barnacle agreed with the summary of what had happened and the Planning points. He pointed out that it was a very professional application and would be difficult to deal with particularly as one of the people owned the site. He had taken up issues with the Council regarding Greenacres, in particular the way the site had grown. He was very concerned that these things started small but grew totally out of proportion and in some cases developed into actual houses.

There was further extensive discussion on all aspects and some other general points arose:-

1. There was considerable feeling that no-one whoever they were should be able to flout the Planning laws and commence development outwith permission
2. How had common land been transferred to private ownership? Did the Council who apparently sold it into private ownership have a title to the land? Did the Council consult all the local householders who had rights over the land before selling the land?
3. Why was there a policy of only counting one objection if there were two from the same household? The subsequent answer was that this only applied in the six objection rule for going to Committee – i.e. there are only 6 objections but if two were from the same household then only one would count. In all other cases the two objections would count.
4. Objections should not be made on the basis that the applicants were travellers. They should only be on valid planning matters.
5. The CC was asked why they did not supply a draft letter for people to use to object. The reply was that it was not the CC’s role to influence whether local people objected or no. It was up to individuals to decide themselves. The CC would of course represent the Community’s views in an appropriate manner.

Draft Minutes of Meeting at Blairingone Primary School

Tuesday 12th June 2012

1. Attending: S Morrison, A Lavery, S Anderson, K Borthwick, R Paterson, A Cheape, Cllr. M Barnacle, Cllr W Robertson, Cllr D Cuthbert & 14 Members of the Public (MoP).
Apologies: T Duffy-Wigman and Cllr Joe Giacopazzi.

3. Community Policing: Report received – No Police meetings will be held regarding T-in-the-Park so issues should be raised via this CC and hence to the T-i-t-P forum. MoP noted that most verges had been cut around Carnbo, but not on back roads used by locals to avoid closures. Sandy said that this had already been requested at the recent Forum Meeting. Cllr Robertson says that local farmers have asked for this too, and he has asked for more cutting to be done. Cllr. Barnacle reports that this issue was also raised at Kinross CC where T-i-t-P were present and they said that they were liaising with PKC.
Recent crimes: Motorbike stolen - under enquiry. Speed checks continue to be made on trunk roads.
Summer drink/drug drive campaign in force from 4th – 18th June, tax, etc., checks will also be made.

4. Minutes of the last meeting:
There were no amendments so the minutes were signed off.

5. Lambhill Forestry Development – Colin Peacock (Forestry Commission) reports: Things have been frustratingly slow, but are now on the move. Forestry plan is now in place and planting (by a contractor currently being appointed) is to start this year (hopefully in July.) There are a couple of areas where ground needs some remedial work. Some new (deer) fences will be erected and others removed as planting takes place. Current access is not ideal with machinery in use and unclear legal position – so discussions with Oran and Mr. Snowie taking place to establish new access by acquiring land or getting permission to cross it. Meanwhile gate has been installed for temporary access. MoP asks if access could be made opposite school, but again problems with land ownership. MoP asks about existing willows – They were planted by the previous owner but not subsequently cut at the right time, and not on right soil, so didn’t flourish and have been mostly removed. Colin will return again in October to update this meeting on progress.

6. Matters Arising:

War Memorial, Blairingone – Site meeting with developer 11th June where they have agreed to take over the entire application process to speed it up. Cllr. Barnacle had previously spoken to John McCrone on 8th June who had agreed to support this CC’s application.

Community Speed Watch – Rod reports: This is on-going, but disappointingly the number of offenders is not reducing, including some very excessive speeds. Ultimately some permanent engineering solution will be required. Hope to continue activity until after T-i-t-P. It’s been worthwhile but it needs a large number of trained volunteers. MoP wonders why PKC didn’t install signs that show actual speed. Cllr. Barnacle opines that the reason is likely that they would have been more expensive.

Olympic Flame - The Flame will pass through Crook of Devon from 8.39 am. 13th June. The runner will start in Drum. Police advise that the road will be closed about ten minutes before the torch arrives.

Crook of Devon Car Park – Map now acquired, so application will be submitted this week.

Travellers’ Site, Crook of Devon – Briefing note from PKC Planning (Nick Brian) available: SEPA would object if not on main drains; note says that Scottish Water would connect to Glendevon system, however in fact it would need to connect to Drum system which does not take surface water and was specifically installed to deal with environmental problems at Loch Leven. Cllr. Barnacle reports that Scottish Water has not received an application to connect;
Why was hardstanding created if landowner only intends to keeps horses on land?; Concern over Planning Department receiving pressure about not discriminating which would cause the application to be referred to Scottish Government; There’s no clear policy on locations for traveller sites, so they appear at random. There are already two sites at Gairneybridge and Greenacres within 6 miles of Crook Moss, which are more than adequate to deal with local families. MoP stated that the applicants for Crook Moss were not local families.
MoP reports that generators are running on the site until late at night – not yet reported to Environment Services. Cllr Robertson says that Environmental Services have not received any noise complaints – residents must report these to PKC hotline at once.
Mop asked the question “where was grey water and surface from roofs etc. currently going” and also where was the waste from current port-a-loos being processed.
Cllr Cuthbert suggests that the issue of possible contamination on the land (since it was previously used as a dump) be raised with Environment Services in order that they might rule the land is not suitable for habitation.
This CC will write to PKC again to clarify all these issues. Meanwhile the CC encourages everyone to write to PKC and their MSP with any comments.

Core Path and Rights of Way Signposting – Cllr. Barnacle reports that there will be an initiative in September to sign any core paths not already signed. MoP asks whether these signs can be erected on private land – Cllr Robertson suggests that there will be consultation with landowners in that case – MoP says that in some cases there hasn’t even been contact with the landowners about the paths being defined – Cllr. Barnacle agrees to look into this.

7. Community Council Business: Angus attended the Kinross-shire Fund Meeting on 30th May, where purchase of laptops was discussed.
Sandy and Kevin went to the meeting of the Convention of Perth and Kinross Community Councils. The organisation continues to struggle for membership and office bearers. Fossoway CC continues to believe the organisation should be wound up but will assess the position when current membership is known.
At the T-i-t-P Liaison Meeting: Usual time for fireworks, curfews on noise will be imposed and sound level will be adjusted if needed; Local phone number (898091) will be used for complaints this year. MoP asks whether the pipeline across the site will restrict the future of site - although its location is currently restricting how some areas are used, there is a licence for at least another two years.
Sandy attended Planning User’s Forum: Section 75 agreements will in future be made public; Landscape plans must be included at start of application rather than being supplied later; Gypsy and Renewable Energy sites will be discussed in future meetings of this forum.
Sheila and Angus need to be “properly” co-opted as CC members as they were on holiday when normal elections were held.

8. PKC Business, Councillor’s Reports:
Cllr Barnacle is pursuing issue of resident’s only access to Drum. Four applications have been made for “green” roads – more friendly to cyclists; Carnbo Post Box replacement is on-going; Passing places on road near Blairingone to be chased; Rural Scotland AGM attended and this CC should consider joining this organisation as it could be very useful; Cold callers seem to be increasing, can Cold Caller ban be implemented as a part of Neighbourhood Watch? – Cllr Robertson says that anyone receiving a cold caller who won’t go away or is aggressive should call Police at once.
Cllr Robertson: there is a proposal to make Planning Applications pay for themselves, which might quadruple initial costs, and remove free re-applications.

Snowie Site in Blairingone: Currently running bio-mass site with permission for agricultural use, however a large stockpile of building waste timber, which could be chemically contaminated, is forming on the site. If this timber was to be mixed with forestry timber then chipping could release contaminants into atmosphere. An application for change of use to industrial processing has been submitted, but this was rejected due to incomplete data, and is still outstanding – how long will this continue? MoP suggests that in fact the building waste is currently just being stored and is not actually being processed yet. A further concern is that a change to an industrial use would then be a small step away from the site becoming a Combined Heat and Power installation. Additionally, the plant’s chipping machinery has been heard running both early in the morning and at 22:15 – this has been raised with PKC Environmental Services who have been to the site.

11. A.O.C.B:
Millennium Walk – Countryside Ranger had contacted Sandy with regard to the notice board at Harelaw entrance – Agreed removal. Also the picnic table at the bridge end of the gorge – Agreed retaining it and having it refurbished.

Matters arising:
• Blairingone War Memorial will be dealt under planning
• Community Speed Watch: the pilot has now ended. We await the evaluation of Tayside Police.
• Olympic Flame: the passing through of the flame in Crook of Devon was very successful by all accounts. Many thanks to Hayley Richard, the Powmill Milk Bar, Caroline Watson and all others for providing funding, balloons, pipers and for turning out. A day to remember.
• Crook of Devon Church Car Park: the CC has put in a planning application for this.
• Core Paths and right of way sign posting: MB has contacted Dave Stubbs to ensure that landowners and other s will be consulted when signage is considered. A short discussion followed in which several members of the public from the farming community stressed their discontent about the process of deciding on core paths. Members of the general public do not realise how dangerous cattle can be when spooked. When farmers are displaying warning signs they get rapped on the knuckles but they feel strongly that there are issues with warning the general public at certain times of the year. WR stresses that it is important to keep writing to MSPs to keep this issue in the awareness.

T-in-the-Park:
Local people are still not happy with the way the verges are cut just prior to T-in-the-Park. There was a promise that back roads would be cleared for reasons of safety but that has not happened everywhere.
There has been at least one incident, possibly more, where a young person was found lost. There does not seem to be an agreed procedure what to do- T-in-the-Park stewards handed this over to the police who were helpful but inefficient. This problem is exacerbated by the existence of external campsites. Perhaps a dedicated phone line for missing persons could be set up?
The Sunday the week after T-in-the-Park tents were flying across the motorway. Police were trying to catch them and it was a dangerous situation.

Councillors’ reports:
MB:
• Investigating Drum traffic calming and access only road; all would have to agree on this.
• Loop road perhaps under the Green Roads initiative?
• Carnbo Post box: no real progress yet.
• Passing places on the road to the Blairingone Equestrian centre: no progress, officer in charge ill.
• Gelvan Bridge has damaged parapet, will be dealt with.
• Is there any representation regarding the Brown Bin collection?

WR:
• Is worried about visibility and road safety: verge cutting is not optimal and drains are getting silted up. Urges everyone to cut overhanging hedges.
• Is worried that conditions set on the planning for the travellers’ site in Crook Moss cannot be enforced. Will try to address Development Committee next time they convene.
DC:
Has asked convener to meet to go through the report.

Followed short discussion on travellers’ site. There is general discontent amongst the elected members of this area that their objections and representations are largely ignored. The report presented to the development committee was full of mistakes and omissions. AL reported that planning did not mention that they could not connect to sewage system; did not prove need; reluctantly agreed site was adjacent to village boundary; did not accept flood risk, agreed that normally they would only accept port-a-loos for a few weeks while the convenor pointed out they had been there for about 5 months; it was at the discretion of the Planning department. It was in his view a very poor report riddled with inaccuracies. After the meeting the person responsible for determining need was in deep conversation with the travellers’ representative in the council building for at least 10 minutes.
Councillors on the Committee were not informed that Scottish Water stated that there was no capacity to connect this site to the sewer; figures to prove that there was an established need for another site were not forthcoming and there was worry about procedural aspects of the process. Gordon Banks has been very helpful. The only way open is to organise a meeting at top level to express our discontent with the way all this has been handled. Also W Robertson stated that he had not yet come to a definite conclusion on the matter and he required further clarification on a number of points. Sandy thanked the elected members for their hard work.

Matters arising:
• Blairingone War Memorial: Alastair reports that it’s still with the planners.
• Crook of Devon Church Car Park: Alastair reports that the planning application has been submitted, initially the planners said that they would be rejecting under delegated powers, however once they realised it was land belonging to council it will be discussed at meeting on 26th September with a recommendation from the planners for approval.
• Travellers’ Site Crook of Devon: to be discussed later this meeting – see below.
• Signposting Core Paths and Rights of Way: Several members of the public report that they have still not been notified that signs are due to be erected on their land. This CC has exhausted all methods of objection, so escalating to individual’s MP/MSP would be the next step - both Councillors present ask to be informed of any problems.
• Snowie Wood Chip Plant at Blairingone: Sheila passes on message from Alan Kinloch who suggests that a breach order should have been issued by now; item was on last planning meeting agenda, but not discussed, due for September meeting.
• Co-Option of CC Members: Kevin reports that procedure we followed wasn’t acceptable to PKC, so Sheila and Angus were required to fill in the normal forms used for election – this has been done and PKC now approve their membership of this CC. Sandy suggests that this could have been avoided if PKC allowed more time prior to elections to submit applications.

CC business: Meetings attended: Convention of Perth and Kinross Community Councils: Sandy and Kevin attended a meeting of this council, which is becoming increasingly poorly attended.

Councillors’ reports:
Cllr Giacopazzi: Crook Moss – will be speaking at the planning meeting.
Cllr Cuthbert: Nothing to report.

Crook Moss: The community mandated the community council to raise a formal complaint regarding the content of the Report of Handling on planning application 12/00546/FLL, and to write to Mr Littlejohn regarding the communities concerns over his department handling of this application, and the lack of engagement with the community over the issues that had been raised by members of the community and the community council.
The contents of the formal complaint were in regard to four significant errors which would mislead the Development Management Committee. These Were….
1. Failing to mention that the site is immediately out with the settlement boundary, and therefore Policy 48 applies.
2. It states no objections from statutory environmental consultees; When there was an objection from SEPA.
3. Miscalculation of existing travellers sites within the area of Kinross-shire.
4. Omission of key paragraphs in the national policy for gypsy/traveller sites.
There was extensive discussion on the content of the letter to Mr Littlejohn and eventually 12 items were agreed for inclusion. It was also agreed that copies of the letter and formal complaint should be sent to the area MP and area MSP, the four local councillors, the convener and vice convener of the Development Management Committee.
The Chair reported that he had spoken to SEPA and was re-assured that their objection stood, and they would ensure that all their concerns were addressed. He had also spoken to PKC’s environmental dep. Who stated that they could only make recommendations, and it was up to planning to decide whether to include their recommendations in planning conditions. It was then the responsibility of planning to enforce these conditions. The Chair thanked the community for its support and assistance in bringing forward points for the letter.

Community policing:
Community police officer reports: Speeding checks at Carnbo and Rumbling Bridge have resulted in offences being detected; No further reports of problems at Seamab; House break-in at Blairingone – red diesel stolen - being investigated. Operation Tupelo detected 40 driving offences (mainly speeding and mobile phone use); Community Tasking and Co-ordination Groups (CTAC) have been established in various areas in Perth and Kinross to enable PKC, Police, Fire and Rescue to work jointly; Community Officers are all now live on Twitter – please feel free to “follow” them! Discussion about whether there are adequate 30mph signs on entry to Rumbling Bridge from Naemoor Road – Cllr Barnacle will ask Roads department to investigate. No news yet about Community Speed Check programme.

Minutes of the previous meeting: There were no amendments so the minutes were signed off.

Matters arising:
• Blairingone War Memorial: Alastair reports that the application is being processed. Cllr Barnacle will check its progress.
• Crook of Devon Church Car Park: Alastair reports that it has gone to the Committee last week and was passed. Cllr Barnacle reports that there was discussion about maintenance of access lane, and it was agreed that a height restricting barrier would be installed. It would probably be appropriate to erect a “no overnight parking” sign.
• Signposting Core Paths and Rights of Way: Cllr Cuthbert has asked Dave Stubbs to progress, no news.
• Snowie Wood Chip Plant at Blairingone: Alastair reports that Blairingone residents have written objecting to the scale of the development. The application is still being processed as a normal, not a large scale application. Cllr Barnacle reports that because the Planning department see the two applications as separate, then it isn’t treated as a major application. Cllr Barnacle suggests that the Councillors approach the Planning Department and recommend that the two applications should be combined.
• Travellers’ Site Crook of Devon: Sandy reports that the formal complaint and letter have been submitted. As yet, no acknowledgements have been received, although Sandy was told that they had been sent. It appears that the letters were treated as comments on a planning application rather than a complaint. Sandy has now received email copies of the responses, although they have still not been received as letters. An article has been published by The Courier based on letters sent and received.
• There were extensive discussions about the PKC planning process between the CC, Councillors and MoP present following the reports of the above planning applications. The process by which objection letters were selected for inclusion in the report to Committee seems to be particularly unclear – the meeting assumed there must be some discussion amongst the planners to achieve this – is it recorded? A MoP present who had submitted a Freedom of Information Request about a previous planning application reported that very little information was received – are internal memos and emails kept? It was generally agreed that there was substantial dissatisfaction with the PKC Planning Process.
• Catering Kiosk at Powmill application has been passed – Considerable concern was raised by the Community about the significant road traffic risks created by use of this site.

CC Business: No Meetings attended this month.

Councillors’ reports:
Cllr Cuthbert: No plans to dispose of Crook of Devon Football Pitch; Rumbling Bridge and Balado speed warning signs are now fixed; Reporting Crook Moss contaminated land to Environmental Services has not resulted in any action.
Cllr Giacopazzi: Glendevon Quarry proposal has been deferred until November due to views from adjoining councils, road traffic, and environmental issues – further reports to be prepared.
Cllr Barnacle: U213 Passing places – sent letter of complaint to Jim Valentine about the attitude of Engineer – Also mentioned repairs to same road to alleviate flooding, which were deferred due to road closure; Rumbling Bridge – Thomson Houses development planning application was deferred to resolve issue about affordable housing; Neighbour Notification (Cllr Robertson progressing) – no movement on the 20 metre rule, however possible changes to guidelines for Wind Farm notification may happen. Cllr Giacopazzi notes that the rule that only one comment may be made per household could be rescinded; it appears that consultations by Communities about Local Plan are not going to have much effect.

12/01743/FLL. Variation of condition 1 (08/00574/FLL Erection of three dwelling houses), Land to the North of Main Street Blairingone. This application is for a one year extension to the time period of 08/00574/FLL, 3 houses North of Main Street Blairingone. This site has a long planning history, from 2000, with permission granted in 2008. The CC did not object at the time and its recommendations were included in the approved plan.
Recommendation: No Community Council comment

“The Witches Maze” at Tullibole Castle, Kinross which commemorates 11 innocent people Strangled and burned after the Crook of Devon Witch Trials in 1662 – 350 years ago.

The unveiling will be done by Lord Moncreiff who is responsible for the maze and Lesley Riddoch, a campaigning journalist, commentator and broadcaster.

Draft Minutes Meeting Fossoway and District Community Council

Tuesday 6th November 2012, Moubray Hall, Powmill

Community Policing: Community police officer (Sadie Allan) reports: The lack of 30mph signs at Naemoor Road junction that was reported at the last meeting – PKC have been contacted. Community Speed Watch – full report not yet published, but trial was very successful, permanent implementation being considered. Speed checks carried out by Police as requested by previous meetings – resulting in four offences being detected. Crimes: Red diesel stolen in Blairingone; A lawn mower worth £500 was stolen from a house in Crook of Devon. Cllr Barnacle reports that the A977 Closure for resurfacing (next week) will result in alternative transport plans using back roads, although these roads are not really suitable, also normal parking places for school runs will not be available. Could Police increase their presence during the works to ensure road safety? PC Allan will inform officers to check whether there are any problems.

Matters arising:
Blairingone War Memorial: Alastair reports that the application has been passed. Cllr Barnacle suggests that the CC writes to the developer asking when development will commence.
Crook of Devon Church Car Park: Planning approval has been received and handed to the church for action.
Signposting Core Paths and Rights of Way: Cllr Barnacle reports that letters to landowners should be sent out over the course of the next month.
Lambhill Wood Chip Plant at Blairingone: Alastair reports that Calum Snowie has asked if he can give a presentation to this CC on Tuesday 4th December – To be confirmed. The CC reminds the public to report any noise or traffic issues. Cllr Barnacle contacted the case and enforcement officers emphasising that the application is being submitted as two parts – No reply as yet.
Travellers’ Site at Crook Moss, Crook of Devon: Alastair reports that the Planning Application was deferred at the meeting - however there are still things happening at the site. The CC officially complained about the flaws in the planner’s report – this complaint is now being handled as a Phase 2 complaint. The CC’s complaint was originally erroneously passed to the Planning Department, who actually replied admitting that there were errors in the report.
Sandy’s complaint that the report lacked clarity has been replied to with some points accepted and others rejected – discussion continues. Once the complaint process has been concluded, this CC needs to decide what happens next: We want an apology from the Planners for misleading the Planning Committee; also there is currently no way to correct errors in the Planner’s Report, so perhaps a review process needs to be put in place.
Cllr Barnacle met the Planning Committee Convenor and Vice Convenor to discuss our complaint.
Entrance to the site has been reinforced because vehicles were sinking into the ground – the work was supervised by the Compliance Officer.
Ann-Marie Dewar of Scottish Water has investigated the capacity of Drum Sewage Works and confirms that it has limited capacity such that this site cannot be connected.
Sandy, Kevin and Cllr Barnacle will be meeting with Gordon Banks MP on 12th November.
Catering Kiosk at Craigton Road, Powmill: The CC didn’t object to this application, however the report for the planning permission asserted that there would not be a traffic problem; the permission only allows one year of operation (from the application date); The large sign originally erected at the site will have to be removed, since it would have needed planning permission, and will have to be replaced with a smaller (1.2m) sign. Although there is a reasonable amount of parking at the site there have still been instances of HGVs parking on the road.

CC Business: No Meetings attended this month.

PKC Councillors’ reports:
Cllr Barnacle: Attended a seminar on wind energy, the local plan’s coverage of Wind Farm Applications will be revised. Ward Councillors are meeting Planning Officers in November to discuss various planning issues. The path between Crook of Devon and the river is scheduled for improvement once deer rut is over. Carnbo Post Box will not be replaced due to insufficient number of houses in Carnbo. U213 passing places – two extra places will be installed at Council’s expense rather than the applicants due to the Highway Department’s handling of the planning application.

Planning:

Recommendation: No Community Council comment

12/01461/FLL. Biomass boiler at Scripture Union, Rumbling Bridge – This application was overlooked by the CC and no objection was made, but received no objections anyway. A resident expressed concern about possible HGV traffic to supply the boiler’s fuel.

Glendevon Energy hydro scheme (previously presented to this CC) is no longer being actively developed due to GS Brown withdrawing their support pending their own developments at Monarch Deer Farm. A possible alternative route for the pipeline using the old railway cutting may allow development to take place.

AOCB:
A977 road closure in Main Street, Crook of Devon from 12th November – some residents received letter about this, emailed PKC officers about traffic control on minor roads and school buses. Neither Muckhart CC nor Clacks Council has been informed, although diverted traffic will pass through their areas. Further this CC is not on the list of official notifications.

Future: A977 will also be closed in Blairingone from 22nd November to 7th December.
Councillor Barnacle confirmed that the repairs were due to damage to the road caused by LGVs.

Community Policing: Community police officer was not present, but sent a report: A977 closure and concern over school run parking – checks made; Carnbo speed checks continue; No recent crimes; Speed checks continue on local arterial routes; Operation Ainslie (12th November – 24th December) aims to target and disrupt housebreakers in the Tayside area which then use the A9 as a rapid escape route – Any information from the public concerning this is welcome.

Matters arising:
• Blairingone War Memorial: Alastair reports that the developer does plan to move the war memorial.
• Crook of Devon Church Car Park: Church is progressing this.
• Signposting Core Paths and Rights of Way: Cllr Barnacle says that there is no news about this.
• Lambhill Wood Chip Plant at Blairingone: Calum Snowie will not be presenting to this meeting – a date will be fixed in the future, hopefully at the next meeting as that is in Blairingone. Gordon Banks MP has written to David Littlejohn to clarify the details of the applications. Cllr Barnacle reports that Cllr Cuthbert has written to Nick Bryant and has received a response explaining why the applications are being handled separately.
• Travellers’ Site at Crook Moss, Crook of Devon: Sandy reports that Phase 2 responses to the complaints are being processed and are due by 8th December. Cllr Barnacle notes that the 1st August meeting deferred the application pending reports on grey water disposal and contaminated land and there has been no change since, meanwhile the occupants are still there; MoPs ask what SEPA are doing – investigations continue but they can’t do anything without proof of damage. There was extensive discussion on this item and considerable disquiet from members of the public regarding the council officers responses and lack of response to the communities concerns.
• Catering Kiosk at Craigton Road, Powmill: The sign has been reduced in size. Cllr Barnacle has had a phone call from the owners of the Milk Bar expressing concern about the number of signs – the PKC enforcement officer has instructed the owner to remove signs other than those on his own land.

CC Business: Kevin attended Dunning Glen meeting - Police have spent quite a lot of time making checks of people and vehicles at the site which has resulted in some offences being reported. The Police request reports (to the non-emergency number) whenever there are congregations of people there.
Sandy, Kevin and Cllr Barnacle met with Gordon Banks MP on 12th November to discuss the Traveller’s Site (as minuted above.) Gordon suggested that another route of complaint might be for the community to approach Audit Scotland.
Sandy attended Planning Users’ Forum – a proposal was made to involve CCs in the preparation of the next local plan in four years’ time, this seems ironic since our input to the current plan was largely ignored!
Sandy attended Working with Community Councils meeting, where all the other CC representatives agreed that their views were also largely ignored.
Angus attended Kinross Fund Meeting where five grants were awarded.

PKC Councillors’ reports:
Cllr Barnacle: Kinross ward councillors met with Peter Marshall and Nick Bryant and discussed the status of the AGLV, flood risk concerns, interpretation of Housing in the Countryside policies, lack of reference to any work done by the Strategy Group in any planning report ; and Wind Turbine policies. The planners expressed a desire to improve their relationship with the CCs – it was suggested that the planners should attend the CC network meetings.
Carnbo telephone box has disappeared - pavement restoration needs to be done appropriately to mitigate flooding, the Roads department assure Cllr Barnacle they will do the right thing.
Rumbling Bridge 30mph speed limit sign has been moved, not to Naemoor road as previously suggested, but to a location that has caused new concerns from other residents. In the longer term, this will be addressed by making Naemoor road a “green road” which will mean it gets a 20mph limit.
Meeting with roads department discussed Drum Main street access only request which will be addressed by improving signage to encourage vehicles to take the main road instead.
Meeting with public transport unit about bus services – Cllr Barnacle has proposed a figure of eight loop around the villages, comments and other bus route suggestions invited from all.
Local Plan: Although there were over 1500 representations to the draft plan, there is no intention by Forward Planning to change the plan at all! The only result is that a report of the representations will be sent with the draft plan to the Reporter. A special PKC meeting will be held in January to give local members an opportunity to propose amendments, or pass the plan unchanged. The Councillors need input from the CC as to which items are sufficiently serious that our councillors should raise amendments to change them. Alastair suggests that the most significant omission from the plan is that it covers nothing other than housing, i.e. no infrastructure improvements, school provision, etc. Also a policy for Blairingone housing is needed. It was agreed that the CC members would discuss the issue prior to Christmas in order to give feedback to the Councillors.

Correspondence: Full list was circulated to the attendees; however upcoming events of interest are as follows:
• B9097 Closure between junction with A977 and U241, Drum, from 10th December for two weeks.
• Waste Collection over festive period: No uplift on 25th, 26th December, 1st and 2nd January.

AOCB:
Road Closure A977: There was extensive discussion on this item. Traffic attempting to avoid the closure caused some problems in spite of the council signposting diversions. Cllr Barnacle points out that the traffic chaos caused proves that the A977 is a significant route through this area. The CC will give feedback to the council on extra signage.

Road closure B9097 10th December: In the absence of physical barriers, then it’s likely that people will take inappropriate diversions again.

Jim Marshall of Walkmill (amongst other residents) reports that the water supply to Crook of Devon smells of Chlorine – Is this a widespread problem? Cllr Barnacle reports that Scottish Water has done some tests and is still investigating. A notice will be posted in the shop requesting any residents who are concerned to contact the CC, Mike Barnacle, or Scottish Water, thanks to Andrew for his co-operation.

Advertising on CC notice boards, e.g. from the Forestry Commission will no longer be allowed.
